Grievance of the petitioners is to the effect that the<br \/>\n\trespondent authority has not granted higher pay scale as per the<br \/>\n\trecommendations made by the Tikku Pay Commission. It is submitted by<br \/>\n\tthe learned Advocate Mr. Majmudar for the petitioners that the one<br \/>\n\tof petitioners has received first higher grade but rest of the<br \/>\n\tpetitioners have not received any higher grade benefit. He submits<br \/>\n\tthat they are entitled for the same from the date of their joining<br \/>\n\tas ad.hoc medical officer (bonded) or on the principle of continuous<br \/>\n\tofficiation but the respondents are not considering their case for<br \/>\n\tthe same. He submits that the petitioners are entitled for the<br \/>\n\thigher grade benefit as per the recommendations made by the Tiku<br \/>\n\tCommission on the basis of various resolutions issued by the State<br \/>\n\tGovernment from time to time. It is his grievance that other<br \/>\n\tsimilarly situated employees have been granted such similar benefits<br \/>\n\twith effect from the date of their joining as ad.hoc bonded medical<br \/>\n\tofficers. Averments made by the petitioners to that effect in para 6<br \/>\n\tof the memo of SCA No. 6177 of 2007 are reproduced as under:\n<\/p>\n<p>?SPetitioners<br \/>\n\tstate and submit that even other similarly situated Medical Officers<br \/>\n\thave been granted benefit of higher pay scale considering their<br \/>\n\tinitial date of appointment. Thus, only petitioners are subjected to<br \/>\n\tdiscriminatory treatment. In fact, Dr. DD Parmar, who was appointed<br \/>\n\tin Irwin Hospital, Jamnagar on 23.6.1971 was granted the benefit of<br \/>\n\thigher pay scale considering his initial date of appointment.<br \/>\n\tSimilarly, one Dr.BS Patel who came to be appointed on 13.4.1974 and<br \/>\n\twho was placed at Sr. No. 233 in the seniority list of Mos has been<br \/>\n\tgranted the benefit of higher pay scale. Likewise, Dr.GK Virda who<br \/>\n\twas appointed on 30.7.1974 and placed at Sr. No.225 in the seniority<br \/>\n\tlist, Dr. MB Thakkar who was appointed on 11.1.1972 and placed at<br \/>\n\tSr.No. 275 in the seniority list and Dr. DG Adheda who was appointed<br \/>\n\ton 29.11.1975 and placed at Sr.No. 339 working as doctors medical<br \/>\n\tofficers were granted higher pay scale considering their initial<br \/>\n\tdate of appointment. The petitioners crave leave to refer to and<br \/>\n\trely upon the relevant record maintained by the authority in this<br \/>\n\tregard at the time of hearing of this petition. If need be. In view<br \/>\n\tof the above facts, petitioners also pray that they may be granted<br \/>\n\tthe said benefit considering their initial date of appointment.<br \/>\n\tUnder these circumstances, petitioners pray that suitable directions<br \/>\n\tbe issued to the respondents to consider the case of the petitioners<br \/>\n\tand grant benefit of higher pay scale and the concerned respondents<br \/>\n\tbe directed to disburse the amount with 18% interest and further<br \/>\n\tdirection be issued for undertaking pay fixation as junior doctors<br \/>\n\thave been granted the benefit, but the petitioners are<br \/>\n\tdiscriminated.??\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Majmudar also submits that as per GR dated 15.10.1997<br \/>\n\twhich is at page 52, as per fourth line, arrears of higher grade has<br \/>\n\tto be paid to the petitioner as per the recommendations made by<br \/>\n\tTikku Pay Commission which will be made applicable w.e.f. 14.11.1991<br \/>\n\tand arrears of higher grade upto 16.10.1994 shall not be paid to the<br \/>\n\tpetitioners and from17.10.1994,  petitioners are entitled for the<br \/>\n\tbenefit of such arrears in cash.  He also submits that the<br \/>\n\tpetitioners have cleared their GPSC Examination in first attempt but<br \/>\n\tthe respondents are also not considering the said fact.\n<\/p>\n<p>In<br \/>\n\tview of these facts and considering submissions made from both the<br \/>\n\tsides, it is open for petitioners herein to make detailed<br \/>\n\trepresentation to the respondent authority within one month from the<br \/>\n\tdate of receipt of copy of this order.\n<\/p>\n<p>As<br \/>\n\tand when such representation made by the petitioners is received by<br \/>\n\tthe respondent authority, respondent authority is directed to<br \/>\n\tconsider cases of each of the petitioners for higher pay scale as<br \/>\n\tper the recommendations made by Tikku Pay Commission from the date<br \/>\n\tof their joining as ad.hoc (bonded) or on the basis of the<br \/>\n\tprinciples of continuous officiation and also consider their case<br \/>\n\tfor arrears in cash w.e.f. 17.10.1994 as per GR dated 15.10.1997<br \/>\n\twhile keeping in view the fact that the petitioners have cleared<br \/>\n\ttheir GPSC Examination in first attempt as submitted by learned<br \/>\n\tAdvocate Mr. Majmudar for petitioners and then to pass appropriate<br \/>\n\treasoned order in accordance with law within two months from the<br \/>\n\tdate of receiving representation from the petitioners and to<br \/>\n\tcommunicate decision to the petitioners immediately thereafter.\n<\/p>\n<p>In<br \/>\n\tview of these observations and directions, these petitions are<br \/>\n\tdisposed of at this stage without expressing any opinion on merits<br \/>\n\tof the matter and with a liberty in favour of the petitioners to<br \/>\n\tchallenge the orders that may be made by respondents before<br \/>\n\tappropriate forum in accordance with law if the orders so passed are<br \/>\n\tadverse to petitioners.\n<\/p>\n<p>Direct<br \/>\n\tService is Permitted.\n<\/p>\n<p>(H.K.\n<\/p>\n<p>Rathod,J.)<\/p>\n<p>Vyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court B.C.Jethwa vs State on 20 July, 2010 Author: H.K.Rathod,&amp;Nbsp;
