K.B.Adhyapal&lt;:, AGA for R2)\u00bb  \n(R1 --- served) &#039;\n\nThis writ petition is fi1ed~.u&quot;nder Ar.ticles_&quot;&#039;_22&#039;5 at 227 of&#039;\nthe Constitution of India praying &quot;to quiash the\norder\/ intimation dated ..O4.02{2&#039;0Q&#039;3 &quot;&#039;i.ssued&quot;&quot;&#039;by the 2115\nrespondent at Annexure--&#039;D;&quot;an:_i eftc. &quot;   .<\/pre>\n<p>This writ petitionv.icerrfing&#8217;-on iii  hearing<br \/>\nin &#8216;B&#8217; Group this. day; the Court made thef following:<\/p>\n<p>iiii &#8216;V i <\/p>\n<p>Petitioner has the Validity of the intimation<\/p>\n<p>dated 0A4i_,02.2iO&#8217;O9i issued  the 2nd respondent produced at<\/p>\n<p>&#8220;.i2&#8243;.VCasiefiofiithe petitioner is that, in terms of the<\/p>\n<p> Qovernrneriit Order for providing contract labourers to the<\/p>\n<p> under the Department of Health and Family<\/p>\n<p>ii&#8221;-..__Wielflare, petitioner entered into a contract under an<\/p>\n<p> _i&#8217;\u00e9greement dated 31st May 2007 for a period of 2% years to<\/p>\n<p>era&#8217;.\n<\/p>\n<p>_. AnneXu&#8217;re&#8211;D.\n<\/p>\n<p>WP No.61062 of 2009<\/p>\n<p>provide contract labourers to various health institutions in<br \/>\nKoppal District. However, the 15* respondent inforrned the<br \/>\npetitioner by Annexure&#8211;D that, the service of the&#8221;&#8216;Veont&#8217;ract<br \/>\nlabourers cannot be continued for want of<br \/>\nit is at this juncture, the<br \/>\npetition inter alia stating that the<br \/>\na contract to supply labourersdforg a iperiodgof  has<br \/>\nmade arrangement by spending&#8221;r1i.o:1iey&#8217;and itiIne.*i\u00a7\\Iow, after<br \/>\nhaving entered into   having made<br \/>\narrangement  various health<\/p>\n<p>institutions,befor+:*e\u00a7&lt;piry_:ofthe contract, abruptly, without<\/p>\n<p>any justificatiovn ooirxrriltgnication is issued as per<\/p>\n<p>     by order dated 13.02.2009, on the basis<\/p>\n<p>  of the*&#8212;rnei\ufb01no  undertaking filed by the learned advocate for<\/p>\n<p>xpetitionier that he will not claim one month salary and<\/p>\n<p> salary of the employees will be paid by the<\/p>\n<p>&#039;:i_4petitioner and that he will not claim any equity, granted the<\/p>\n<p>y&#8230;-\\..\n<\/p>\n<p>WP No.61D62 of 2009<\/p>\n<p>petitioner and the Department of Health and Family Welfare,<br \/>\nKoppal District.
