    WP(C) No.32928 of 2010 is filed by B.Syamala,<\/p>\n
while,  WP(C)   No.34999  of  2010   is  filed   by<\/p>\n
Pushpalatha.  Syamala and Pushpalatha are working<\/p>\n
in S.N.M.V.H.S.S, Vannappuram.\n<\/p>\n<\/p>\n
    2.   Syamala  was   originally   appointed   on<\/p>\n
2.6.1982. Pushpalatha was appointed on 29.7.1983.<\/p>\n
However, Syamala was deployed on protection for the<\/p>\n
period from 9.12.1988 to 4.3.1993.   On 28.3.2008,<\/p>\n
the  District  Educational  Officer  finalised  the<\/p>\n
seniority list, as per which Syamala was shown as<\/p>\n
serial No.10 and Pushpalatha was shown as serial<\/p>\n
No.6.  Aggrieved by the seniority list finalised by<\/p>\n
the District Educational Officer, Syamala filed an<\/p>\n
appeal before the Director of Public Instruction,<\/p>\n
who disposed the appeal as per the order dated<\/p>\n
25.9.2010 (Ext.P4 in WP(C) No.32928 of 2010 and<\/p>\n
W.P.(C).No.32928
\n&  34999 OF 2010          2<\/span><\/p>\n
Ext.P3 in WP(C) No.34999 of 2010).  The contention<\/p>\n
put   forward   by   Syamala that  the  period   of<\/p>\n
deployment also should be taken into account for<\/p>\n
fixing   the   seniority was not  accepted by   the<\/p>\n
Director of Public Instruction.    Challenging the<\/p>\n
order passed by the Director of Public Instruction,<\/p>\n
Syamala filed a revision dated 11.10.2010 before<\/p>\n
the Government (Ext.P5 in WP(C) No.32928 of 2010).<\/p>\n
That revision is pending disposal.\n<\/p>\n<\/p>\n
    3. Meanwhile, Rule 37 of Chapter XIV A was<\/p>\n
amended as per SRO No.732\/2010 which was published<\/p>\n
as per GO(P) No.130\/2010\/G.Edn. dated 23.7.2010.<\/p>\n
As per the amendment, a proviso was added to sub<\/p>\n
rule 1 of rule 37 of Chapter XIV A KER. The proviso<\/p>\n
is  to   the   effect  that the period  of  service<\/p>\n
rendered in the parent school or in another school<\/p>\n
by a teacher, who is relieved under Rule 52, shall<\/p>\n
be reckoned for seniority on his re-appointment to<\/p>\n
the parent school.<\/p>\n

    4. Sri. M.P.Ashok Kumar, the learned counsel<\/p>\n
appearing for Syamala contended that the amendment<\/p>\n
is declaratory in nature and therefore, it has<\/p>\n
retrospective effect as well.     Sri.V.A.Mohammed,<\/p>\n
the   learned   counsel appearing for   Pushpalatha<\/p>\n
contended that the amendment is only prospective in<\/p>\n
nature.   It is also contended by Sri.Mohammed that<\/p>\n
the post of Headmaster became vacant on 1.4.2010.<\/p>\n
Only   because  there  was  a  management  dispute,<\/p>\n
Pushpalatha was not appointed as Headmistress.  Had<\/p>\n
she been appointed as Headmistress on the date of<\/p>\n
occurrence of vacancy, the amendment which came<\/p>\n
into force on 23.7.2010, would not have affected<\/p>\n
her.    Only because of the fact that there was a<\/p>\n
management dispute, the interpretation of law could<\/p>\n
not be otherwise and the relevant date is the date<\/p>\n
of occurrence of vacancy.\n<\/p>\n<\/p>\n
    5. On the basis of the order passed by the<\/p>\n
District Educational Officer, on 28.3.2008, and the<\/p>\n
W.P.(C).No.32928
\n&  34999 OF 2010          4<\/span><\/p>\n
order dated 25.9.2010 passed by the Director of<\/p>\n
Public     Instruction,   Pushpalatha   moved    the<\/p>\n
Government for implementing those orders (Ext.P8 in<\/p>\n
WP(C) No.34999 of 2010).      That representation is<\/p>\n
also pending disposal before the Government.     The<\/p>\n
learned counsel appearing for the parties submitted<\/p>\n
that since the matter is now pending before the<\/p>\n
Government,    it   would  be  sufficient,  if   the<\/p>\n
Government is directed to dispose of the revision<\/p>\n
filed by Syamala and the representation filed by<\/p>\n
Pushpalatha.     It is also submitted that all the<\/p>\n
questions raised by the parties may be left open to<\/p>\n
be considered by the Government.   Sri.Mohammed also<\/p>\n
submitted that even going by the seniority list, it<\/p>\n
can be seen that there are other affected parties,<\/p>\n
who are not made parties in the Writ Petition filed<\/p>\n
by Syamala.     He submits that it is necessary that<\/p>\n
those affected parties also should be heard by the<\/p>\n
Government.<\/p>\n
\n\nW.P.(C).No.32928\n&  34999 OF 2010        5\n\n    In the facts and circumstances    of the case,\n\n<\/pre>\n
the Writ Petitions are disposed of as follows:<\/p>\n
    The first respondent in the Writ Petitions<\/p>\n
shall dispose of Ext.P5 revision dated 11.10.2010<\/p>\n
filed by Syamala and Ext.P8 representation dated<\/p>\n
30.7.2010 filed by Pushpalatha, as expeditiously as<\/p>\n
possible, and at any rate within a period of three<\/p>\n
months from the date of receipt of a copy of the<\/p>\n
judgment, after affording an opportunity of being<\/p>\n
heard to Syamala, Pushpalatha and all the other<\/p>\n
affected parties.   The Government shall take into<\/p>\n
account all the contentions put forward by the<\/p>\n
parties and take a final decision in the matter.<\/p>\n
    It is submitted that Pushpalatha is continuing<\/p>\n
as Headmistress in charge, as per the orders passed<\/p>\n
by the Educational authorities.    Pending disposal<\/p>\n
of the revision and the representation by the<\/p>\n
Government    as stated above,   Pushpalatha  shall<\/p>\n

continue   as   teacher in  charge. The respective<\/p>\n
petitioners    shall produce a  copy of  the  Writ<\/p>\n
Petition and certified copy of the judgment before<\/p>\n
