    Petitioners are accused 2 and 3 in C.C.<\/p>\n
No.316\/08  on  the   file  of  Chief  Judicial<\/p>\n
Magistrate’s Court, Kalpetta. Prosecution case<\/p>\n
is that all the accused committed offences<\/p>\n
under Sections 2(14), 39B, 51 and 57 of the<\/p>\n
Wild Life  (Protection) Act, 1972  (hereinafter<\/p>\n
referred to as ‘the Act’).       The case as<\/p>\n
against the first petitioner is that he is the<\/p>\n
owner of Hotel ‘MGT International’ near Civil<\/p>\n
Station, Wayanad at Kalpetta and on 8.4.2004<\/p>\n
getting information that trophy of wild animal<\/p>\n
is kept in the building, Forest Range Officer<\/p>\n
conducted a raid and seized the trophy from<\/p>\n
the  room  used  by  the  first  accused,  the<\/p>\n
Manager, who was reportedly hospitalised at<\/p>\n
that time. The case is that first petitioner,<\/p>\n
being the owner and second petitioner, being<\/p>\n
CRMC 1789\/09               2<\/span><\/p>\n
the person in charge of running of the hotel, have<\/p>\n
also committed offences under Sections 2(14), 39B,<\/p>\n
51 and 57 of the Act.    This petition is filed under<\/p>\n
Section 482 of the Code of Criminal Procedure to<\/p>\n
quash the proceedings as against the petitioners.<\/p>\n
    2. It is contended that there is no specific<\/p>\n
overt   act   alleged  against  the  petitioners  and<\/p>\n
though     the   building  belongs   to   the   first<\/p>\n
petitioner, hotel is being managed by the second<\/p>\n
petitioner and the trophy was seized from the room<\/p>\n
of  the     first accused  and  in  the  absence   of<\/p>\n
allegation     of   any   overt   act   against   the<\/p>\n
petitioners, prosecution as against them is only an<\/p>\n
abuse of process of the court and therefore, the<\/p>\n
case as against them is to be quashed.<\/p>\n
    3.Learned counsel appearing for the petitioners<\/p>\n
and learned Public Prosecutor were heard.<\/p>\n
    4.     The  argument  of   the  learned   counsel<\/p>\n
appearing for the petitioners is that Annexure-I<\/p>\n
charge sheet submitted by the Forest Range Officer<\/p>\n
itself would show that first petitioner, though is<\/p>\n

the owner of the hotel, due to his age as well as<\/p>\n
illness, was not managing the hotel and second<\/p>\n
petitioner     is   managing   it   and    in   such<\/p>\n
circumstances, even if first accused committed any<\/p>\n
offence, first petitioner cannot be prosecuted for<\/p>\n
the offences and therefore, prosecution as against<\/p>\n
the first petitioner is an abuse of process of the<\/p>\n
court and is to be quashed.    As against the second<\/p>\n
petitioner, it is contended that even though second<\/p>\n
petitioner is running the hotel, the case was<\/p>\n
foisted due to enmity of the employees of the<\/p>\n
Zodiac Bar, as the period expired and a case is<\/p>\n
pending before the Munsiff’s Court, Kalpetta for<\/p>\n
eviction and second petitioner has nothing to do<\/p>\n
with the offences alleged and if at all, it would<\/p>\n
lie only against the first accused and therefore,<\/p>\n
the case as against second petitioner also is to be<\/p>\n
quashed.\n<\/p>\n
    5.     Learned Public Prosecutor argued that the<\/p>\n
offending trophy was seized from the room of the<\/p>\n
Manager of the hotel and the hotel is owned by the<\/p>\n
CRMC 1789\/09              4<\/span><\/p>\n
first petitioner and therefore, the presumption is<\/p>\n
that the offending trophy was kept there with the<\/p>\n
knowledge of the first petitioner and under Section<\/p>\n
57 of the Act, a presumption is available in favour<\/p>\n
of the prosecution as against the first petitioner<\/p>\n
also   and   therefore, the case  cannot be  quashed<\/p>\n
exercising the inherent powers of this Court under<\/p>\n
Section 482 of Code of Criminal Procedure. Learned<\/p>\n
Public Prosecutor also submitted that as far as<\/p>\n
second petitioner is concerned, he is the person<\/p>\n
responsible for running the hotel and in such<\/p>\n
circumstances question whether offending trophy was<\/p>\n
kept there with the knowledge and consent of the<\/p>\n
second petitioner is a matter for decision on<\/p>\n
evidence and at this stage second petitioner is not<\/p>\n
entitled to get the proceedings quashed.<\/p>\n
    6.     The presumption provided under Section 57<\/p>\n
of the Act can be drawn only if possession, custody<\/p>\n
or control of any captive animal, animal article,<\/p>\n
meat (trophy, uncured trophy, specified plant or<\/p>\n
part or derivative thereof) is established with the<\/p>\n

accused.    If   possession, custody   or control   is<\/p>\n
established,    there   is  a  presumption until   the<\/p>\n
contrary is proved, that such person is in unlawful<\/p>\n
possession, custody or control of such captive<\/p>\n
animal,     animal  article,  meat  (trophy,   uncured<\/p>\n
trophy,     specified  plant or   part  or  derivative<\/p>\n
thereof).     Therefore,  unless  possession  of   the<\/p>\n
trophy     with  first   petitioner  is   established,<\/p>\n
presumption available under Section 57 of the Act<\/p>\n
cannot be invoked as against him.           Annexure-I<\/p>\n
charge sheet itself shows that first petitioner is<\/p>\n
not  attending     to  the  management  of the   hotel<\/p>\n
because     of  his   age  and  illness.     In   such<\/p>\n
circumstances, unless there is material to show<\/p>\n
that the seized trophy was kept in the building<\/p>\n
either by first petitioner or at least with his<\/p>\n
consent or knowledge, first petitioner cannot be<\/p>\n
prosecuted.     In the absence of any such allegation<\/p>\n
in the final report, prosecution as against the<\/p>\n
first petitioner, though he is the owner of the<\/p>\n
hotel, who has nothing to do with the running of<\/p>\n
CRMC 1789\/09               6<\/span><\/p>\n
the hotel at the relevant time, is only an abuse of<\/p>\n
process of the court and it can only be quashed.<\/p>\n
    7.     With  regard  to  second  petitioner,  the<\/p>\n
position    is   different.  The  materials  produced<\/p>\n
establish that second petitioner was running the<\/p>\n
hotel for the first petitioner at the relevant<\/p>\n
time.   In   such  circumstances,  second  petitioner<\/p>\n
cannot     express  ignorance  of  the  presence   of<\/p>\n
offending    trophy  seized  from  the  hotel.    The<\/p>\n
question whether second petitioner is liable for<\/p>\n
the possession or not cannot be decided at this<\/p>\n
stage, as it can be decided only after recording<\/p>\n
the   evidence.    Hence,  case  as  against   second<\/p>\n
petitioner cannot be quashed invoking the inherent<\/p>\n
powers under Section 482.    If charge is not framed,<\/p>\n
second petitioner is at liberty to seek an order of<\/p>\n
discharge under Section 239 of Code of Criminal<\/p>\n
Procedure.\n<\/p>\n
    The     petition  is   partly  allowed.   C.C.No.<\/p>\n
316\/2008 on the file of Chief Judicial Magistrate’s<\/p>\n
Court, Kalpetta as against first petitioner\/second<\/p>\n
CRMC 1789\/09             7<\/span><\/p>\n
accused is quashed.  The case as against the second<\/p>\n
petitioner is to be continued.\n<\/p>\n
