Applicant has no criminal antecedents. He is<br \/>\naged about 21 years of age. He further submitted that first,<br \/>\nallegations made in the FIR were regarding molestation and not of<br \/>\nrape. Subsequently, however, complainant made further allegation<br \/>\nalleging that present applicant had also committed rape on her.\n<\/p>\n<p>\tCounsel<br \/>\nfurther submitted that being a boy of young age, he may be granted<br \/>\nbail on any just condition.\n<\/p>\n<p> \tOn<br \/>\nthe other hand learned APP submitted that there is prima facie<br \/>\nevidence of the applicant having committed a serious offence.\n<\/p>\n<p>\tHaving<br \/>\nheard learned advocates for the parties and having perused documents<br \/>\non record, looking to the young age of boy as also considering that<br \/>\ninvestigation is over and charge-sheet is filed and co-accused has<br \/>\nbeen granted bail, the applicant is ordered to be released on bail in<br \/>\nconnection with C.R. No. I-100\/2010 registered before Sami police<br \/>\nstation, District Patan,  on his furnishing a bond of Rs.<br \/>\n10,000\/-(Rupees Ten Thousand) with one surety of like-amount to the<br \/>\nsatisfaction of the lower Court and subject to following conditions<br \/>\nthat he shall  :\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>shall<br \/>\n\tnot enter the area of Gochnad village, Taluka Sami, District Patan<br \/>\n\ttill competition of trial.\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of his residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt and shall mark presence in the police station in the area<br \/>\n\twhere he is residing on every 1st and 15th day<br \/>\n\tof English Calendar month between 11:00 am to 2:00 pm;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
