The plaintiff had \ufb01led Q.S.No.35\/ 2000 seeking speci\ufb01c<\/p>\n<p>performance 0f ageemant of Saki: dated 25.11.1988<\/p>\n<p>\ufb02<\/p>\n<p>Q-\u00bb_<\/p>\n<p>executed by the faizher of defendant Nos<br \/>\naltema\ufb01ve relief of zecovtzzy of advance   s  <\/p>\n<p>paid to defenciant Nos. 1 to 4 with    &#8216;A<\/p>\n<p>per annum.\n<\/p>\n<p>4. The ag1*een1Vc1:_1:f:*,x(as%V:  fotgr gtmms of land<br \/>\nin Sy.No.37AV\/_3: 1+4&#8242;   property had come<br \/>\nto the shasf\u00e9    1 to 4 by virtue of<br \/>\n2: &#8216;E301 1984 and that he had<br \/>\nag:v.E\u00a7:i&#8217;c&#8217;}V;V   to the piainti\ufb01 for a<br \/>\nco1\u00a3:&#8217;~:id&#8217;\u00abE*,I:&#8217;7a1iio&#8211;1;.;VV  and had received a sum of<\/p>\n<p>R_s.3,O(&#8216;}C-,1&#8217;&#8211;&#8216;by_&#8217;vw.&lt;\u00a7y_b\u00e9f&quot;&#039;b%\u00e91dvance and it was agreed that the<\/p>\n<p> amount of Rs. 19,000] &#8212; would be paid<\/p>\n<p>&#039; at_  of mgistration 9f the sale deed. it was further<br \/>\nH &quot; Q16 vendor would get the suit property converted<br \/>\n land to non-agict\ufb01mrai land and Within<\/p>\n<p>AA &#039; 0_;&#039;1c \u00a31:oni;h after conversion of the land he would execute a<\/p>\n<p>&#039;iiigistcmd saze deed in favour of the plainti\ufb02&#039; but that the<\/p>\n<p>\ufb01fixer of defendant Nos. 1 to 4 (me to (ma: reason or the ether<\/p>\n<p>Went on postponing the registration of the sale deed, though,<\/p>\n<p>%<\/p>\n<p>the plainti\ufb02 was rea\u00e9y and  to   pan <\/p>\n<p>agreement and subsequently,:=_the:_-\u00a3zatt?3$i=,\u00a7f.&#039;def\u00e9L\u00a3\u00a7ant::v{t&#039;os. &#039;:<\/p>\n<p>to 4 died on 03\/03; 1997; 1; the&quot;  _t}$32\u00a7Ot\u00a7\/ i\u00e9gs<br \/>\nsuit schedule property   &lt;V:l:eii&#039;a:1::\u00a7.\u00a7izv\u00a71:1t&#039;1V\u00a7?~Ios.. 1 to 4 in<br \/>\nfavour of dcf\u00a2n{iant&quot;&#039;F\u20acos.    l\u00e9gal notice was<br \/>\nissued by the &#039;tA2_1::V1&#039;   which a reply was<br \/>\ngiven on     was sent to all the<br \/>\ndcfend?;\u00a3it\u00a7&quot;&#039;\u00a7ii&#039;&quot;    a reply was givsn on<br \/>\n  the suit was \ufb01led on<br \/>\n plaintiff filed a. suit for speci\ufb01c<\/p>\n<p>p\u20acIfOI;.V\ufb01i?;ttIC&#039;f3VV!&lt;)&#039;f \u00e9ttqi\ufb01cti\u00e9gent dated 25\/11\/1988 and in the<\/p>\n<p>  &#039;f\u00a7t\u00a71&quot;\u00abIt:.c:ove1y of the a\u00e9vance amount of Rs.3,G00\/ &#8212;<\/p>\n<p>t &quot; \u00bb   at the rate of 18% per annum.\n<\/p>\n<p>  &#8216;{)1:\u00a7freceipt of summons anti notice: from the trial Court,<\/p>\n<p> AA _dezf&#8217;e&#8217;xa:\u00e9lant Nos}. to 4 appeared and written statement was<\/p>\n<p>*  by defendant No.1 which was adopted by defendant<\/p>\n<p>Nos. 2 to 4; iilefendant \u00a3493.} to 4 contended that the<br \/>\nayeement dated 25\/31\/1988 was not binding on them<\/p>\n<p>though it was executed by their late father and that they had<\/p>\n<p>%<\/p>\n<p>sold the emim land bearing S_v.No. .37A;(\u00e9,\u00a7j44e\u00e9&#8217;lt ig\u00e91Liaineg.\u00a2 rim <\/p>\n<p>suit property to defendant Nosi-5  ii) an   5<\/p>\n<p>that there was no cause of_a}.etion fer the    <\/p>\n<p>6. Defendant&#8217;   \ufb01mfeir  statement<br \/>\neoniendeed that   4 acres 3 guntas<br \/>\nin the   names had been<br \/>\nenterecii&#8217;   respect of the suit land<br \/>\nanti&#8217;    agreement of sale executed<br \/>\nby   1 to 4 in favour of the plaixati\ufb01&#8217;<\/p>\n<p>and  iL!1C:V&#8217;Er&#8221;\u00a7tEiS not binding on them. They<\/p>\n<p>_*&#8217;a}ite:i&#8217;1ii:afiVyelyA&#8217;eo:1te;ided that in case, the Court concluded<\/p>\n<p>A V&#8221;&#8216;tI:1at,_the:a;:;{i13ement to sell dated 25\/ 1 1\/1988 was to be given<\/p>\n<p>H * :&amp;.e\ufb01&#8221;ee.t  the consideration amount pend&#8217; by them had to<\/p>\n<p>Be  &#8220;beck to them by defenciants 1 to 4.<\/p>\n<p>&#8221;  On the above pleadings, the trial Court framed the<\/p>\n<p> following issues:\n<\/p>\n<p>1. Whether the plaintiff proves that late Sri<br \/>\nBasavanneppa Mailappa Tilbachi, the<br \/>\nfather of defendants No.1 to 4 has<\/p>\n<p>executed an agreement dated.\n<\/p>\n<p>agreeing to sell the :s1i\u00e9:&#8217;sc:;ee::11e<br \/>\nin favour of   . t&#8221;Qr V ?f<br \/>\nconskieratioa of-Rs.22;0OO\/j  Qtfcacczifgfefii V<br \/>\nRs.3,()O0\/- as  V &#8216; V <\/p>\n<p>2. What oxdm: or deems?\n<\/p>\n<p>3. In support of the case, the piainti\ufb01&#8217; examined himself<\/p>\n<p>as PW-1 and examined PWS.-2 and 3 and got marked Exs.P&#8211;<\/p>\n<p>%<\/p>\n<p>-3&#8230;\n<\/p>\n<p>1 to P-8 and closed his side. O;1\u00bbbcha\u00a7I'&#8221;&#8216;\u00e9f <\/p>\n<p>to 4, defendant No.1    go\ufb01 &#8221;\n<\/p>\n<p>marked Ex.D-1 and Ol1.&#8217;bf&#8217;:]__T1a1fVi)f_\u00a7i6f\u00a7:I1x;E;%\ufb011t .NQ\u00a7.$  .16,<\/p>\n<p>defendant No.7 was  DW-2&#8243;:&lt;\ufb02:0se\u00a7:i their side.<\/p>\n<p>9. Based on a13&#8243;civv.&#8217;\u00a3&#8217;:;:vii:v&#8217;&#8211;.;&#8217;$videncc on necord,<br \/>\nthe trial   &#8216;V 2 and 4 in the<br \/>\n i   in the a\ufb02irmative and<br \/>\n   regarding the relief of<br \/>\n @:.gz\u00a7cment but decreed the suit on<\/p>\n<p>the aif\u00e9z:i;1a&#8217;t:iv\u00a2 Bf recovery of advance amount of<\/p>\n<p> &#8211; \\!\u00a7?ithv\u00ab.iz)\u00a7i2ItSt at the rate of 18% per ammm from<\/p>\n<p>&#8216;  &#8220;th\u00a2 ~vt;1\u00e9\u00a7;t\u00a2:-%&#8217;\u00aba:;f&#8217;ag1eement in. from 25\/11\/1988 till thc date of<\/p>\n<p>H &#8216;-   at the rate of 1?\/6 per amtmm fmm the date of<\/p>\n<p> realisation.\n<\/p>\n<p>  Not being satis\ufb01ed with the said judgment: and decree,<\/p>\n<p>T the plain\ufb01ft&#8221; \ufb02ied Regular Appeaz No.9] 2003 before the<\/p>\n<p>learned Civil Jud.ge(Sem&#8217;or Division), I-fukeri. rfhe first<\/p>\n<p>apeiiatc Court raised the following points fer consideration:<\/p>\n<p>%<\/p>\n<p>1. V &#8216;  heard Sri B.S.i&lt;Iamate, iearned counsel for the<\/p>\n<p> He submits that in EXP-I time was not the<\/p>\n<p>V &quot; I esseiace of contract and it was the obligaiaion on the 9311: of<\/p>\n<p> toe vendor to get the suit schedule land converted \ufb01nm<\/p>\n<p>1%<\/p>\n<p>-10..\n<\/p>\n<p>ayicuitulal use to non~a$&#8217;icu1tura1 use  the <\/p>\n<p>of defendants 1 to 4 (vendor)   .V <\/p>\n<p>contract, the pIainti\ufb01&#8217;was\u00a79nstf\u00e91itt\u00e9d to keggal it:<br \/>\nthe year 1999&#8211;~2(){)0 and siiktg\u00e9querttiy.<br \/>\nspeci\ufb01c 1C)\u20acI&#8217;fOI&#8217;II1\u20acElJ\u00a3i(&#8216;T2t2~~._&#8221;Of ._of   He flzrther<br \/>\nsubmits that both    themselves<br \/>\nby raising ..thA&lt;V~A::V &#039;ttte suit and waiver of<br \/>\nright     npeci\ufb01c performance and<br \/>\nTh\u20acEiii\u00b0\u00a33I&#039;CD   ought to intervene and<br \/>\n the  \ufb01atrformancc of the contract. While<\/p>\n<p>aotvertingta Attjttt-t 54j.ot the Limitation Act, he submits that<\/p>\n<p>. P&#8211;3 and 5 are the copies of the legal<\/p>\n<p> and 6 am the zepiies and Ex.P-7 is the<\/p>\n<p> of the decree in O.S.No.230\/ 1994.\n<\/p>\n<p>15, __ 1~ In a Stlif; for speci\ufb01c perfformmce, the misvant points<\/p>\n<p> &#8216; .  \ufb02\ufb01fli&#8217; consideration am as to wlmther the plainti\ufb01&#8217; was ready<\/p>\n<p>and Willing to perform his part of the contract; the defence<\/p>\n<p>&amp;<\/p>\n<p>-12- ._ .\n<\/p>\n<p>available to the defendants an&amp; the p1UViSi0I1&amp;\u00a7&#8211;:C3\u00a7..&#8217; 53C;Cti0\ufb02S<\/p>\n<p>10, 16 and 20 of the Speci\ufb01c Relief Act; <\/p>\n<p>question which arises -in  &#8220;&#8221;appca}&#8217;  isl   <\/p>\n<p>unregistered agmement to sci}   s\ufb01bs\u00e9q\ufb01iezst  in  J<\/p>\n<p>respect of the very  &#8216;stmiisactgioil<br \/>\npmvailcs. It is a1sQ__no\ufb01ced&#8230;f,ijat thy: plsiiltiff  not sought<br \/>\nfor cance\ufb02ation of  Ts-,a1z\u00bb::_  09\/03; 1933 on the<\/p>\n<p>basis of which vdefe;1\u20aci&#8217;anVtf&amp;N6s,_&#8221;~5_   rcsistc\u00e9 the suit<\/p>\n<p>of .~&#8217;i&#8217;];\u00a3\u20ac*;     &#8220;Etc be scan as to whether<br \/>\nde\u00a7:nda:1&#8243;i    bona\ufb01de purchasers Without<\/p>\n<p>notice7;*.._  V _<br \/>\n X Ex; R1&#8242;  the agmement executed by the father of<\/p>\n<p>&#8220;\u20ac.i\u00a3:fe:;dant Nos.&#8221; &#8220;&#8221;  to 4 dated 25.11.1933 and Pw.2 is<\/p>\n<p>  \u00e9siiness to Ex.P1 and PW.3 is the scribe of Ex.P1.<\/p>\n<p>&#8216;A &#8216;._&#8221;&#8221;&#8216;VI&#8221;h8\u00a3&#8217;I\u20ac.  &#8220;\u00a3110 dispute as to the execution of the said<\/p>\n<p>agzis\u00e9iment, since both the courts have held that Ex.P1 was<\/p>\n<p>&#8221; ,  Executed by the father of dcisndam Nos. 1 to 4 in favour of<\/p>\n<p>the plainti\ufb01i There is further no dispute: that as on the date<\/p>\n<p>of the agreement, the suit property was agricuitural L-and am}<\/p>\n<p><span class=\"hidden_text\">-13-<\/span><\/p>\n<p>thai it was agreed to sell the same after conversi(.i\u00a7&#8217;\u00bbtQ non-<\/p>\n<p>agricultural purpose by the father of de\u00a3end;m\u00a7&#8221;&#8216;:o 4<\/p>\n<p>and at his own expense and that thema\ufb01gr   d\ufb01\ufb01d <\/p>\n<p>to be mastered on paymc11t: f  -I  of.__ <\/p>\n<p>Rs.19,000]-. ._ ._  4 % L\n<\/p>\n<p>17. A reading of is ,_th\u00a2 &#8216;&#8221;&#8216;~aVg&#8217;z&#8221;et:ment <\/p>\n<p>question, makes it, .appam&#8211;nf; _ as &#8216;&lt;3-j:1~.1:l:1(:r&#039;\u00a7 date of the<\/p>\n<p>agreement, the  agxicultllral land<\/p>\n<p> that  __t0 be Suki. aftsr conversion for non-<\/p>\n<p>agn&quot;c\u00ab&quot;u1t1&#039;11*a~~ I&#039; &quot;a;idV that the vendor was bound to get<\/p>\n<p>{he   within one month and thereafter sale<\/p>\n<p>  to zegistemd in favour of the plainti\ufb01&quot; on<\/p>\n<p>n   consideration of Rs.19,000\/-. This cktarly shows that the   <\/p>\n<p>matter and it is onjy after the   of  <\/p>\n<p>defendants No. 5 to 10 that the   &#8216;mg<br \/>\nycar 2000. The facts of the instant case are such that<\/p>\n<p>there is 11\u00a2 expianatien for \ufb01ling the suit in the year 2000<\/p>\n<p>when EX.P2 was entered into in the year 1998.
