punishabie under Sections 279 and33.7 of  ” 3′ V\n<\/p>\n
2. Heard regarding adrrieission. V V.\n<\/p>\n
3. As seen frointhe  tnhepetitvivoner is aileged<\/p>\n
to  a@KiS!?:t:T(VZ;’.’bushearing Regn.No.19\/F~1723 in
\na rashuand  while driving towards Mysore.<\/p>\n
onf19.9.3’2″00s,\u00bb.ttreis’ane\u00a7i’e’ged, at 3.45 PM, the bus reached<\/p>\n
 Atienjgaidevargukoooai”jviliage within the limits of Yeiwala<\/p>\n
 The petitioner was driving at high speed in<\/p>\n
 negligent manner and iost control. The bus hit<\/p>\n
 against PW.3 Parvathamma, consequent to which she feii<\/p>\n
 suffering injuries to her head, shouider and other<\/p>\n
__5parts of her body. Report in this regard was submitted at<\/p>\n
the jurisdictional Police Station, who after investigation
\nfiled a final report indicting the petitioner for the offences<\/p>\n
punishahie under Sections 279 and 337 of IPC.<\/p>\n

4. The accused pleaded not guilty and was put to
\ntrial, during which the prosecution reiied on the evidence
\nof 7 witnesses and 8 documents. Considering the
\nincriminating aspects spoken to by witnesses, he was<\/p>\n
found guilty against which he was in Crimi_na_l”–RAp’pleal<\/p>\n
before the Appellate Court in Appeal No.2f:fo\/2o1oii?’;’ <\/p>\n
reiterated the piea of innoce5n’ce””and, t;rEed’\u00ab.to”–\u00a7asten T V<\/p>\n
actionable negligence on the  hersei\ufb01.vihichltlie<\/p>\n
Appellate Court found was”i~vonvtenat.3ieg_and:”_:dis.rniss’ed the
\nappeal. Against vboth irnpug.neucl”–.judgnients. he is in<\/p>\n
revision.\n<\/p>\n
VS. = would contend that the<\/p>\n
prosecution _:Vevi.d..enc’e through PWs.1,2 and 3 itself shows,<\/p>\n
 A at..the’iw.sp’o.t wherethe accident occurred, a tree had fallen<\/p>\n
a_.nd- removed. PW.3 Parvathamma unmindful<\/p>\n
of4:V%the..t:r’a,i’fi.c, crossed the road and by her own act of<\/p>\n
 A negl’ige*nce, possibly she must have fell down suffering<\/p>\n
 ‘einjjllgries. He submits that there is no collision between the<\/p>\n
bus and the victim.\n<\/p>\n
6. Secondly, he would contend even if we accept the<\/p>\n
statements of witnesses, they speak only of the occurrence<\/p>\n

of the accident, but do not describe how it happened.
\nThey are totally silent as to how the accident occurred and<\/p>\n
spok\ufb01\ufb01 nothing about the alleged rashness and vneg_l’ig.ence<\/p>\n
in driving. He would further submit that Pi\/_\\g”;’E:<\/p>\n
of the bus has also given a clear evidence..t.h’a.tthiere is no <\/p>\n
rashness of the driving of the f;th–e ‘:pe’titiorie’r:,: ‘<\/p>\n
this ground, he seeks acc;u.itta|.\n<\/p>\n
7. Per contra, learnedVR”\ufb01ov’ernmlentxiPleallder Sri.Raja
\nSubramanya Bhat, lias:\u00ab–s’ut-ilposrtedthe’\u00abreasons”assigned by
\nthe Courts below to co.nvic.t <\/p>\n
  what is urged, I have examined
\nthe records. _ <\/p>\n
 is 13. Firslti-yyiivt is to be noticed that PWs.1 and 2 are the<\/p>\n
  and they have stated of having seen the<\/p>\n
 which PW.3 Parvathamma said to have<\/p>\n
su”ffer’=ed”i’njuries. Each of them say a tree had fallen at<\/p>\n
is * the place where the accident has occurred and it was being<\/p>\n
removed. It is also not in dispute that the situs where the<\/p>\n
“accident has occurred is a road within the territory of<\/p>\n
Municipal limits of Mysore and one can accept reasonable<\/p>\n
traffic and movement of people. Undoubtediy, the driver<\/p>\n

i__\/’<\/p>\n
was conscious or must have noticed that there was
\nobstruction of the road due to fail of a tree and it was<\/p>\n
incumbent upon him to have taken all possible pvrxecautions<\/p>\n
to controi the vehicle. Instead, the evidence’\u00absho_ws,.Vui:e<\/p>\n
proceeded trying to negotiate the obstructed’:”.sp’o:t and:<\/p>\n
against the obstruction. Suchrfacts\u00e9zfuhdoubtiediysaire,in ‘<\/p>\n
contravention of Section 18-{of i~\u00e9\/i’oto’i’ Vehic’ie&s.,A.ct,’_i’;<\/p>\n
which reads thus;\n<\/p>\n
” Driving dangerou;sly,V- .  ”  \u00bb   _
\nWhoever drives a ‘tn,1_ot0r vel:ric’ie’.\ufb01’V’at’_’.a speed or<\/p>\n
in a manner  da’nfge_ro’us\u00ab to the public,<\/p>\n
tre\ufb01erd thecircumstances of the
\n7,case “nature, condition and use of
\ntiiepilace. vehicle is driven and the<\/p>\n
. ., amobnt of.v”tra’ffic”‘$which actually is at the time
\n  which reasonably be expected to be in
\n..,A’ti2e’\u00ab..Apia_ce, shall be punishable for the first
\nit  imprisonment for a term which
\nextend to six months or with fine which<\/p>\n
~~ vmay extend to one thousand rupees, and for
\nany second or subsequent offence if committed
\nwithin three years of the commission of a
\nprevious similar offence with imprisonment for<\/p>\n
a term which may extend to two years, or with
\nfine which may extend to two thousand<\/p>\n
rupees, or with both.\n<\/p>\n<\/p>\n
10. Fortunately, the victim has suffered injuries as<\/p>\n
otherwise the effect would have been fatal. It s4i.sVV_ifo_:ri~.this<\/p>\n
reason we expect atleast the drivers of the.$tatie’jowr.iedi_s<\/p>\n
Corporation to be conscious of “the safetyi:’_of'”=life_ <\/p>\n
property, unlike any private tran’spo:2fttotperators w’iie.re”ttt%f.e<\/p>\n
main object would be profiitipmaking’.-..ll\\ihenVthejrS.tate3 <\/p>\n
Transport Corporation run  for theberiefit of the
\ncommuters i.e. citizen’szV:anyd”l-.igt  to ensure safety
\nof the passengers asiweil,::be’c’a.usex.p*rofi.t~”making cannot be
\nits motive; a4|f$Q_{*n:oti.\u00a7y\u00e9\u00a7i.”‘inithe recent Past that
\nreckleslsgy Vtofithe Corporation owned
\nbuses.’  of iife and injuries to several
\npersonsIx_’_4 Safety4V.tbse’ing.\u00bbs.iiparamount consideration is given<\/p>\n
to{the~ wind’s”~..an_d therefore no iiberal approach can be<\/p>\n
 must also be observed that the Corporation<\/p>\n
 AA ownedtbuses are to ply invariably within the city limits for<\/p>\n
  purpose of transport of the commuters and therefore<\/p>\n
 precautions of their safety is a must. In the instant case,<\/p>\n
when we keep this in mind and examine the evidence on
\nrecord the bus has entered the territorial limits of Mysore<\/p>\n
and the driver was negotiating a road which was not<\/p>\n
1\/<\/p>\n
narrow but sufficient wide. There was a road obstruction<\/p>\n
due to fall of a tree and he was expected to4…bie..,_:’id,ore<\/p>\n
cautious. It is not only he failed to take  <\/p>\n
appears to have driven rashly,_despite_rsuch’_~Ob’str-ucti,on’~at<\/p>\n
ignoring the movement of persons.j”sii5’hat\u00bb._h’as”resul.teti_i’n<\/p>\n
the accident in question. ”:__’The learned J’u’dg.e..,_,hwe|..d <\/p>\n
guilty of culpable negligen_cue’.\u00bb.,_A.sv far sentence is
\nconcerned, still the p’etitioner{.gis  satisfied. As far as
\nthe evidence _of__the;”Cor1duc’to.r,__i’s..”co.ni:’e’rned, it is quiet<\/p>\n
obvious  hostile tomhelp his colleague.
\n hausvlrelied on the decision of this
\nCourtin the case_ljV~of’DiJi=_gappa vs. The State of Karnataka<\/p>\n
reported ll’:,_:IL,Q..”2t708′”‘.l<AR 3759, wherein a co-ordinate<\/p>\n
–  A Esench”:of”l-this Cllourtvconsidering the occurrence of accident<\/p>\n
in’th_\u00e9’\u00bb..ciilc’uinj”stances like in this case and on the facts of<\/p>\n
that c~as:e:’..-nloticed the complainant had not described the<\/p>\n
 Ag alleged’ rashness in driving and acquitted the accused. In<\/p>\n
  regard all that can be observed is, the conclusion of<\/p>\n
 the learned Judge in that case is based, on and confined to<\/p>\n
the facts of that, but in the instant case the facts are not
\nso. In the instant case, the fact that there was<\/p>\n
obstruction on the road and despite such obstruction for<\/p>\n
e’: -‘>

checking his speed. It is for this reason, I have_4t.alke_:n~..the<\/p>\n
view that it amounts to contravention of  -the<\/p>\n
