SHAH\n\t\t\n\t\n\n \n\nDate\n: 19\/03\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent Official Liquidator Report has been preferred by the Official<br \/>\nLiquidator of M\/s.Testeels Ltd. [In Liquidation] with the following<br \/>\nprayers :\n<\/p>\n<p> (a)\tThis<br \/>\nHon&#8217;ble Court may be pleased to permit the Official Liquidator U\/s.<br \/>\n457(1)(a) of the Companies Act,1956 to file Special Leave Petition<br \/>\nbefore the Hon&#8217;ble Supreme Court of India against the orders dated<br \/>\n25.02.2010 at Annexure  C  to this report.\n<\/p>\n<p>(b)\tThis<br \/>\nHon&#8217;ble Court may be pleased to permit the Official Liquidator to<br \/>\nengage Shri Gaurav Agrawal, an advocate from the panel of Office of<br \/>\nthe Official Liquidator, High Court of Delhi to draft and file S.L.P.<br \/>\nand to appear before the Hon&#8217;ble Supreme Court of India as special<br \/>\ncounsel.\n<\/p>\n<p>(c)\tThis<br \/>\nHon&#8217;ble Court may also be pleased to permit the Official Liquidator<br \/>\nto engage a Senior Counsel also at New Delhi to argue the S.L.P.<br \/>\nbefore the Hon&#8217;ble Supreme Court of India.\n<\/p>\n<p>(d)\tThis<br \/>\nHon&#8217;ble Court may also be pleased to permit the Official Liquidator<br \/>\nto pay such professional fee of Shri Gaurav Agarwal as advocate on<br \/>\nrecord and the professional fee of senior counsel, who may be<br \/>\nappointed, as may be charged by them and\/or as may be approved by<br \/>\nthis Hon&#8217;ble Court.\n<\/p>\n<p>(e)\tThis<br \/>\nHon&#8217;ble Court may also be pleased to permit the Official Liquidator<br \/>\nto incur such other incidental expenses as may be necessary in<br \/>\nconnection with filing and prosecuting  the S.L.P. The Official<br \/>\nLiquidator may be permitted to pay the fee of the advocate on record<br \/>\nand senior counsel and to incur the incidental expenditure either out<br \/>\nof the fund lying in the company&#8217;s account or from C.P.S.S.R.F. A\/c.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Ms.Amee Yajnik, learned advocate appearing on behalf of the<br \/>\nOfficial Liquidator, prayer in terms of para 4(a), (b), (c)  and (e)<br \/>\nare hereby granted in toto. It is reported that as per practice, any<br \/>\nAdditional Solicitor General of India is engaged as Senior Counsel<br \/>\nand, therefore, Official Liquidator may continue with the same<br \/>\npractice by engaging any Additional Solicitor General of India as<br \/>\nSenior Counsel.
