Brar, Deputy Advocate General, Punjab,\n             for the appellant.\n\n             Mr. Amarjit Markan, Advocate,\n             for the respondents.\n\n\nS.D. Anand, J.\n<\/pre>\n<p>             Respondents &#8211; accused Hari Singh, Nima Singh and<\/p>\n<p>Kaur Singh sons of Puran Singh are real brothers inter se; while<\/p>\n<p>respondents &#8211; accused Bhagwan Singh and Roop Singh sons of<\/p>\n<p>Wariam Singh are also real brothers of each other.    Out of the five<\/p>\n<p>respondents &#8211; accused, Hari Singh and Bhagwan Singh are dead. It<\/p>\n<p>has been brought to our notice today that injured Gurdev Singh is<\/p>\n<p>also dead.\n<\/p>\n<p>             Injured Sukhdev Singh and respondents &#8211; accused were<\/p>\n<p>litigating proceedings for partition of a joint khata in the Revenue<br \/>\n<span class=\"hidden_text\"> Crl. Appeal No. 784-DBA of 1997                                     2<\/span><\/p>\n<p>Court. On the relevant date, at about 8 p.m. the respondents (out of<\/p>\n<p>whom Hari Singh, Kaur Singh and Bhawan Singh were carrying a<\/p>\n<p>gandasa each; while the remaining were carrying a Soti) appeared<\/p>\n<p>on the scene and belaboured Gurdev Singh who fell down upon the<\/p>\n<p>ground. The occurrence was witnessed by PW6 &#8211; Sukhdev Singh,<\/p>\n<p>PW3 &#8211; Bhajan Singh and PW2 &#8211; Gurdev Singh.\n<\/p>\n<p>             The learned Trial Judge, on appraisal of the evidence on<\/p>\n<p>record, recorded the following finding of fact:-<\/p>\n<blockquote><p>             &#8220;13. It is in these circumstances that not only it can be<\/p>\n<p>             said that the statements of the alleged eye witnesses<\/p>\n<p>             Bhajan     Singh     and   Sukhdev    Singh   P.Ws.    are<\/p>\n<p>             contradictory, with regard to the place of occurrence, to<\/p>\n<p>             the statement of injured complainant Gurdev Singh P.W.<\/p>\n<p>             but also it further causes serious doubts about the<\/p>\n<p>             statements of Bhajan Singh and Sukhdev Singh P.Ws.<\/p>\n<p>             that they could have seen the occurrence or part thereof<\/p>\n<p>             from the Chobara when they were present, because, in<\/p>\n<p>             case the occurrence took place inside the residential<\/p>\n<p>             room over which the Chobara is situated, they could not<\/p>\n<p>             have seen the same. It is not the case of Gurdev Singh<\/p>\n<p>             that, during the occurrence, he was brought out from the<\/p>\n<p>             room into the Court-yard. It is doubtful if Bhajan Singh or<\/p>\n<p>             Sukhdev Singh saw occurrence. At least, with regard to<\/p>\n<p>             Sukhdev Singh P.W., it can be said that his name is not<\/p>\n<p>             at all mentioned in the statement Ex.PC made by Gurdev<br \/>\n<span class=\"hidden_text\"> Crl. Appeal No. 784-DBA of 1997                                        3<\/span><\/p>\n<p>             Singh, to the investigating officer and which statement<\/p>\n<p>             has become the F.I.R. in this case.\n<\/p><\/blockquote>\n<blockquote><p>             14. &#8230;&#8230;&#8230;&#8230; Accordingly, both the father (Gurdev Singh<\/p>\n<p>             P.W.) and the son (Bhajan Singh P.W.) are contradictory<\/p>\n<p>             about the source from which they had obtained the<\/p>\n<p>             electric connection, but they are also discrepant,<\/p>\n<p>             alongwith Sukhdev Singh P.W. regarding the place where<\/p>\n<p>             the electric bulbs were available for that light. It the light<\/p>\n<p>             was only in the inner room and the occurrence took place<\/p>\n<p>             in the Court-yard they it may have been difficult to identify<\/p>\n<p>             the assailants by any person, who had allegedly seen the<\/p>\n<p>             occurrence taking place in the Court-yard. It there was<\/p>\n<p>             light in the Court-yard only and not in the room then the<\/p>\n<p>             assailants may not have identified by a person who might<\/p>\n<p>             have seen the occurrence inside the room&#8230;<\/p>\n<\/blockquote>\n<blockquote><p>             15.   With these circumstances, the inordinate delay in<\/p>\n<p>             lodging of the F.I.R. becomes a matter which cannot be<\/p>\n<p>             ignored. According to Bhajan Singh and Sukhdev Singh<\/p>\n<p>             P.Ws. they had accompanied the injured to the Civil<\/p>\n<p>             Hospital at Malerkotla and they remained present with<\/p>\n<p>             him. &#8230;.. The doctor has also deposed that he talked with<\/p>\n<p>             the injured and made a note in the bed head ticket to the<\/p>\n<p>             effect that the injured had stated that he received the<\/p>\n<p>             injuries in a fight with someone. However, the statement<\/p>\n<p>             of the injured was not recorded at that time. The<\/p>\n<p>             explanation put-forth by Bhajan Singh P.W. is that no<br \/>\n<span class=\"hidden_text\"> Crl. Appeal No. 784-DBA of 1997                                      4<\/span><\/p>\n<p>             doubt, before coming to the Civil Hospital, Malerkotla,<\/p>\n<p>             they had gone to the police station at Amargarh yet the<\/p>\n<p>             Officer Incharge at that police station told him that first<\/p>\n<p>             the medico legal report should be obtained and then the<\/p>\n<p>             report would be recorded. Apparently, there is none to<\/p>\n<p>             support this fact and it appears to be a made up<\/p>\n<p>             version&#8230;&#8230;..Even when the Doctor declared at 6.30 p.m.<\/p>\n<p>             on 25.12.1991 that Gurdev Singh was unfit to make a<\/p>\n<p>             statement because he was under the effect of seddation,<\/p>\n<p>             then also Bhajan Singh or Sukhdev Singh could have<\/p>\n<p>             made    a   statement   about   the   occurrence   to   the<\/p>\n<p>             Investigating Officer. They did not make any such<\/p>\n<p>             statement and it was only in 26.12.1991 that when the<\/p>\n<p>             doctor opined at 3.30 p.m. that Gurdev Singh was fit to<\/p>\n<p>             make a statement, vide endorsement with Ex.D\/1 that<\/p>\n<p>             thereafter the statement Ex.PC of Gurdev Singh was<\/p>\n<p>             recorded on 26.12.1991 by 5.00 p.m.         The delay in<\/p>\n<p>             lodging of the F.I.R. is thus a circumstance which goes<\/p>\n<p>             against the prosecution and the plea taken by the<\/p>\n<p>             accused is plausible that till 26.12.1991 the witnesses<\/p>\n<p>             were busy in making up a story.&#8221;<\/p><\/blockquote>\n<p>             We have satisfied ourselves that the finding recorded by<\/p>\n<p>the learned Trial Judge proceeds on factually correct premise. We<\/p>\n<p>also do not find anything perverse in the manner of appreciation of<\/p>\n<p>evidence. The Court had, in any case taken a possible view in the<\/p>\n<p>matter. In view of the parameters laid down by the Apex Court in<br \/>\n<span class=\"hidden_text\"> Crl. Appeal No. 784-DBA of 1997                                     5<\/span><\/p>\n<p><a href=\"\/doc\/264653\/\">Ramesh Babulal vs. State of Gujarat, AIR<\/a> 1996 SC 2035, Jaswant<\/p>\n<p>Singh vs. State of Haryana, AIR 2000 SC 1833 and Main Pal vs.<\/p>\n<p>State of Haryana, AIR 2004 SC 2158, we are not inclined to interfere<\/p>\n<p>in the finding of acquittal recorded by the learned Trial Court.<\/p>\n<p>             The appeal against Hari Singh and Bhagwan Singh shall<\/p>\n<p>stand dismissed as abated; while the appeal against Kaur Singh,<\/p>\n<p>Nima Singh and Roop Singh shall stand dismissed on merits of the<\/p>\n<p>matter.<\/p>\n<pre>\n\n\n\n                                                ( S.D.
