establishing iin\u00ab:liistrie:;s.  of objections<\/p>\n
\ufb01led  –.:i”iel  were considered and the<\/p>\n
petitionersi’__4werel’  along with the lands in<\/p>\n
 ‘certain\u00ab\u00bbothe; lands to an extent of 540 Acres<\/p>\n
  accgn’iredl”‘b_y the board for formation of industrial<\/p>\n
areavand -th_eA’i1=contention of the petitioners that barren<\/p>\n
 lands are available for formation of industrial area has<\/p>\n
A ‘imam as the adjoining lands have also been acquired<\/p>\n
l  and accordingly, held that the writ peiition is devoid of<\/p>\n
 merit and dismissed the writ petition. Being aggrieved<\/p>\n

by the said order dated 28\/ 5\/ 2009. petitioners 2 to 6<\/p>\n
have preferred this appeal.\n<\/p>\n

forming  and there are other lands<\/p>\n

 been considered before passing the final<\/p>\n

11. The material on  Wolulcl” show
\nthat the fact that the ‘ laiids fare :n’otified_.yunder Section 3<\/p>\n
of the  preliininary noti\ufb01cation was
\nissued   after considering the<\/p>\n
objections   the llpsetitioners, notifications under<\/p>\n
” ” ”issc’i:5nii-i2s(4i\u00a2of th\u00e9tiis; was issued on 5\/12\/2006. The<\/p>\n
 facts. acquired for the purpose of forming<\/p>\n
lI1CAlL.14″‘SVt1″l\u00a73;1~  is not disputed. However, what is<\/p>\n
37-‘~.__V’eonteridei{i by the learned counsel for the petitioners is<\/p>\n
  the petitioners are the owners of the valuable<\/p>\n
ll   .laiil1ds, it is their only source of livelihood and there are<\/p>\n
“other lands available in the adjacent area for forming<\/p>\n

industrial area and therefore. lands of the petitioners
\nought not to have been acquired. It is well settled that<\/p>\n
private interest must yield in favour of the…fpu_lbl’ic<\/p>\n
interest. The fact that lands belonging to the .<\/p>\n
is being acquired for the purposemof forrnirigiliindustrial “‘<\/p>\n
area, which is a public purpose c:._fa’nriotii\u00bb.be _ldislp:’ut.e’ti.;_’<\/p>\n
There is no merit in the’f_c”ontention .oif’f._the_”<-vl.earned r L'<\/p>\n

   would be entitled to compensation for<\/p>\n
the"'acqi_iisit.ion of the lands under the Act. Under the<\/p>\n
 vl\ufb01dircurnstances, it is clear that the learned Single Judge<\/p>\n
   justified in holding that the writ petition is devoid of<\/p>\n
 -rnerit and no ground whatsoever is made out for<\/p>\n
quashing the notificatioris impugned in the writ petition<\/p>\n
and the order of the learned Single Judge is justified
\nand does not suffer from any error or illegality as to Call
\nfor interference in this intraeeourt appeal. Accordingly,<\/p>\n
all these Writ appeals are dismissed.<\/p>\n
