S.J.MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nAppeal has been preferred by the appellant (respondent) against the<br \/>\norder dated 15th February 2011 whereby the learned Single<br \/>\nJudge, while issuing rule and notice as to interim relief, passed<br \/>\nad-interim order staying the election of President and Council<br \/>\nMembers of appellant &#8211; Charutar Vidya Mandal (hereinafter<br \/>\nreferred to as &#8216;Education Trust&#8217;).\n<\/p>\n<p>\tWe<br \/>\nhave heard counsel appearing on behalf of the appellant-respondent<br \/>\nand counsel appearing on behalf of the contesting first, second and<br \/>\nthird writ petitioners. Joint Charity Commissioner being a formal<br \/>\nparty, no notice be issued.\n<\/p>\n<p>\tFrom<br \/>\nthe impugned order, it appears that the learned Single Judge accepted<br \/>\nthe submissions made on behalf of the respondent &#8211; writ<br \/>\npetitioners that various irregularities have been committed, which<br \/>\nled to only conclusion that the affairs of the Education Trust are<br \/>\nhijacked by the appellant-respondent and the same are managed<br \/>\naccording to their whims and not in accordance with the Trust-deed<br \/>\nand the rules and regulations. Notice for interim relief has been<br \/>\nissued but interim order for stay of election has been passed. From<br \/>\nthe record, it will be evident that election is scheduled to be held<br \/>\non 6th March 2011. Prior to order of stay passed by the<br \/>\nlearned Single Judge staying the process of election, notification<br \/>\nhad been issued and thus election process started. In our view, once<br \/>\nelection process is started, normally the Court should not interfere<br \/>\nwith such process of election though it will always open to the Court<br \/>\nto suggest that any action or decision will be subject to the writ<br \/>\npetition.\n<\/p>\n<p>\tIn<br \/>\nthis background, we are of the view that the learned Single Judge,<br \/>\ninstead of granting ad-interim relief, ought to have decided the case<br \/>\non merits after notice to the parties, making it clear that any<br \/>\naction or election in the mean time shall be subject to the decision<br \/>\nof the writ petition. For the reason aforesaid, order granting<br \/>\ninterim stay dated 15th February 2011 is set-aside.\n<\/p>\n<p>\tTaking<br \/>\ninto consideration the fact that election is scheduled to be held on<br \/>\n6th March 2011, we direct to list this case, Special Civil<br \/>\nApplication No.2017\/2011 for hearing before the learned Single Judge<br \/>\non 28th February 2011 at 2:30 p.m. Parties should not ask<br \/>\nfor unnecessary adjournment.\n<\/p>\n<p>\tThe<br \/>\nAppeal and the Civil Application stand disposed of.
