It is also prayed by the<br \/>\n\tpetitioner to direct respondent Nos. 1 and 2 to pass appropriate<br \/>\n\torders for releasing outstanding dues of the petitioner for the<br \/>\n\tperiod during which, she remained out of service on account of the<br \/>\n\talleged order of dismissal for which the approval is not granted. It<br \/>\n\tis also prayed by the petitioner to direct respondent Nos. 1 and 2<br \/>\n\tto take appropriate action so that she can discharge her duty in<br \/>\n\tsafe atmosphere in the school.\n<\/p>\n<p>Heard<br \/>\n\tMr. Vyas learned Counsel for the petitioner, Mr. Oza learned AGP for<br \/>\n\tthe respondent Nos. 1 and 2 and Mr. Pancholi learned Counsel has<br \/>\n\tappeared on behalf of the respondent No. 3.\n<\/p>\n<p>It<br \/>\n\tappears that pursuant to the interim order passed by this Court in<br \/>\n\tthe present proceedings, directions were given to the District<br \/>\n\tEducational Officer to remain present, and thereafter, he was also<br \/>\n\tdirected to take effective steps as ordered by this Court for the<br \/>\n\tpayment of the salary, and allowing her to resume duty.\n<\/p>\n<p>Today,<br \/>\n\twhen the matter is taken up for further hearing, Mr. Vyas learned<br \/>\n\tCounsel for the petitioner states that the petitioner has been<br \/>\n\tpermitted to resume duty and she is working as the Asst. Teacher<br \/>\n\twith the respondent No. 3 school. However, he states that backwages<br \/>\n\tfor the period, during which she was not on duty on account of the<br \/>\n\talleged order of dismissal for which the approval was not granted,<br \/>\n\tthe same is not paid to the petitioner and therefore, this Court may<br \/>\n\tnot consider the matter only for such purpose. It was also submitted<br \/>\n\tthat since two times assault have been made upon the petitioner,<br \/>\n\tthis Court may direct respondent authority to ensure that the<br \/>\n\tpetitioner, is in a position to discharge her duty in a safe<br \/>\n\tatmosphere.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tOza learned AGP upon the instructions of Mr. B.V. Chaudhary, Asst.<br \/>\n\tEducation Inspector, declared before the Court that DEO has already<br \/>\n\tprepared bill for the backwages and the amount will be paid as and<br \/>\n\twhen the same is sanctioned by the Treasury. He submitted that<br \/>\n\tthereafter, the said amount shall be deducted from the grant payable<br \/>\n\tto the respondent No. 3 School.\n<\/p>\n<p>On<br \/>\n\tbehalf of the respondent No. 3, Mr. Pancholi learned Counsel<br \/>\n\tsubmitted that as such, as on today there is no prohibitory order of<br \/>\n\tany competent forum known to law, restraining the petitioner to<br \/>\n\tdischarge duty as the teacher nor there is any prohibitory order<br \/>\n\tagainst backwages payable to her during the period of dismissal.<br \/>\n\tHowever, he submitted that respondent No. 3 is contemplating to file<br \/>\n\tthe petition challenging the action of granting non-approval by the<br \/>\n\tCommissioner Mid-day Meals and Schools on the ground that he did not<br \/>\n\texercise power within stipulated time limit and therefore, it was<br \/>\n\tthe case of deemed approval. He did admit that there is delay of<br \/>\n\tabout three years in filing petition, but the respondent No. 3 shall<br \/>\n\texplain such delay and shall pursue proceedings appropriately. It<br \/>\n\twas therefore, submitted that even if this Court is inclined to pass<br \/>\n\tappropriate order in the present petition, the right of the<br \/>\n\trespondent No. 3 in the event succeeds in the said petition may not<br \/>\n\tbe prejudiced.\n<\/p>\n<p>It<br \/>\n\tappears that as on today in absence of any prohibitory order of any<br \/>\n\tcompetent forum against the petitioner for reinstatement in service<br \/>\n\tor to discharge the duty, it will be required for the respondent No.<br \/>\n\t3 to permit her to discharge the duty on the post of Asst. Teacher,<br \/>\n\twhich in any case is permitted and as recorded hereinabove, the<br \/>\n\tpetitioner is functioning as the Asst. Teacher in the respondent No.<br \/>\n\t3 school. Therefore, no further orders are required to be passed in<br \/>\n\tthis regard except recording that the petitioner is permitted to<br \/>\n\tresume duty in the respondent No. 3 school, the same will be allowed<br \/>\n\tto continue unless there is any prohibitory order of any competent<br \/>\n\tforum known to law.\n<\/p>\n<p>So<br \/>\n\tfar as the backwages for period during which the petitioner remained<br \/>\n\tout of service on account of the alleged order of dismissal, and the<br \/>\n\tapproval not granted, is concerned, as declared by learned AGP bill<br \/>\n\tis already prepared and the payment therefore, would be made after<br \/>\n\tsanction from the treasury.\n<\/p>\n<p>\tAs a consequence thereof the petitioner would get backwages for the<br \/>\n\tsaid period, and hence the same would take care of the grievance<br \/>\n\traised by the petitioner for the payment of the backwages. However,<br \/>\n\tas respondent No. 3 is contemplating to challenge the said order, in<br \/>\n\tthe event the amount is already utilised by the petitioner fully,<br \/>\n\tthe question of refund may arise. Therefore, the petitioner if<br \/>\n\tretains 50 percent of the amount for a reasonable time, no serious<br \/>\n\tprejudice will be caused. In the meantime respondent No. 3 may<br \/>\n\tpursue proceedings on the basis of the right as available in law,<br \/>\n\tand if any prohibitory order is passed, the same would also hold<br \/>\n\tfield and in absence thereof the petitioner may be at the liberty to<br \/>\n\tutilise money of the remaining amount also.\n<\/p>\n<p>Hence,<br \/>\n\tit is observed that payment shall be made of the backwages as per<br \/>\n\tthe bill prepared by the DEO and may also be credited in the account<br \/>\n\tof the petitioner, however, the petitioner shall retain 50 percent<br \/>\n\tof the amount for the period of 15 days from the credit of the<br \/>\n\tamount in her account. It is also clarified that in the event any<br \/>\n\tprohibitory order is passed by any competent forum known to law, the<br \/>\n\tpetitioner shall use amount accordingly, but in absence thereof or<br \/>\n\tif no order is communicated to the petitioner during the period of<br \/>\n\t15 days, the petitioner shall be at the liberty to utilise the<br \/>\n\tamount, in accordance with law.\n<\/p>\n<p>Since<br \/>\n\tthe petitioner is a lady teacher, it would be required for the<br \/>\n\tManagement namely respondent No. 3 to ensure that she is in a<br \/>\n\tposition to discharge the duty in safe atmosphere and upon the<br \/>\n\tfailure by respondent No. 3, it would be required for the respondent<br \/>\n\tNo. 2 DEO or in any case Commissioner respondent No. 1 herein, to<br \/>\n\tensure that the lady teacher is in a position to discharge the duty<br \/>\n\tin safe atmosphere and there is no harassment by other staff member.<br \/>\n\tIf any complaint is made by the petitioner to respondent Nos. 1 or 2<br \/>\n\tin this regard, respondent No. 2 shall be at the liberty to pass<br \/>\n\tappropriate orders in accordance with law, after giving opportunity<br \/>\n\tof hearing to the concerned parties.\n<\/p>\n<p>The<br \/>\n\tpetition is disposed accordingly. It is clarified that the present<br \/>\n\torder shall not operate as a bar to the respondent No. 3 in pursuing<br \/>\n\tproceedings against the approval not granted by the Commissioner<br \/>\n\tMid-day Meals School. If such challcenge is brought before the<br \/>\n\tappropriate forum including this Court, the rights and contentions<br \/>\n\tof both the sides shall  remain open.
