‘ This Writ Appeal is directed against the<\/p>\n
“*order dt.13.\u00e9.2009 passed by the Learned<\/p>\n
isingle Judge in Writ Petition No.6125\/2008.<\/p>\n
2. The Writ Petition was filed. by the<\/p>\n
appellant herein seeking a writ of mandamus<\/p>\n
3%\u00bb<\/p>\n
against the respondents to consider this<\/p>\n
representations and to condone the shortage of<\/p>\n
attendance and to permit him to ap\ufb01ear foruk<\/p>\n
the Practical examination “which_ were dto
\ncommence on 21” April onwards and also final
\nyear examination which were to commence from<\/p>\n
4th May 2008 <\/p>\n
3. fAfter.hser\u00a7ice_”o\u00a3\u00ab’notice on the<\/p>\n
res\ufb01ondents end after hearing both sides, the
\nLearned’ siegie,VJedge dismissed the Writ<\/p>\n
Petition ‘by; holding that the petitioner’s<\/p>\n
“rep;esentation” had been considered and an<\/p>\n
“_ereeg’7hea” been passed as per Annexure–R6<\/p>\n
H\u00a7\u00a3.11[4,\u00e9oo8, which had not been challenged in<\/p>\n
the 3Writ Petition. However, the Learned<\/p>\n
x =_Single Judge considered. Regulation~8 of the<\/p>\n
concerned Regulations and held that since the
\npetitioner did not satisfy minimum requirement<\/p>\n
of attendance which is 65% in each of the<\/p>\n
V’<\/p>\n
subjects he was not entitled to any relief in
\nthe said Writ Petition, accordingly Siamissed<\/p>\n
the Writ Petition.\n<\/p>\n
4. Being aggrieved by the said order; th<\/p>\n
petitioner has filedlllthis appeal\n<\/p>\n
5. We have heatd the learned counsel for<\/p>\n
the appellant and the i\u00e9ar\ufb01\u00e9g counsel for the<\/p>\n
respondent#Qniversit\u00a7 as \ufb01ell as the College.<\/p>\n
t.6.. It “is 7, contended on behalf of the<\/p>\n
appellant that on account of illness. The<\/p>\n
‘a\ufb01pellant did not have the minimum attendance<\/p>\n
” as h\u00a7.&ae suffering from Malaria and that an<\/p>\n
A.opportunity should have been given by the<\/p>\n
leatned Single Judge to take the examination<\/p>\n
x =_hy condoning the shortage of attendance or<\/p>\n
otherwise he would have lost an academic year.<\/p>\n
7. Per contra, it is submitted on behalf<\/p>\n
of ‘the respondent~University’ as well as the
\n.5:\n<\/p>\n

College, as per Annexure-R6. We \ufb01indf that<\/p>\n
despite coming to know of this lfact? “no *<\/p>\n
attempt was made by the appellant to make np<\/p>\n
the shortage of Vattendance. plUnderVg”thep<\/p>\n
circumstances, the Collede did not per\ufb01it the’<\/p>\n
appellant to take up the exa$ination’in April-
\nMay 2008. Regulation 8 reads as follows:<\/p>\n
“8. Attendance: l
\n8.1_ ____ _A candidate shall be considered to have
\nsatisfied }the_ reqnirement of attendance for
\nthe year if”he]she attends not less than 75%
\nof the member of classes actually held up to<\/p>\n
‘the end of the year in each of the subjects<\/p>\n

“_a\u00a7w\u00a7v\u00a21)\u00ab_ the shortage of attendance of<\/p>\n
“student dwhose attendance is 65% and above but<\/p>\n
below 75% may be condoned by the University on<\/p>\n

“athe University by following the rules<\/p>\n
prescribed for condonation.\n<\/p>\n
8.2 A candidate who does not satisfy the<\/p>\n
requirement of attendance even in one subject<\/p>\n
\u00e9f<\/p>\n

shall not be permitted to take the ryhcle<\/p>\n
University examination of that year7andfhe}sh\u00a7k<\/p>\n
shall not be allowed to Vpr’o’ceed}’  hnextuu<\/p>\n
year. Such a candidate shallubegreduired to<\/p>\n
repeat the course ixui a subsequent year anda<\/p>\n
fulfill the attendance requirements as statedl<\/p>\n
in para Bfl above;f<\/p>\n
Under Regulation .\u00a7~ -8; of \u00a7the concerned<\/p>\n
Regulation,1f the\u00ab aminimum ” requirement of<\/p>\n
attendance is_ 75%–5in”each{aoff the subjects.<\/p>\n
However, the ,shortage,’Qfa_attendance of any<\/p>\n
students, if it is by only 5%, namely, if it<\/p>\n
is upto 6\u00a7% can he condoned by the University<\/p>\n
on Hthe* recommendation of the Principal on<\/p>\n
Zfgpayment:\n<\/p>\n
xofhthe_re\u00e9uisite fee in terms of the<\/p>\n
lsaid Rulesg\ufb02 However, in the instant case, it<\/p>\n
;has came pn record that the appellant had only<\/p>\n
Arl\u00a7Q% attendance in certain subjects. Under the<\/p>\n
V”\u00bbcircumstances, there was no question of<\/p>\n
V’,condonation of the shortage of attendance<\/p>\n
contrary to the rules. Hence the University as<\/p>\n
