Justice ANTONY DOMINIC\n\n Dated :02\/09\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n             ```````````````````````````````````````````````````````\n                    W.P.(C) No. 27256 of 2010 F\n             ```````````````````````````````````````````````````````\n             Dated this the 2nd day of September, 2010\n\n                            J U D G M E N T\n<\/pre>\n<p>            The petitioner is the occupant of property comprised in<\/p>\n<p>Survey No.61\/11 of KDH Village.               He approached the second<\/p>\n<p>respondent complaining that he is proposed to be evicted from the<\/p>\n<p>land. Accordingly, the matter was considered with notice to the<\/p>\n<p>petitioner and Ext.P4 order has been issued. After considering the<\/p>\n<p>contentions of the petitioner including the genuineness of Ext.P1<\/p>\n<p>patta, the District Collector came to the following findings:-<\/p>\n<p>                   &#8221;   In   the    meanwhile       the    Tahsildar,<\/p>\n<p>            Devikulam has reported that, on verification of<\/p>\n<p>            the documents, it was found out that there was no<\/p>\n<p>            assignment made as LA.39\/80 in the year 1980,<\/p>\n<p>            from his office.       Only one Land Assignment<\/p>\n<p>            Order was issued in 1980. It was in favour of<\/p>\n<p>            Smt.Mary Alphonsa, New Colony, Munnar as<\/p>\n<p>            LA.1\/80.     Moreover, the boundaries of the<\/p>\n<p>            property are mentioned differently in the Patta,<\/p>\n<p>            in the survey sketch and in the possession<\/p>\n<p>            certificate.\n<\/p>\n<p>                   The petitioner was present for the hearing<\/p>\n<p>WPC.27256\/2010<br \/>\n<span class=\"hidden_text\">                                   : 2 :<\/span><\/p>\n<p>           conducted on 28-01-2009.       But he could not<\/p>\n<p>           produce any valid documents to prove his right<\/p>\n<p>           over the property. Exhibits P1 to P5 are bogus<\/p>\n<p>           documents and do not warrant any right to the<\/p>\n<p>           petitioner over the plaint schedule property.<\/p>\n<p>                 Verification of the documents and the<\/p>\n<p>           report of the Tahsildar, prove the case is one of<\/p>\n<p>           fabrication of fake documents in order to grab<\/p>\n<p>           Govt. Land which in turn is a criminal offence.<\/p>\n<p>           The petitioner&#8217;s application for assignment also<\/p>\n<p>           cannot be considered on merit, because he is an<\/p>\n<p>           unauthorised occupant of Govt. land. The land<\/p>\n<p>           in question is Puramboke.          Moreover the<\/p>\n<p>           petitioner is not in actual possession of the<\/p>\n<p>           property.\n<\/p>\n<p>                 In    the     above    circumstances,   the<\/p>\n<p>           application for assignment, Exhibited as P9 is<\/p>\n<p>           declined.\n<\/p>\n<p>                 The Tahsildar, Devikulam will file FIR<\/p>\n<p>           against those who fabricated the documents and<\/p>\n<p>           will proceed further in the matter.&#8221;<\/p>\n<p>     2.    Ext.P5 appeal filed by the petitioner before the first<\/p>\n<p>respondent was also rejected by Ext.P8. It is challenging Exts.P4<\/p>\n<p>and P8, the writ petition is filed.\n<\/p>\n<p>WPC.27256\/2010<br \/>\n<span class=\"hidden_text\">                                    : 3 :<\/span><\/p>\n<p>      3.    The finding in the impugned orders is that patta, on the<\/p>\n<p>strength of which the petitioner is setting up his possession, is a<\/p>\n<p>bogus one. Nothing has been produced in this writ petition to infer<\/p>\n<p>that the said conclusion is erroneous.               Even otherwise,<\/p>\n<p>genuineness of patta, which the petitioner will have to establish,<\/p>\n<p>can be done only in a civil suit and not in a proceedings under<\/p>\n<p>Article 226 of the Constitution of India. In these circumstances,<\/p>\n<p>the writ petition is liable to be dismissed and I do so.<\/p>\n<p>      Be that as it may, the fact remains that the petitioner is in<\/p>\n<p>possession of the land.
