Jindal, J\n\n<\/pre>\n<p>              An application for suspension of sentence has been moved by<br \/>\nPardeep Barua (husband) who was convicted under Section 304-B IPC and<br \/>\nsentenced to undergo rigorous imprisonment for 10 years on account of<br \/>\ndowry death of Ratna. Ratna died other than in the normal circumstances<br \/>\nwhile living at the house of the accused. She has been treated with cruelty<br \/>\non account of demand of dowry. The main grouse of the applicant-appellant<br \/>\nis that in the dying declaration given by the deceased, she had stated that she<br \/>\ncaught fire accidently. The deceased being in her 20s and having died<br \/>\nwithin two years of her marriage would not have taken such a drastic step<br \/>\nwithout any rhyme or reason, while ignoring small child in her lap. The<br \/>\nfirst dying declaration has not come on record and it is still to be established<br \/>\nwhether the same was made voluntarily and in a fit state of mind by the<br \/>\nprosecutrix when her husband (the accused) was on her side. In any case,<br \/>\nthe prosecution has examined 13 witnesses in order to establish her un-<br \/>\nnatural death due to maltreatment on account of demand of dowry.<br \/>\n Crl. Misc. Appeal No. 1958-SB of 2007                                     -2-<\/span><\/p>\n<p>            When once a person is convicted and sentenced accordingly,<br \/>\nthen Appellate Court will proceed on the basis that such person is guilty.<br \/>\nThe provisions as envisaged under Section 389 Cr.P.C. cannot be exercised<br \/>\nas a matter of course merely on the fact that during the period of trial the<br \/>\naccused was on bail and there was no misuse of the liberty does not per se<br \/>\nwarrant the suspension of the execution of the sentence and grant bail, but it<br \/>\nhas to be considered whether there really existed some reasons to suspend<br \/>\nthe sentence and grant bail.    It   was   observed     in   case    <a href=\"\/doc\/140906570\/\">Gomti   vs.<br \/>\nThakurdas and others<\/a>, 2007 (2) RCR (Crl.) 714 that what really was<br \/>\nnecessary to be considered by the High Court is whether reasons existed to<br \/>\nsuspend the execution of sentence and thereafter grant bail.\n<\/p>\n<p>            On analysis of the aforesaid judgment, it transpires that the<br \/>\nApex Court observed as under :-\n<\/p>\n<blockquote><p>            &#8220;(i)    the sentence could be suspended only in exceptional<br \/>\n                    cases;\n<\/p><\/blockquote>\n<blockquote><p>            (ii)    the mere fact that during the period of trial, the accused<br \/>\n                    was on bail and there was no misuse of liberty does not<br \/>\n                    per se warrant suspension of execution of sentence.\n<\/p><\/blockquote>\n<blockquote><p>            (iii)   the observations given Dharam Pal&#8217;s case (supra)<br \/>\n                    cannot be understood to have laid an invariable rule to be<br \/>\n                    observed with mathematical precision and sentence could<br \/>\n                    be suspended at any time and even while admitting the<br \/>\n                    appeal.\n<\/p><\/blockquote>\n<blockquote><p>            (iv)    in Vijay Kumar&#8217;s case (supra), it was observed that the<br \/>\n                    Court while considering the prayer for bail, must look<br \/>\n                    into the relevant factors i.e. the manner in which the<br \/>\n                    crime is alleged to have been committed, the gravity of<br \/>\n                    the offence and the desirability of releasing the accused<br \/>\n                    on bail after he has been convicted for committing<br \/>\n                    serious offence of murder, etc.;&#8221;\n<\/p><\/blockquote>\n<p> Crl. Appeal No. 1958-SB of 2007                              -3-<\/span><\/p>\n<p>            The aforesaid observations takes me to settle that the sentence<br \/>\ncould be suspended only where there existed reasons for suspending the<br \/>\nsame.\n<\/p>\n<p>            Since the application lacks reasons, therefore, the sentence<br \/>\ncannot be suspended.
