The Labour Court helci<br \/>\nthat petitioner hail worked for 282 days and therefere he<\/p>\n<p>could not have been terminated \ufb01om se117ice4vV.wi.t\u00bbI10ut<\/p>\n<p>complying with the maxiidatoxy requirement of  <\/p>\n<p>the Induehjal Disputes Ace 1947. &#8216;I&#8217;peretbre;&#8221;i&#8217;t&#8211;  \u00e9teide e{1\u00a2&#8217;~ <\/p>\n<p>order of teneination. Counsel for the petitioner assai\ufb01ng<\/p>\n<p>&#8220;Vibe impugned award contends that once the order of<\/p>\n<p>&#8220;:}_&amp;rm, L13:&#8221;1_at:ion is set aside, as a rule, the Labeur Court ought to<\/p>\n<p> heve ordered for reinstatement with backwages and} other<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>uoonsequen\ufb01al bene\ufb01ts, which it has not done. Therefore, he<\/p>\n<p>submits that the impugneci awani requires interference <\/p>\n<p>4. It is true that in the normal eoutse   <\/p>\n<p>order of termination is set aside a&#8217;s&#8221;&#8221;iliegal,&#8217;..Atl1.e Workmaix is<\/p>\n<p>entitled for reinstatement and also Ai\ufb01drbllgackwaggag; . <\/p>\n<p>not an invariable rule. Though the<\/p>\n<p>  togolt a lenient View and heid that though there is<\/p>\n<p>V V&#8217; _ \u00e9elajf \ufb01shes in making the refezenee, that cannot be the<\/p>\n<p> gxotijgd  rejecting the reference. But after holding that<\/p>\n<p>  ttetneiaitation is bad, certainly, it took note of the fact that 16<\/p>\n<p>  -ioag years have iapseci from the date of termination.<\/p>\n<p>&#8221; V Therefore, in its OI3iI]i(}I} it was appropriate to grant imnpsum<\/p>\n<p>., 5 &#8211;\n<\/p>\n<p>compensation of Rs.3{),()00\u00abOO in lieu of reinstatement.
