KURIAKOSE, J.\n\n             -------------------------\n\n                    W.P.(C) No.10148 of  2007 G\n\n             -------------------------\n\n                Dated this the 3rd  day of April, 2007.\n\n\n\n                                   JUDGMENT\n<\/pre>\n<p>             Heard   Sri.Omprakash,   counsel   for   the<\/p>\n<p>petitioner,   Sri.Santhosh   Kumar   for   the   first<\/p>\n<p>respondent   and   the   learned   Government   Pleader<\/p>\n<p>also on behalf of the official respondents.\n<\/p>\n<p>             2. On considering the writ petition for<\/p>\n<p>admission, I passed an interim order directing<\/p>\n<p>the   first   respondent   to   maintain   the   status<\/p>\n<p>quo as on that day as regards the building and<\/p>\n<p>the   2nd  respondent   to   ensure   that   the   first<\/p>\n<p>respondent               does           not         continue                    with         the<\/p>\n<p>construction work.\n<\/p>\n<p>             3. It is seen from Ext.P11 that it has<\/p>\n<p>been         issued           pursuant                   to         the         direction<\/p>\n<p>contained   in   W.P.(C)No.8086\/07.   In   answer   to<\/p>\n<p>Ext.P11,            the            first                 respondent                   raised<\/p>\n<p>objections   and   submitted   Ext.P7   reply,   in<\/p>\n<p>which,   he   inter   alia   contended   that,   he   is<\/p>\n<p>having properties outside his eastern compound<\/p>\n<p>W.P.(C) No.10148 of  2007<\/p>\n<p>                                                       :: 2 ::\n<\/p>\n<p>wall   also.     If   what   he   says   is   correct,<\/p>\n<p>perhaps,   the   construction   will   not   offend<\/p>\n<p>Section   220(b)   of   the   Kerala   Panchayat   Raj<\/p>\n<p>Act.              But,               as           rightly              submitted         by<\/p>\n<p>Sri.Omprakash, the issue can be resolved only<\/p>\n<p>by   a   measurement   by   the   3rd  respondent   Taluk<\/p>\n<p>Surveyor.\n<\/p>\n<p>                  4.     In   such   circumstances,   I   direct<\/p>\n<p>the   3rd  respondent   Taluk   Surveyor   to   conduct<\/p>\n<p>a   measurement   of   the   first   respondent&#8217;s<\/p>\n<p>properties   covered   by   his   title   deed   with<\/p>\n<p>notice   to   the   petitioner   panchayat   and   also<\/p>\n<p>to   the   4th                  respondent   Assistant   Executive<\/p>\n<p>Engineer,   N.H.47,   Alappuzha.     The   necessary<\/p>\n<p>charges   for   the   conduct   of   measurement   will<\/p>\n<p>be   remitted   by   the   first   respondent   within<\/p>\n<p>two   weeks   of   receipt   of   a   copy   of   this<\/p>\n<p>judgment. The 3rd  respondent will conduct the<\/p>\n<p>measurement   at   the   earliest,   at   any   rate,<\/p>\n<p>within one month of remittance of the charges<\/p>\n<p>W.P.(C) No.10148 of  2007<\/p>\n<p>                                                       :: 3 ::\n<\/p>\n<p>by the first respondent. Once the measurement<\/p>\n<p>is   over,   the   3rd                            respondent   will   furnish<\/p>\n<p>copies   of   the   measurement   to   the   petitioner<\/p>\n<p>panchayat   and   also   to   the   first   respondent.\n<\/p>\n<p>The   petitioner-panchayat   will   conduct   a<\/p>\n<p>further   hearing   of   the   issue   covered   by<\/p>\n<p>Ext.P11   and   take   a   decision.   Till   such<\/p>\n<p>decision   is   taken,   as   directed   above,   the<\/p>\n<p>interim order dated 23.3.2007 will continue.\n<\/p>\n<p>                  Writ   petition   is   disposed   of   as<\/p>\n<p>above.\n<\/p>\n<p>                                                                      Sd\/-\n<\/p>\n<p>                               (PIUS C.
