JUSTICE RAJIVE BHALLA<\/p>\n<p>Present: Dr. Surya Parkash,Advocate<br \/>\n         for the appellants.\n<\/p>\n<p>          Mr. Rajinder Goyal, Advocate<br \/>\n          for the respondents.\n<\/p>\n<p>RAJIVE BHALLA, J (Oral).\n<\/p>\n<\/p>\n<p>          The appellants filed a suit for declaration that they are owners in<\/p>\n<p>possession, as occupancy tenants and, therefore, cannot be dispossessed<\/p>\n<p>by the respondents. The respondents contested this suit by denying that<\/p>\n<p>the appellants are occupancy tenants, and in addition, pleaded that the<\/p>\n<p>Civil Court has no jurisdiction to decide the question whether a person is an<\/p>\n<p>occupancy tenant or not.\n<\/p>\n<p>          The trial court, vide judgment and decree dated 03.09.1998,<\/p>\n<p>rejected the appellants assertion that they are occupancy tenants.<\/p>\n<p>However, as the appellants were able to establish their possession, the trial<\/p>\n<p>court issued an injunction restraining the respondents from dispossessing<\/p>\n<p>the appellants except in due course of law.\n<\/p>\n<p>          Aggrieved by the aforementioned judgment and decree, the<\/p>\n<p>appellants and the respondents filed separate appeals. The first appelalte<\/p>\n<p>court dismissed both the appeals. The appeal filed by the appellants was<\/p>\n<p>dismissed by holding that the question whether a person is an occupancy<br \/>\n<span class=\"hidden_text\"> Regular Second Appeal No. 2937 of 2001                        -2-<\/span><\/p>\n<p>tenant or not cannot be decided by a civil court. The appeal filed by the<\/p>\n<p>respondents, against the grant of an injunction, was dismissed by holding<\/p>\n<p>that as the appellants have been able to establish their possession. It does<\/p>\n<p>not call for interference.    It would be necessary to mention that the<\/p>\n<p>respondents    have not filed any appeal against the dismissal of their<\/p>\n<p>appeal.\n<\/p>\n<p>          Counsel for the parties are ad-idem that the judgment and decree<\/p>\n<p>passed by the first appellate court is a nullity as the jurisdiction to decide<\/p>\n<p>whether a person is an occupancy tenant or not rests with a civil court as<\/p>\n<p>held by a Division Bench of this Court           in &#8220;<a href=\"\/doc\/519244\/\">Ami Lal v.
