Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/07\/2008\n\n O R D E R\n                    M.SASIDHARAN NAMBIAR, J.\n\n                      -------------------------------\n\n                         C.R.P.No.900 of 2007\n\n                      -------------------------------\n\n                     Dated this the 17th July, 2008.\n\n                               O R D E R\n<\/pre>\n<p>                This revision is filed challenging the order of the<\/p>\n<p>Executing Court confirming the sale.        The sale was confirmed on<\/p>\n<p>30.11.2006. Executing court reported that no further steps was taken<\/p>\n<p>thereafter.\n<\/p>\n<\/p>\n<p>                2. The learned counsel appearing for the decree holder<\/p>\n<p>respondent submitted that respondent will not oppose the prayer for<\/p>\n<p>setting aside the sale, if the State is prepared to deposit the entire<\/p>\n<p>amount due, as provided under Rule 89 of Order XXI of Code of Civil<\/p>\n<p>Procedure before the executing court, including interest till date within<\/p>\n<p>a specified time.\n<\/p>\n<\/p>\n<p>                3.  The learned Government Pleader       submitted that<\/p>\n<p>revision petition may be disposed, directing the executing court to set<\/p>\n<p>aside the sale on the application to be filed by the State.<\/p>\n<p>CRP.No.900 of 2007<\/p>\n<p><span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>                The revision is disposed as follows. If State deposits<\/p>\n<p>the entire amount due to the decree holder inclusive of the interest up<\/p>\n<p>to that date, as provided under Rule 89 of Order XXI of Code of Civil<\/p>\n<p>Procedure, and files an application to set aside the sale, Execution<\/p>\n<p>Court to set aside the sale and pass appropriate orders allowing decree<\/p>\n<p>holder to withdraw the amount.
