SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 31\/01\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent First Appeal under Section 54 of the Land Acquisition Act has<br \/>\nbeen preferred by the appellant-original opponent-Special Land<br \/>\nAcquisition Officer challenging the impugned judgment and award<br \/>\npassed by the learned Joint District Judge, Surat (the Reference<br \/>\nCourt) in Land Reference Case No. 60\/1983 awarding compensation for<br \/>\nthe acquired land at the rate of Rs. 15 per sq meter.\n<\/p>\n<p>2.\tAt<br \/>\nthe outset, it is required to be noted that there was common judgment<br \/>\nand award passed by the learned Reference Court in Land Reference<br \/>\nCase Nos. 53\/1983 to 66\/1983, 68\/1983, 70\/1983, 72\/1983 to 74\/1983<br \/>\nand against the common judgment and award the very appellant-original<br \/>\nopponent preferred First Appeal No. 1296\/1988 and allied matters<br \/>\n(inclusive of present First Appeal No. 1303\/1988).  It is reported<br \/>\nthat by the common judgment and award dated 11\/04\/2008 the learned<br \/>\nSingle Judge has already dismissed First Appeal No. 1296\/1988 and<br \/>\nallied matters (except First Appeal No. 1303\/1988) and has confirmed<br \/>\nthe impugned judgment and award passed by the learned Reference<br \/>\nCourt.  It appears that for some reason or the other the present<br \/>\nFirst Appeal came to be separated and, therefore, the same could not<br \/>\nbe heard and disposed of alongwith the aforesaid First Appeals. In<br \/>\nview of the common judgment and order passed by the learned Single<br \/>\nJudge (Coram:- K.S. Jhaveri, J.) dated 11\/04\/2008 in First Appeal No.<br \/>\n1296\/1988 and allied matters, the present First Appeal arising out of<br \/>\nthe very common judgment and award deserves to be dismissed.  This<br \/>\nCourt considered the judgment and order passed by the learned Single<br \/>\nJudge in the aforesaid Appeals and this Court is in complete<br \/>\nagreement with the reasoning given by the learned Single Judge while<br \/>\ndismissing the aforesaid First Appeals.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above and for the reasons stated in the judgment and<br \/>\norder passed by the learned Single Judge of this Court dated<br \/>\n11\/04\/2008 in First Appeal No. 1296\/1988 and allied matters, the<br \/>\npresent First Appeal deserves to be dismissed and is accordingly<br \/>\ndismissed.  Notice discharged.
