Justice P.N.RAVINDRAN\n\n Dated :11\/06\/2008\n\n O R D E R\n           J.B.KOSHY &amp; P.N.RAVINDRAN, JJ.\n                  -------------------------------\n              M.A.C.A.NO.621 OF 2003 (B)\n                -----------------------------------\n         Dated this the 11th day of June, 2008\n\n                      J U D G M E N T\n<\/pre>\n<p>KOSHY,J.\n<\/p>\n<\/p>\n<p>     Petitioner, at the age of 31, sustained injuries in a motor<\/p>\n<p>accident on 8.11.1998.        He claimed a compensation of<\/p>\n<p>Rs.5 lakhs. Tribunal awarded only Rs.1,69,600\/- inclusive of<\/p>\n<p>reimbursement of medical expenses actually incurred.<\/p>\n<p>Tribunal found that accident occurred due to the negligence of<\/p>\n<p>the vehicle insured by the 3rd respondent Insurance company.<\/p>\n<p>Only quantum of compensation is disputed in this appeal.<\/p>\n<p>     2.   According to the claimant, his monthly income was<\/p>\n<p>Rs.7,500\/- as he was the proprietor of the business in soft<\/p>\n<p>drinks and soda. He produced application for registration of<\/p>\n<p>Small Scale Industry etc. to prove the same. He also adduced<\/p>\n<p>oral evidence. But in the absence of clear evidence to show<\/p>\n<p>the actual income, tribunal has taken only Rs.2,000\/- as the<\/p>\n<p>monthly income. We are of the view that he was maintaining a<\/p>\n<p><span class=\"hidden_text\">MACA.621\/03                      2<\/span><\/p>\n<p>family and even a manual worker will get more than Rs.125\/-<\/p>\n<p>per day in 1998.        Considering all these aspects, we fix<\/p>\n<p>Rs.3,000\/- as the monthly income.      As far as the injuries are<\/p>\n<p>concerned, tribunal found as follows:\n<\/p>\n<\/p>\n<blockquote><p>          &#8220;It is proved by the above medical records that<br \/>\n          in the accident petitioner sustained lacerated<br \/>\n          injury left temperal region 10 cm long bone<br \/>\n          deep,     cerebral     odema,     subarchinoid<br \/>\n          hemorrhage, contusion right frontal lobe near<br \/>\n          orbital roof, contusion right temperal lobe,<br \/>\n          fracture to left parietal bone, fracture of left<br \/>\n          temperal bone on seuamus part and in the<br \/>\n          region of mastoid air cells, encyphalo malasia<br \/>\n          of the right temperal region, left sided<br \/>\n          hemi plegia with facial plasi left.    He was<br \/>\n          admitted in the Medical College on 8.11.1998,<br \/>\n          wound     sutured,   tracheotomy    done   and<br \/>\n          discharged on 24.12.1998. Thereafter several<br \/>\n          times he attended the OP department of the<br \/>\n          Medical College Hospital with complaint of<br \/>\n          left side weakness and underwent treatment.&#8221;\n<\/p><\/blockquote>\n<p>Ext.A4 certificate shows that his permanent partial disability<\/p>\n<p>was 30%.       But tribunal, without any reason, reduced it to<\/p>\n<p>20%. According to the claimant, because of the after effects<\/p>\n<p>of injuries, he is unable to do any work.     We have referred<\/p>\n<p>the claimant to the Medical Board constituted under the<\/p>\n<p>Government Medical College Hospital, Thiruvananthapuram.<\/p>\n<p>Medical Board assessed the permanent disability at 30%. So<\/p>\n<p><span class=\"hidden_text\">MACA.621\/03                    3<\/span><\/p>\n<p>compensation should be calculated for 30% permanent<\/p>\n<p>disability. Tribunal has fixed 17 as the multiplier. Since he<\/p>\n<p>was aged 31, considering the 2nd Schedule as the guideline,<\/p>\n<p>we see no ground to enhance the same. Apex Court in the<\/p>\n<p>following decisions held that 2nd Schedule can be taken as a<\/p>\n<p>guideline for assessing compensation for claims under Section<\/p>\n<p>166 also <a href=\"\/doc\/909799\/\">(See Smt.Supe Dei and others v. M\/s National<\/p>\n<p>Insurance Co. Ltd. and<\/a> another (JT 2002 (Suppl.1) SC<\/p>\n<p>451),      <a href=\"\/doc\/1407348\/\">Abati Bezbaruah v. Dy. Director General,<\/p>\n<p>Geological Survey of India and<\/a> another ((2003) 3 SCC<\/p>\n<p>148) and APSRTC v. M.Pentaiah Charg (2007 AIR SCW<\/p>\n<p>5689)).    Therefore, compensation payable for permanent<\/p>\n<p>disability will be Rs.3,000 x 12 x30\/100 x 17 = Rs.1,83,600\/-.<\/p>\n<p>Tribunal has awarded only Rs.81,600\/- for disability and loss<\/p>\n<p>of earning capacity. Therefore, additional compensation will<\/p>\n<p>be Rs.1,02,000\/-.   Tribunal has awarded Rs.6,000\/- for loss of<\/p>\n<p>actual earning for three months under treatment.    Since we<\/p>\n<p>have enhanced the monthly income from Rs.2,000\/- to<\/p>\n<p>Rs.3,000\/-, he is entitled to additional Rs.3,000\/- on that<\/p>\n<p>ground.    Even though it is contended that compensation<\/p>\n<p>granted under other heads are very low considering the total<\/p>\n<p>amount, no enhancement is required.     The additional amount<\/p>\n<p><span class=\"hidden_text\">MACA.621\/03                      4<\/span><\/p>\n<p>of Rs.1,0,5000\/- should be deposited by the 3rd respondent<\/p>\n<p>insurance company with 7.5% interest from the date of<\/p>\n<p>application till its deposit over and above the decreed amount<\/p>\n<p>by the tribunal.
