Justice V.GIRI\n\n Dated :05\/11\/2008\n\n O R D E R\n                         V.GIRI, J\n                       -------------------\n                   W.P.(C).31883\/2008\n                       --------------------\n      Dated this the 5th day of November, 2008\n\n                       JUDGMENT\n<\/pre>\n<p>      Petitioners claim to be the owners of 55 acres of<\/p>\n<p>property in Survey No.38\/2 of Shornur Village in<\/p>\n<p>Palakkad District.     The said land, though originally<\/p>\n<p>proposed to be treated as vested forest lands,             is<\/p>\n<p>stated to have been later handed over to the<\/p>\n<p>petitioners on a declaration made in that behalf by the<\/p>\n<p>competent Forest Tribunal.               Petitioners are now<\/p>\n<p>aggrieved by the proposal on the part of the<\/p>\n<p>respondents to treat the same as ecologically fragile<\/p>\n<p>land. Petitioners have filed Ext.P1 objection before the<\/p>\n<p>second respondent, who is competent to take a<\/p>\n<p>decision on such objections and decide whether the<\/p>\n<p>land is liable to be treated as ecologically fragile.<\/p>\n<p>      Having heard learned                Special Government<\/p>\n<p>Pleader also, writ petition is disposed of directing the<\/p>\n<p>second respondent to consider and take a decision on<\/p>\n<p>Ext.P1 within a period of six months from the date of<\/p>\n<p>W.P.(C).31883\/2008<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>receipt of a copy of this judgment.
