The District Superintendent of Education, Bettiah, Bihar.\n                                       ----------------------------------\n<\/pre>\n<p>03.   29.09.2011                   This writ application has been filed for quashing the notice<\/p>\n<p>                        20.02.2008, by which the Circle Officer, Narkatiaganj has ordered the<\/p>\n<p>                        petitioner to vacate the land in question which is the land of Govt.<\/p>\n<p>                        Middle School, Sathi.\n<\/p>\n<p>                                    The petitioner is a teacher of Government Middle School,<\/p>\n<p>                        Sathi. She has challenged the order by which notice has been issued to<\/p>\n<p>                        her to vacate the lands belonging to the school in question.<\/p>\n<p>                                    The case of the petitioner is that her husband Seraj Alam<\/p>\n<p>                        have died on 16.07.2004 had applied for settlement of the land and after<\/p>\n<p>                        his death the proceeding became stagnant.         Although there was a<\/p>\n<p>                        recommendation for settlement of the said land in the name of the<\/p>\n<p>                        petitioner&#8217;s husband.\n<\/p>\n<p>                                    This Court is not inclined to quash the notice issued to the<\/p>\n<p>                        petitioner. The petitioner should appear before the concerned authority<\/p>\n<p>                        and file show cause along with the materials including the order<\/p>\n<p>                        recommending the settlement in favour of her husband, thereafter the<\/p>\n<p>                        concerned authority i.e. Circle Officer, Narkatiaganj shall take steps in<\/p>\n<p>                        accordance with law.\n<\/p>\n<p>                                    Accordingly, this application is disposed of.<\/p>\n<pre>           Mkr.
