Justice S.SIRI JAGAN\n\n Dated :17\/06\/2008\n\n O R D E R\n                            S.SIRI JAGAN, J\n                     = = = = = = = = = = = = = = = =\n                      W.P.(C).No. 17514 OF 2008\n                        = = = = = = = = = = = = =\n                  Dated this the 17th day of June, 2008.\n\n                            J U D G M E N T\n<\/pre>\n<p>     The petitioner claims to be a member of the Sri<\/p>\n<p>Pandarachetty Community, which according to the petitioner is a<\/p>\n<p>socially and educationally backward class entitled to reservation<\/p>\n<p>in the matter of admission to Medical and Engineering Courses<\/p>\n<p>in Kerala State. However, Sri Pandarachetty Community is not<\/p>\n<p>included in the list of SEBCs in the prospectus issued by the<\/p>\n<p>Government for admission to professional colleges in Kerala this<\/p>\n<p>year.   Petitioner&#8217;s contention is that other sub classes of the<\/p>\n<p>Chetty Community are included in the list of SEBCs and therefore<\/p>\n<p>the non-inclusion of Sri Pandarachetty Community in the list of<\/p>\n<p>SEBCs in the prospectus is arbitrary, unreasonable and<\/p>\n<p>unsustainable. Petitioner therefore seeks the following relief:<\/p>\n<p>       i)    To issue a writ of mandamus or any other<br \/>\n       appropriate writ, direction or order commanding 2nd and<br \/>\n       4th  respondents    to   include    the   community    &#8220;Sri<br \/>\n       Pandarachetty&#8221;    in  the    category    of   Socially and<br \/>\n       Educationally Backward Classes in the prospectus for<br \/>\n       admission to the Professional Degree Courses for the<br \/>\n       year 2008 and to grant benefit of reservation to the<br \/>\n       petitioner.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No. 17514 OF 2008       2<\/span><\/p>\n<p>      2.    Admittedly, the prospectus was issued in January, this<\/p>\n<p>year in which Sri Pandarachetty Community was not included in<\/p>\n<p>the list of SEBCs. Petitioner applied pursuant to that prospectus.<\/p>\n<p>At that time, he did not raise any objections, although he claims<\/p>\n<p>to have filed representations. Whatever that be, the petitioner is<\/p>\n<p>approaching this court at the last minute when admissions are<\/p>\n<p>going to be finalised.
