Publication of<br \/>\nthe declaration under Section 6 of the Act was made on<br \/>\ndifferent dates in the following manner: (a) in the District<br \/>\nGazette on 1.2.1990, (b) daily newspapers on 27.2.1990 and\n<\/p>\n<p>(c) local publication on 15.3.1991. The award under Section<br \/>\n11A of the Act was made on 25.3.1992.\n<\/p>\n<p>A Writ application was filed by the landowner<br \/>\n(respondent no.5 herein) before the Patna High Court taking<br \/>\nthe stand that the award was made after the expiry of two<br \/>\nyears period as reckoned from the date of publication of the<br \/>\ndeclaration on 27.2.1990 when it was published in two local<br \/>\ndaily newspapers. Referring to Section 11A of the Act the<br \/>\nplea was accepted. This Court&#8217;s judgment in <a href=\"\/doc\/600998\/\">Kaliyappan v.<br \/>\nState of Kerala and Ors. (AIR<\/a> 1989 SC 239) was referred to<br \/>\nfor upholding the stand of the landowner. Challenge before<br \/>\nthe Division Bench did not yield any result to the present<br \/>\nappellant, for whose benefit the land was acquired. An<br \/>\napplication for review was filed which was dismissed by the<br \/>\nimpugned judgment by taking the view that there was no scope<br \/>\nfor review of the judgment and what was attempted to be done<br \/>\nin essence amounted to appeal in the guise of a review<br \/>\npetition.\n<\/p>\n<p>\tLearned counsel for the appellant-Board submitted that<br \/>\nthe approach of the High Court is erroneous. The period has<br \/>\nto be reckoned from the last date out of the series of<br \/>\npublication envisaged and in view of the clear language of<br \/>\nSection 11A, there was no scope for holding that the award<br \/>\nwas made beyond the prescribed time. Learned counsel for the<br \/>\nState of Bihar supported the stand. But learned counsel for<br \/>\nthe respondent no.5-landowner submitted that the date of<br \/>\nlocal publication is really of no consequence after the<br \/>\npublication in the two local newspapers.  Since a grievance<br \/>\nwas made by some of the landowners whose lands were<br \/>\nsimultaneously acquired that they had not been given due<br \/>\nnotice, the land acquisition authorities made a local<br \/>\npublication of the substance of the declaration. This was an<br \/>\nact done for the convenience of the parties and it cannot<br \/>\nextend the period of limitation as prescribed under Section<br \/>\n11A of the Act.\n<\/p>\n<p>\tIn order of appreciate the rival contentions few<br \/>\nprovisions of the Act need to be noted. They are:\n<\/p>\n<p>Sections 4(1), 6(1) and  (2) and 11A read as follows:\n<\/p>\n<p>&#8220;4. Publication of preliminary notification<br \/>\nand powers of officers thereupon \u2013 (1)<br \/>\nWhenever it appears to the appropriate<br \/>\ngovernment that land in any locality is<br \/>\nneeded or is likely to be needed for any<br \/>\npublic purpose or for a company, a<br \/>\nnotification to that effect shall be<br \/>\npublished in the Official Gazette and in two<br \/>\ndaily newspapers circulating in that<br \/>\nlocality of which at least one shall be in<br \/>\nthe regional language and the Collector<br \/>\nshall cause public notice of the substance<br \/>\nof such notification to be given at<br \/>\nconvenient places in the said locality (the<br \/>\nlast of the dates of such publication and<br \/>\nthe giving of such public notice, being<br \/>\nhereinafter referred to as the date of the<br \/>\npublication of the notification).\n<\/p>\n<p>*\t\t\t*\t\t\t*<\/p>\n<p>6.\tDeclaration that land is required for a<br \/>\npublic purpose. \u2013 (1) Subject to the<br \/>\nprovisions of Part VII of this Act, when the<br \/>\nappropriate government is satisfied, after<br \/>\nconsidering the report, if any, made under<br \/>\nSection 5-A, sub-section (2), that any<br \/>\nparticular land is needed for a public<br \/>\npurpose, or for a company, a declaration<br \/>\nshall be made to that effect under the<br \/>\nsignature of a Secretary to such government<br \/>\nor of some officer duly authorized to<br \/>\ncertify its orders, and different<br \/>\ndeclarations may be made from time to time<br \/>\nin respect of different parcels of any land<br \/>\ncovered by the same notification under<br \/>\nSection 4, sub-section (1), irrespective of<br \/>\nwhether one report or different reports has<br \/>\nor have been made (wherever required) under<br \/>\nSection 5-A, sub-section (2):\n<\/p>\n<p>Provided that no declaration in respect<br \/>\nof any particular land covered by a<br \/>\nnotification under Section 4, sub-section<br \/>\n(1), &#8211;\n<\/p>\n<p>(i) published after the<br \/>\ncommencement of the Land<br \/>\nAcquisition (Amendment and<br \/>\nValidation) Ordinance, 1967 (1 of<br \/>\n1967), but before the commencement<br \/>\nof the Land Acquisition (Amendment)<br \/>\nAct, 1984, shall be made after the<br \/>\nexpiry of three years from the date<br \/>\nof the publication of the<br \/>\nnotification; or<\/p>\n<p>(ii)\tpublished after the<br \/>\ncommencement of the Land<br \/>\nAcquisition (Amendment) Act, 1984,<br \/>\nshall be made after the expiry of<br \/>\none year from the date of the<br \/>\npublication of the notification:\n<\/p>\n<p>Provided further that no such<br \/>\ndeclaration shall be made unless the<br \/>\ncompensation to be awarded for such property<br \/>\nis to be paid by a company, or wholly or<br \/>\npartly out of public revenues or some fund<br \/>\ncontrolled or managed by a local authority.\n<\/p>\n<p>Explanation 1.- In computing any of the<br \/>\nperiods referred to in the first proviso,<br \/>\nthe period during which any action or<br \/>\nproceeding to be taken in pursuance of the<br \/>\nnotification issued under Section 4, sub-<br \/>\nsection (1), is stayed by an order of a<br \/>\ncourt shall be excluded.\n<\/p>\n<p>Explanation 2.- Where the compensation to be<br \/>\nawarded for such property is to paid out of<br \/>\nthe funds of a corporation owned or<br \/>\ncontrolled by the State, such compensation<br \/>\nshall be deemed to be compensation paid out<br \/>\nof public revenue.\n<\/p>\n<p>(2)Every declaration shall be published in<br \/>\nthe Official Gazette, and in two daily<br \/>\nnewspapers circulating in the locality in<br \/>\nwhich the land is situate of which at least<br \/>\none shall be in the regional language, and<br \/>\nthe Collector shall cause public notice of<br \/>\nthe substance of such declaration to be<br \/>\ngiven at convenient places in the said<br \/>\nlocality (the last of the dates of such<br \/>\npublication and the giving of such public<br \/>\nnotice, being hereinafter referred to as the<br \/>\ndate of the publication of the declaration),<br \/>\nand such declaration shall state the<br \/>\ndistrict or other territorial division in<br \/>\nwhich the land is situate, the purpose for<br \/>\nwhich it is needed, its approximate area,<br \/>\nand, where a plan shall have been made of<br \/>\nthe land, the place where such plan may be<br \/>\ninspected.               (Emphasis supplied)<\/p>\n<p>*\t\t\t*\t\t\t*<\/p>\n<p>11A. Period within which an award shall be<br \/>\nmade \u2013(1) The Collector shall make an award<br \/>\nunder Section 11 within a period of two<br \/>\nyears from the date of the publication of<br \/>\nthe declaration and if no award is made<br \/>\nwithin that period, the entire proceedings<br \/>\nfor the acquisition of the and shall lapse:\n<\/p>\n<p>Provided that in a case where the said<br \/>\ndeclaration has been published before the<br \/>\ncommencement of the Land Acquisition<br \/>\n(Amendment) Act, 1984, the award shall be<br \/>\nmade within a period of two years from such<br \/>\ncommencement.\n<\/p>\n<p>Explanation. \u2013 In computing the period of<br \/>\ntwo years referred to in this section, the<br \/>\nperiod during which any action or proceeding<br \/>\nto be taken in pursuance of the said<br \/>\ndeclaration is stayed by an order of a court<br \/>\nshall be excluded.&#8221;\n<\/p>\n<p>\tThe crucial words in Section 11A are &#8220;within a period<br \/>\nof two years from the date of publication of the<br \/>\ndeclaration&#8221;. Section 6(2) deals with the various modes of<br \/>\npublication, as enjoined by the legislature and what is<br \/>\nenvisaged by the Statute is a conjoint publication, by all<br \/>\nsuch methods. Various modes as prescribed in the provision<br \/>\nitself are (a) publication in the official gazette, (b)<br \/>\npublication in two daily newspapers circulating in the<br \/>\nlocality in which the land is situate of which at least one<br \/>\nshall be in the regional language and (c) public notice of<br \/>\nsubstance of such declaration at convenient places in the<br \/>\nlocality. There is no option left with any one to give up or<br \/>\nwaive any one or other of the modes and all such modes have<br \/>\nto be strictly resorted to. Sub-section (2) of Section 6<br \/>\ntherefore necessarily makes it abundantly clear that the<br \/>\nlast of the dates of the publication and giving of such<br \/>\npublic notice shall &#8220;hereinafter&#8221; be referred to as the<br \/>\ndate of publication of the declaration. Therefore, the<br \/>\nexpression &#8220;date of publication of declaration&#8221; appearing<br \/>\nin Section 11A a stage subsequent to Section 6, answering<br \/>\nthe stipulation &#8216;hereinafter&#8217; has to be the last of the<br \/>\ndates out of the three modes of publication ordained by the<br \/>\nStatute. In substance the triumvirate modes are cumulative<br \/>\nand inseparable in the sense that unless all the three modes<br \/>\nare resorted to and completed, there is no scope for the<br \/>\nlimitation period of two years beginning to run or for the<br \/>\npenal consequences envisaged ensuing therefrom.\n<\/p>\n<p>\t<a href=\"\/doc\/860251\/\">In Krishi Utpadan Mandi Samiti and Anr. v. Makrand<br \/>\nSingh and Ors.<\/a> (1995 (2) SCC 497) while considering  the<br \/>\nvarious provisions (in which only the period of limitation<br \/>\nwas changed by amending Act 68 of 1984) it was noted that<br \/>\nthere are three modes of publication and the three steps are<br \/>\nas indicated supra.\n<\/p>\n<p>\tIf one takes note of the parenthesis appearing in Sub-<br \/>\nsection (2) of Section 6, it is clear that reference to the<br \/>\nsubsequent provisions of the Act to the date of publication<br \/>\nof declaration has to be determined as the last of the dates<br \/>\nof the publication and the giving of public notice.  As the<br \/>\ndate of publication by local publication was the last at<br \/>\nthat point of time i.e. on 15.3.1991 the award on 25.3.1992<br \/>\nwas not beyond the prescribed period of limitation.\n<\/p>\n<p>The decision in Kaliyappan&#8217;s case (supra) was on<br \/>\ndifferent aspect of the problem raised in the factual<br \/>\nposition presented in that case, and did not deal with the<br \/>\nquestion of the nature involved in the present appeal. Even<br \/>\nin that case, this Court observed that under Section 11A,<br \/>\nthe Collector is empowered to make an award within two years<br \/>\nfrom the date of publication of the declaration meaning<br \/>\nthereby that it will be till the expiry of the last date of<br \/>\nthe period of two years. The further question as to how the<br \/>\nsaid period is to be computed did not arise in that case, as<br \/>\nin the present case. Therefore, no assistance is available<br \/>\nto the respondent-land owner from that decision.  On the<br \/>\ncontrary, the decision in <a href=\"\/doc\/179030\/\">Eugenio Misquita and Ors. v. State<br \/>\nof Goa and Ors.<\/a> (1997 (8) SCC 47) was rendered on identical<br \/>\nlegal set up after advertising to the relevant distinctions<br \/>\nin computing the period of limitation for making the<br \/>\ndeclaration under Section 6 in contrast to the one for<br \/>\ncomputing the period of limitation stipulated for making the<br \/>\naward under Section 11A of the Act, in the special context<br \/>\nof the mandate contained in Sub-section (2) of Section 6 of<br \/>\nthe Act. We are in respectful agreement with the principles<br \/>\nlaid down therein and the same squarely governs this case,<br \/>\nin favour of the stand taken for the appellant, the<br \/>\nlimitation having necessarily to be computed from the last<br \/>\nof the publication viz., 15.3.1991.\n<\/p>\n<p>Judgments of the High Court by learned Single Judge,<br \/>\nthe Division Bench in the appeal and the review application<br \/>\nhave not taken the correct view. They are set aside.
