It   is   contended  by   the  counsel  for   the<br \/>\n        petitioners that the petitioners are IVth grade employees<br \/>\n        and serving in different trades like Cooks, washerman and<br \/>\n        Cleaners  etc.   The petitioners are enrolled members  of<br \/>\n        the  Railway Protection Special Force.  It is the case of<br \/>\n        the  petitioner that in exercise of the powers  conferred<br \/>\n        by  Section 21 of the Railway Protection Force Act, 1957,<br \/>\n        the  Central Government has framed the Railway Protection<br \/>\n        Force  Rules  1987.  Chapter VI of the said  Rules  deals<br \/>\n        with  the Pay Remuneration and duration of service.   Pay<br \/>\n        scales  of  the enrolled members of the Force  have  been<br \/>\n        given in Rule 78.1, which is to the following effect:\n<\/p>\n<blockquote><p>                         &#8220;Ancillary  staff  shall draw  the  same<br \/>\n                    scales  of  pay  as is  admissible  to  other<br \/>\n                    enrolled members holding that rank&#8221;.\n<\/p><\/blockquote>\n<p>2.                    It  is  the  case of the  petitioner  that  the<br \/>\n           petitioners  were called Ancillary Staff.  As such  they<br \/>\n           are  also  entitled to draw the same scale of pay as  is<br \/>\n           admissible  to  the  enrolled members holding  the  same<br \/>\n           rank.\n<\/p>\n<p>   3.                  Learned   counsel   for   the  petitioner   has<br \/>\n           contended  that in similar circumstances the Madras High<br \/>\n           Court  in 18 R.  Gandhi &amp; Ors.  Vs.  The Chief  Security<br \/>\n           Commissioner,   Railway   Protection   Force   &amp;   Ors.,<br \/>\n           (C.W.P.No.   13322\/90), decided on 1.12.98, on the basis<br \/>\n           of  Rule 78.1 of the RPSF Rules, 1957, that  petitioners<br \/>\n           were entitled to the same scales of pay as admissible to<br \/>\n           other enrolled members holding that rank.\n<\/p>\n<p>  4.                   On  the  other hand, counsel appearing for  the<br \/>\n           respondent  on  last date of hearing took time  to  file<br \/>\n           additional  affidavit.   However, the same has not  been<br \/>\n           filed.   Counsel  for the respondent says that she  does<br \/>\n           not want to file additional affidavit and the matter can<br \/>\n           be  argued  straightway.  She has contended that  Fourth<br \/>\n           Pay Commission has recommended the replacement scales as<br \/>\n           regards  the  Ancillary staff of the force, and did  not<br \/>\n           recommend  the  same pay scales for the ancillary  staff<br \/>\n           that  of the other enrolled members of the  force.\n<\/p>\n<p>    5.                 The    Central    Government,    accepted   the<br \/>\n           recommendations  of the Fourth Pay Commission and issued<br \/>\n           Notification    dated     19.9.86    framing    &#8220;Railway<br \/>\n           Service(Revised  Pay) Rules 1986&#8221;, which were framed  by<br \/>\n           the  President  of  India  in  exercise  of  the  powers<br \/>\n           conferred  by  the  provisions  of Article  309  of  the<br \/>\n           Constitution  of  India.  On the basis of the  aforesaid<br \/>\n           Notification,  it has been contended by the counsel  for<br \/>\n           the  respondent that the petitioners are not entitled to<br \/>\n           the  same  pay scale as that of enrolled members of  the<br \/>\n           Force.\n<\/p>\n<p>    6.                 I  have  given my careful consideration to  the<br \/>\n           arguments  advanced by the counsel for the parties.   In<br \/>\n           view  of  the  fact  that  counsel  for  respondent  has<br \/>\n           contended  that  Notification was issued  in  September,<br \/>\n           1986 and the Rules have been framed by the respondent in<br \/>\n           1987,  wherein according to Clause 78.1 under Chapter VI<br \/>\n           of  the said Rule, which has been framed by the  Central<br \/>\n           Government  under  Section 21 of the Railway  Protection<br \/>\n           Force  Act  1957,  it does not reflect the  contents  of<br \/>\n           Notification  issued  in  September,1986  based  on  the<br \/>\n           recommendation  of the Fourth Pay Commission.  Therefore<br \/>\n           it  is the rules which will govern the field and not the<br \/>\n           notification  which  was prior in time than  the  rules.<br \/>\n           Therefore,  following judgment of the Madras High Court<br \/>\n           in  18 R.Gandhi (supra), this writ petition is  allowed.<br \/>\n           The  prayer  of  the  writ  petition  is  granted.   The<br \/>\n           respondents are directed to comply with the order within<br \/>\n           three months.\n<\/p>\n<p>     7.
