No.39199 of 2004\n                      NANAK CHANDRA GUPTA &amp; ORS\n                                    Versus\n                          STATE OF BIHAR &amp; ANR\n\n                                      -----------\n<\/pre>\n<p>9   2.7.2008                     Learned counsel is permitted to make necessary<\/p>\n<p>                  correction with regard to court&#8217;s name in paragraph-1 of the<\/p>\n<p>                  application.\n<\/p>\n<p>                                 Heard learned counsel for the petitioners and learned<\/p>\n<p>                  counsel for the State.\n<\/p>\n<p>                                 However, none appears on behalf of opposite party<\/p>\n<p>                  no.2 to argue the matter.\n<\/p>\n<p>                                 This application has been filed for quashing the order<\/p>\n<p>                  dated 16.4.2004 passed by learned Sub-divisional Magistrate,<\/p>\n<p>                  Bhabua in Complaint Case no. 712\/02 whereby and whereunder he<\/p>\n<p>                  had taken cognizance under section 498A of the Penal Code against<\/p>\n<p>                  the petitioners accused and issued summons for their appearance.<\/p>\n<p>                                 Shortly stated the case of the complainant\/opposite<\/p>\n<p>                  party no.2, as put in the petition of complaint is that she was married<\/p>\n<p>                  with late Manoj Kumar Gupta son of petitioner no.1 on 26.4.1999 at<\/p>\n<p>                  Baidyanath Dham, Deoghar temple in which several presentations<\/p>\n<p>                  were given. After marriage she began to live with her husband at<\/p>\n<p>                  Mithapur, Patna. It is further said that she went to her naihar at<\/p>\n<p>                  village Bahuara, P.S. Dildarnagar, District Gazipur with her husband<\/p>\n<p>                  where her husband died on 31.5.2001 and thereafter she returned to<\/p>\n<p>                  Patna and again taken back to Bahuara as she was pregnant. In the<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>month of August, 2001 she gave birth to a daughter. On being<\/p>\n<p>informed her father in law came and brought her to Mithapur, Patna.<\/p>\n<p>It has been alleged that at Patna petitioners tried to obtain her<\/p>\n<p>signature on a plain paper to grab the property of her husband who<\/p>\n<p>had business at Patna. When she refused to sign papers she was<\/p>\n<p>ousted from the house and inspite of social pressure she was not<\/p>\n<p>accepted by the petitioners and ultimately on 26.7.2002 accused<\/p>\n<p>persons\/petitioners ousted her from the house. She then returned to<\/p>\n<p>her Naihar. It appears that a petition of complaint was filed before<\/p>\n<p>the Chief Judicial Magistrate, Bhabua on 2.8.2002.<\/p>\n<p>              It appears that the complainant was examined on<\/p>\n<p>solemn affirmation and during inquiry under section 202 Cr.P.C.<\/p>\n<p>one witness was examined and the learned Magistrate after being<\/p>\n<p>satisfied that there was sufficient ground for proceeding against the<\/p>\n<p>accused petitioners under section 498A of the Penal Code, issued<\/p>\n<p>summons against them for appearance.\n<\/p>\n<p>              The argumernt of learned counsel is that the court at<\/p>\n<p>Bhabua has no territorial jurisdiction to entertain the complaint. He<\/p>\n<p>submitted that no part of cause of action took place at Bhabua. There<\/p>\n<p>is no allegation even of conspiracy.\n<\/p>\n<p>              As per allegation the marriage was performed at<\/p>\n<p>Deoghar. After marriage the complainant was brought to Patna by<\/p>\n<p>her husband where she started living. Complainant&#8217;s naihar is at<\/p>\n<p>Gazipur in the State of U.P.\n<\/p>\n<p>              I find substance in the argument of learned counsel<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>     that no part of the occurrence was committed at Bhabua. It is not<\/p>\n<p>     clear why the complainant decided to file complaint at Bhabua.<\/p>\n<p>                  In the facts and circumstances of the case, the<\/p>\n<p>     complaint case filed at Bhabua is not maintainable.<\/p>\n<p>                  For the aforesaid reasons, this application is allowed<\/p>\n<p>     and the order of cognizance dated 16.4.2004 is hereby quashed.<\/p>\n<pre>Al                                            (M.Saran,J)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Nanak Chandra Gupta &amp;Amp; Ors vs State Of Bihar &amp;Amp; Anr on 2 July, 2008 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
