No.2824 of 2005\n\n                    ------------------------------------------\n\n                  Dated this  the  9th day of February, 2007.\n\n\n                                        ORDER\n<\/pre>\n<p>       The revision petitioner   challenges   the order   of the Magistrate<\/p>\n<p>Court   by   which   he   was   proceeded   against   presumably   under   section<\/p>\n<p>319 of the Code of Criminal Procedure (&#8216;the Code&#8217; for short).<\/p>\n<p>       2.   It appears from the records that while PW1 was   examined,<\/p>\n<p>he gave evidence that the revision petitioner  was also involved in the<\/p>\n<p>incident   who   allegedly     assaulted   PW1   as   a   result   of     which,   he<\/p>\n<p>sustained   injuries   and   he   was   taken   to   the   hospital.     He   gave     first<\/p>\n<p>information   statement   as   Ext.P1.     After   investigation,     the   police<\/p>\n<p>referred   the   case   against   the   revision   petitioner   and   charge-sheeted<\/p>\n<p>the case only against the first  accused in the crime, for offence  under<\/p>\n<p>section 341 and 324  of IPC.\n<\/p>\n<\/p>\n<p>       3.   While   PW1   was   examined   in   court,   he     impleaded   revision<\/p>\n<p>petitioner.   The   records   produced   by   the   prosecution   will   go   to   show<\/p>\n<p>that    he  had  a  case  from   the   right  beginning  that  revision  petitioner<\/p>\n<p>had assaulted him and he sustained injuries.  The  medical records are<\/p>\n<p>also  available   to support   this.  In  such  circumstances,    the  trial   court<\/p>\n<p><span class=\"hidden_text\">[Crl.R.P.2824\/05]                             2<\/span><\/p>\n<p>observed   that   the   name   of   the   revision   petitioner   was   subsequently<\/p>\n<p>deleted   for   unknown   reasons   and   found   it   fit   to   proceed   against<\/p>\n<p>revision petitioner, after  impleading him as the second accused in the<\/p>\n<p>case.\n<\/p>\n<\/p>\n<p>          4.  Learned counsel appearing for the revision petitioner  argued<\/p>\n<p>that the statement   of the only eye witness to the occurrence  (CW2)<\/p>\n<p>which is recorded under section 161 of the  Code will go to show that<\/p>\n<p>revision petitioner was not involved in the  offence.    A  a copy of the<\/p>\n<p>statement was produced  along with  revision memo.   It is submitted<\/p>\n<p>that, this fact itself is sufficient to disbelieve the evidence of PW1.   It<\/p>\n<p>was   also   pointed   out   that   CW2   is   the   person   who   is   admittedly   an<\/p>\n<p>eyewitness     and   he   also     got   hurt   in   the   course   of   the   incident.<\/p>\n<p>According   to   PW1   himself   the   beating     accidentally     fell       on   CW2.<\/p>\n<p>Therefore,  there is absolutely   no reason to disbelieve  the statement<\/p>\n<p>recorded   under   section   161   of   the   Code,   it   is   submitted.     It   is   also<\/p>\n<p>pointed out   that the case against revision petitioner was referred by<\/p>\n<p>the   police     and   the   refer   report   was   accepted   by   the   court.   In   such<\/p>\n<p>circumstances there is no  justification  in proceeding against  revision<\/p>\n<p>petitioner,   especially   since     evidence   of   PW1   is   discredited   by   the<\/p>\n<p>version   given   by   CW2     to   the     Police       and   the   refer   report,   it   is<\/p>\n<p>strongly contended.\n<\/p>\n<p>\n<span class=\"hidden_text\">[Crl.R.P.2824\/05]                           3<\/span><\/p>\n<p>       5.On hearing both sides, I am satisfied   that none of the above<\/p>\n<p>arguments are acceptable.   The fact that a contradictory statement is<\/p>\n<p>available   in   the   case   diary     statement   of   an   eye-witness     is   not   a<\/p>\n<p>reason  at this state to disbelieve the evidence of  PW1. Even without<\/p>\n<p>examining CW2 in the court, it cannot   be said whether his   evidence<\/p>\n<p>will   contradict   the   evidence   of   PW1.   Evidence   does   not   mean     the<\/p>\n<p>statement   of   the   eye   witnesses   recorded   under   section   161   of   the<\/p>\n<p>Code. On the ground that the evidence given by  PW1 is contradictory<\/p>\n<p>to   the   statement   of   CW2   which     recorded   under   section   161   of   the<\/p>\n<p>Code, the evidence of PW1 cannot be discarded at this stage.<\/p>\n<p>       6.   PW1     had   a   consistent   case   during   the   investigation   stage.<\/p>\n<p>A   reading   of     first   information   statement   along   with   the   allegation<\/p>\n<p>made to the  Doctor and also  the statement of PW1 which is recorded<\/p>\n<p>under   section   161   of   the   Code     would       all   persuade   any   court   to<\/p>\n<p>proceed against the  revision petitioner invoking section 319 of Cr.P.C.<\/p>\n<p>The trial court has rightly exercised   it powers and there is no illegality<\/p>\n<p>or   impropriety   in   this   regard.       The   question   whether     PW1   can   be<\/p>\n<p>believed or CW2 (who is the sole eyewitness  to the occurrence) is  to<\/p>\n<p>be  believed or not  is a  matter of evidence, which can be decided by<\/p>\n<p>the court during trial.   But,     it is too   insufficient to   interfere in the<\/p>\n<p>order   passed.   There   is   no   reason   to     set   aside   the   impugned   order.<\/p>\n<p><span class=\"hidden_text\">[Crl.R.P.2824\/05]                          4<\/span><\/p>\n<p>The   trial   court   is     justified   in     proceeding     against   the     revision<\/p>\n<p>petitioner  under section 319 of the Code.\n<\/p>\n<\/p>\n<p>        7. I  refrain myself  from   discussing any matter on the  merits<\/p>\n<p>of the case, since any observations  so made  may prejudice the mind<\/p>\n<p>of the trial court and it may affect a fair trial. I do not find any illegality<\/p>\n<p>or impropriety  in the order under challenge.\n<\/p>\n<\/p>\n<p>        This revision is dismissed.\n<\/p>\n<\/p>\n<p>                                                                 SD\/-\n<\/p>\n<p>\n                                                          K.
