At the very outset, the learned counsel for the<\/p>\n<p>                       petitioner     seeks    permission       to      make   necessary<\/p>\n<p>                       correction in the provision of law.                Permission is<\/p>\n<p>                       accorded.\n<\/p>\n<p>                                Heard, the learned counsel for the petitioner.<\/p>\n<p>                                This     application under        Article 227 of the<\/p>\n<p>                       Constitution of India has been filed against the order<\/p>\n<p>                       dated 20.12.2010 as contained in Annexure &#8216;3&#8217; passed<\/p>\n<p>                       by Principal Judge, Family Court, Begusarai in Divorce<\/p>\n<p>                       case No.46 of 2007 whereby the learned Court below<\/p>\n<p>                       allowed the application under Section 24 of the Hindu<\/p>\n<p>                       Marriage Act, 1955 and directed this petitioner to pay<\/p>\n<p>                       Rs.1500\/-       per    month     as      maintenance     to   the<\/p>\n<p>                       respondent, Reena Devi.\n<\/p>\n<p>                                The      learned      counsel     for    the   petitioner<\/p>\n<p>                       submitted that the respondent Reena Devi had lodged<\/p>\n<p>                       F.I.R. against the petitioner under Section 498 (A)           and<\/p>\n<p>                       during investigation, the police found that in fact<\/p>\n<p>                       because of adultery, there is dispute between the<\/p>\n<p>                       parties and the respondent has filed this criminal case<\/p>\n<p>                       under Section 498 (A) of I.P.C. and on the basis of that<\/p>\n<p>                       finding, final form has been submitted.             However, the<\/p>\n<p>                       learned Court below considering the statement of the<br \/>\n<span class=\"hidden_text\">               -2-<\/span><\/p>\n<p>respondent took cognizance under Section 498 (A) of<\/p>\n<p>I.P.C.\n<\/p>\n<p>         According to the learned counsel, in such view<\/p>\n<p>of the matter, the petitioner has got good prima facie<\/p>\n<p>case as the divorce case has been filed on the ground of<\/p>\n<p>adultery. Secondly, the learned counsel submitted that<\/p>\n<p>the petitioner is not regular employee. Although, he is<\/p>\n<p>an Advocate, he is not a regular practitioner and he<\/p>\n<p>does freelance work of Rashtriya Sahara newspaper and<\/p>\n<p>he has got no sufficient income to pay Rs.1500\/- per<\/p>\n<p>month to the respondent.\n<\/p>\n<p>         From perusal of the impugned order, it appears<\/p>\n<p>that the learned Court below has considered all these<\/p>\n<p>aspects of the matter.     The learned Court below also<\/p>\n<p>found that the person against whom adultery is alleged<\/p>\n<p>has died in the year 2007 itself and this divorce case<\/p>\n<p>has been filed in the year 2007.     The learned Court<\/p>\n<p>below also considered the fact that the petitioner is an<\/p>\n<p>Advocate and according to the learned Court below<\/p>\n<p>even now a skill labour can get Rs.4000\/- per month.<\/p>\n<p>         Considering all these aspects of the matter, the<\/p>\n<p>learned Court below granted Rs.1500\/- as maintenance<\/p>\n<p>to the respondent per month. So far the finding of the<\/p>\n<p>police regarding adultery is concerned, it is not binding<\/p>\n<p>on the Civil Court.
