Jani for the applicant, Mr. H.L. Jani,<br \/>\nlearned APP for the respondent No.1 State and Mr. Baiju Joshi,<br \/>\nlearned advocate for the respondent No.2.\n<\/p>\n<p>\tDuring<br \/>\nthe hearing of this application, learned advocate Mr. R.C. Jani has<br \/>\ncontended that in quashing petition, the proceedings is already<br \/>\nstayed by this Court and today, the present applicant is ready to<br \/>\ndeposit of the said amount, but the learned Judge is unable to<br \/>\nconsider that issue due to order passed in quashing petition.<br \/>\nTherefore, he may be permitted to withdraw the application with a<br \/>\nliberty to move before the same Court, where quashing petition is<br \/>\npending and he may be permitted to make a prayer for time being for<br \/>\nthe said issue.\n<\/p>\n<p>\tIn<br \/>\nview of the above, permission is granted.
