This
\n\tapplication is filed under Section 438 of the Code of Criminal
\n\tProcedure in connection with first information report registered at
\n\tII-CR No.98 of 2011 with Godhra Town “A” Division Police
\n\tStation, Godhra,  for the offences punishable under Sections 3 and 7
\n\tof the Essential Commodities Act, 1955.\n<\/p>\n
Learned
\n\tSenior Counsel for the applicant submits that the goods in question
\n\tnamely various items of the essential commodities picked up from the
\n\tGodown of the Gujarat Civil Supplies Corporation on 4th
\n\tJune 2011, after entering into the register of the godown, were
\n\tfound in the truck on the very next day in the morning of 5th
\n\tJune 2011 and not a single bag of the essential commodities  was
\n\tfound missing or divested. Considering the above aspects along with
\n\tthe action that has been initiated under the Act for breach or
\n\tviolation of the terms and conditions of the licence and the
\n\tprovisions of the Rules and Regulations framed under the Act,  the
\n\tapplicant may be granted anticipatory bail.  It is further submitted
\n\tthat the applicant will be available for investigation and will not
\n\tflee from justice.\n<\/p>\n

Having
\n\theard learned counsel for the parties and perusing the record of the
\n\tcase and taking into consideration the facts of the case, nature of
\n\tallegations, role attributed to the accused and punishment
\n\tprescribed for the alleged offences, without discussing the evidence
\n\tin detail, at this stage, I am inclined to grant anticipatory bail
\n\tto the applicant.  This Court has also taken into consideration the
\n\tlaw laid down by the Apex Court in the case of Siddharam
\n\tSatlingappa Mhetre v. State of Maharashtra & Ors. Reported<\/a> in
\n\t[2011]1 SCC 694, wherein the Apex Court reiterated the law
\n\tlaid down by the Constitutional Bench in the case of Shri
\n\tGurubaksh Singh Sibbia & Ors. Reported in [1980]2 SCC 565.\n<\/p>\n

\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n
In
\n\tthe result, this application is allowed by directing that in the
\n\tevent of the applicant herein being arrested pursuant to FIR being
\n\tfirst information report registered at II-CR No.98 of 2011 with
\n\tGodhra Town “A” Division Police Station, Godhra,   the
\n\tapplicant shall be released on bail on furnishing a bond of
\n\tRs.10,000\/- (Rupees Ten Thousand only) with one surety of like
\n\tamount on following conditions :-\n<\/p>\n
[a]\tshall
\ncooperate with the investigation and make himself \tavailable for
\ninterrogation whenever required.\n<\/p>\n
[b]\tshall
\nremain present at concerned Police Station on  29.7.2011 between
\n11:00 am to 2:00 pm:\n<\/p>\n
[c]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any witness so
\nas to dissuade them from disclosing such facts to the Court or to any
\nPolice Officer;\n<\/p>\n
[d]\tshall
\nat the time of execution of bond, furnish the address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[e]
\n\twill not leave India without the permission of the Court and, if is
\nholding a Passport, shall surrender the same before the trial Court
\nimmediately<\/p>\n
[f]\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand, if he considers it just and proper and the concerned
\nMagistrate would decide it on merits.\n<\/p>\n
[g]\tdespite
\nthis order, it would be open for the Investigating Agency to apply to
\nthe competent Magistrate, for police remand of the applicant. The
\napplicant shall remain present before the learned Magistrate on the
\nfirst date of hearing of such application and on all subsequent
\noccasions, as may be directed by the learned Magistrate. This would
\nbe sufficient to treat the accused in the judicial custody for the
\npurpose of entertaining application of the prosecution for police
\nremand. This is, however, without prejudice to the right of the
\naccused to seek stay against an order of remand, if ultimately
\ngranted, and the power of the learned Magistrate to consider such a
\nrequest in accordance with law. It is clarified that the applicant,
\neven if, remanded to the police custody, upon completion of such
\nperiod of police remand, shall be set free immediately, subject to
\nother conditions of this anticipatory bail order.\n<\/p>\n
\tRule
\nmade absolute. Application is disposed of accordingly.\n<\/p>\n
\tDirect
\nservice is permitted.\n<\/p>\n
