MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE AKIL KURESHI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/10\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE AKIL KURESHI)<\/p>\n<p>\tSince<br \/>\ncommon questions of  facts  and law arise in this group of petitions,<br \/>\nthey have been heard together and are being disposed of by this<br \/>\ncommon order.\n<\/p>\n<p>\tPetitioners<br \/>\nare trusts running educational institutions.  They have questioned<br \/>\nthe fee structure for the students  in the respective colleges as<br \/>\nfixed by the Fee Regulatory Committee, respondent herein.  The main<br \/>\ngrievance of the petitioners  is that though as per the<br \/>\nrecommendations of the 6th  Pay Commission, teaching and<br \/>\nnon-teaching  staff of the concerned colleges are required to be paid<br \/>\nhigher revised salary, the Committee has not taken into account such<br \/>\nadditional burden and has fixed the fee structure which is not<br \/>\nsustainable.\n<\/p>\n<p>\tPreviously<br \/>\nsuch issues had reached  this Court, notably in Special Civil<br \/>\nApplication No.9241 of 2010 and connected matters.  This group of the<br \/>\npetitions came to be disposed of by order dated 1st<br \/>\nOctober 2010. Referring and relying  on the previous order of similar<br \/>\nnature, the Division Bench made the following observations and<br \/>\ndirections :\n<\/p>\n<p>We have<br \/>\nnoticed that in similar cases viz., S.C.A No. 3289\/2009<br \/>\n{Rotary Foundation for Education &amp; Learning &amp; Anr.<br \/>\nv\/s.\n<\/p>\n<p>Justice RJ Shah (Retd.) Fee Committee} and analogous<br \/>\ncases, this Court has already decided the issue and passed Order on<br \/>\n23\/03\/2010, relevant portion of which reads as follow :-\n<\/p>\n<p>\t&#8220;Firstly,<br \/>\nwe find that in some of the cases though the petitioners had<br \/>\nrequested for personal hearing, the same was not granted. Secondly,<br \/>\nthough the petitioners-institutions are required to implement the<br \/>\nrecommendations of the 6th Pay Commission for teaching &amp;<br \/>\nnon-teaching staff and revise their salary accordingly, such revision<br \/>\nhas not been taken into consideration by the Committee in the fee<br \/>\nstructure.\n<\/p>\n<p>\tConsidering<br \/>\nall these aspects of the matter, we are of the opinion that the<br \/>\nentire issue of fee-structure requires reconsideration by the<br \/>\nCommittee. Under the circumstances, the impugned orders of fee<br \/>\nfixation in respect of each petition are set-aside. The matters are<br \/>\nremanded to the Committee for fresh consideration and decision in<br \/>\naccordance with law after hearing the petitioners. If the petitioners<br \/>\ngive an undertaking that they will actually implement the<br \/>\nrecommendations of the 6th Pay Commission for its teaching<br \/>\nas well as non-teaching staff, such additional burden shall also be<br \/>\ntaken into account while deciding the fee structure afresh. Such<br \/>\nfresh orders may be passed expeditiously. Till such orders are passed<br \/>\nas mentioned above, the petitioners shall continue to collect same<br \/>\nfees from the students as they are collecting presently under the<br \/>\norders of the Fee Committee.&#8221;\n<\/p>\n<p>\t   The<br \/>\ncase of the petitioners&#8217; being similar to the case of  Rotary<br \/>\nFoundation for Education &amp; Learning &amp; Anr. [Supra] and<br \/>\nanalogous cases,  these cases are also disposed of with the<br \/>\nsimilar observation and direction. The Fee fixation as already made<br \/>\nin respect of each petitioners are set-aside, the matters are<br \/>\nremitted to the Fee Committee for fresh consideration and decision in<br \/>\naccordance with observation, as quoted above, after hearing the<br \/>\npetitioners.  If the petitioners file undertaking that they will<br \/>\nactually implement the recommendations  made by the 6th<br \/>\nPay Commission for its teaching &amp; non-teaching staff, such<br \/>\nadditional burden shall also be taken into consideration while<br \/>\ndeciding the fee structure afresh, the orders may be passed<br \/>\nexpeditiously.  Till such orders are passed, as mentioned above, the<br \/>\npetitioners shall continue to collect same fees from the students as<br \/>\nare collected presently under the orders of the Fee Regulatory<br \/>\nCommittee. &#8221;\n<\/p>\n<p>\tSince<br \/>\nissues in this group of petitions is also identical, we are of the<br \/>\nopinion that similar directions  need to be given in favour of the<br \/>\npetitioners also.\n<\/p>\n<p>\tIn<br \/>\nthe result, all these petitions are disposed of requesting the  Fee<br \/>\nRegulatory Committee  to fix fresh fee structure for the concerned<br \/>\nacademic years  after taking into account the additional burden which<br \/>\nthe colleges may have to bear upon implementation of the 6th<br \/>\nPay Commission recommendations on their giving undertaking that<br \/>\nrevised salaries are being paid.  After verifying such details, the<br \/>\nFee Regulatory  Committee  shall fix the fee structure  for the<br \/>\nconcerned colleges.  The existing fee structure is therefore,  set<br \/>\naside.  However, till such fresh decision is taken, it would be open<br \/>\nfor the colleges to collect and if already collected retain the fee<br \/>\nas fixed by the Fee Regulatory Committee so far.    Such fresh<br \/>\ndecision may be taken expeditiously.
