Sharma, JJ.\n<\/pre>\n<p>                                   Heard both the parties.\n<\/p>\n<p>                                   The appellant-writ petitioner responded an<\/p>\n<p>                   advertisement, which suggested that 137 flats would be sold<\/p>\n<p>                   on &#8216;first come first served&#8217; basis to the persons responding to<\/p>\n<p>                   the advertisement in respect of a flat of his choice. Appellant-<\/p>\n<p>                   petitioner has challenged the said advertisement and in<\/p>\n<p>                   particular, the decision conveyed thereby that the allotment of<\/p>\n<p>                   the flat in question would depend upon the promptness of the<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>responder. Appellant-petitioner wanted allotment of flat no.<\/p>\n<p>201 in Block 3 on Road No.10B. The acknowledgment of<\/p>\n<p>such response, however, has not been placed on records of<\/p>\n<p>this case. The appellant-petitioner, however, does not dispute<\/p>\n<p>that she was the third applicant in respect of the said flat.<\/p>\n<p>Because she was the third applicant in respect of the said flat,<\/p>\n<p>having regard to the decision conveyed in the advertisement,<\/p>\n<p>the appellant-petitioner was aware that she would not be<\/p>\n<p>allotted the said flat, unless the first two applicants back out.<\/p>\n<p>It was the delay on the part of the appellant-petitioner in<\/p>\n<p>making the application, which resulted in loss of her prospect<\/p>\n<p>of being the allottee of the flat in question. If the appellant-<\/p>\n<p>petitioner had been the first applicant in respect of the flat in<\/p>\n<p>question, having regard to the nature of the averments made<\/p>\n<p>in the writ petition, the appellant-petitioner would not have<\/p>\n<p>approached this Court at all, for in no uncertain terms she had<\/p>\n<p>disclosed how beneficial it would be for her if she is allotted<\/p>\n<p>the said flat. A person, who has taken his chance on the terms<\/p>\n<p>and conditions disclosed to him by an advertisement, after<\/p>\n<p>having had failed to achieve his object under the<\/p>\n<p>advertisement, should not, nor can be permitted to turn<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>                    around and challenge the advertisement.<\/p>\n<p>                                  On that principle, we dismiss the appeal,<\/p>\n<p>                    which was preferred against the order dismissing the writ<\/p>\n<p>                    petition.\n<\/p>\n<p>                                  Accordingly, the appeal is disposed of.\n<\/p>\n<\/p>\n<p>                                                (Barin Ghosh, J.)<\/p>\n<p>                                                (Shyam Kishore Sharma, J.)<\/p>\n<p>Patna High Court, Patna<br \/>\n22nd December, 2008,<br \/>\nS.B.P.\/N.A.F.R.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court Smt.
