JUSTICE J.P.SINGH, JUDGE     \nDate : 30\/12\/2008\n: J U D G M E N T :\n<\/pre>\n<p>Mohammad Taj has filed this petition through his brother<br \/>\nMohammad Zaman seeking quashing of District Magistrate,<br \/>\nJammu&#8217;s order No. 16\/PSA of 2007 dated 21.11.2007 passed<br \/>\nunder Section 8 of the Jammu and Kashmir Public Safety Act,<br \/>\n1978 to prevent him from indulging in activities prejudicial to<br \/>\nthe security of State.\n<\/p>\n<p>His Counsel, Mr. Rajneesh Oswal submits that petitioner<br \/>\nwas on bail in FIR no. 62\/2007 registered under Sections 4\/5<br \/>\nESA and 7\/25 Arms Act at Police Station, Channi Himmat,<br \/>\nJammu, when without there being any material on records<br \/>\njustifying his detention under preventive custody, he was<br \/>\nerroneously ordered to be detained by District Magistrate,<br \/>\nJammu. He questions District Magistrate&#8217;s order on yet another<br \/>\nground that the detention order issued on 21.11.2007 was<br \/>\nexecuted only on 3rd March, 2008 which proved that there was<br \/>\nno proximate link between the grounds of detention and<br \/>\npurpose therefor.\n<\/p>\n<p><span class=\"hidden_text\">2<\/span><\/p>\n<p>Mr. V. K. Chopra, learned AAG, on the other hand,<br \/>\nsubmitted that in view of the nature of activities of the<br \/>\npetitioner, the District Magistrate was justified in directing his<br \/>\npreventive detention as the petitioner was likely to indulge in<br \/>\nactivities prejudicial to the Security of State. Learned counsel<br \/>\nsubmitted that delay in execution of the detention order would<br \/>\nnot affect legality of petitioner&#8217;s detention, in that, detention<br \/>\norder could be executed at any time, the detaining authority so<br \/>\ndesired.\n<\/p>\n<p>I have considered the submissions of learned counsel for<br \/>\nthe parties.\n<\/p>\n<p>Petitioner&#8217;s specific plea appearing in paragraph No.<br \/>\n7 (F) of his petition that delay of 101 days in executing the<br \/>\ndetention order, when the petitioner had not absconded, would<br \/>\nrender his detention illegal, has not at all been adverted to by<br \/>\nthe District Magistrate in the counter affidavit filed in answer to<br \/>\nthe petitioner&#8217;s petition. Records produced by learned State<br \/>\ncounsel too do not indicate as to why the detention order issued<br \/>\non 21.11.2007 had not been executed for more than three<br \/>\nmonths.\n<\/p>\n<p>Inaction of the respondents and that too without any<br \/>\nexplanation, as to why the detention order issued in November,<br \/>\n2007 had remained unexecuted till March 2008 demonstrates<br \/>\npassing of detention order in a routine manner. Had the<br \/>\ndetaining authority intended to prevent any such activity of the<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\npetitioner, which would have been prejudicial to the security of<br \/>\nState, there would not have been any remissness on behalf of<br \/>\nthe District Magistrate and the law enforcing agencies, in<br \/>\nexecuting the detention order, particularly when the petitioner is<br \/>\nnot stated by the State respondents to have been absconding.<br \/>\nApprehension gathered by the learned District<br \/>\nMagistrate, as it so appears in the grounds of detention, that the<br \/>\npetitioner, though on bail, would continue to work for terrorists<br \/>\nthus appears to be misconceived because had it been so, the<br \/>\ndetention warrant should have been executed without any loss<br \/>\nof time.\n<\/p>\n<p>In the absence of any explanation by the District<br \/>\nMagistrate and the law enforcing agencies as to why the<br \/>\ndetention order had not been executed for more than three<br \/>\nmonths, coupled with respondents&#8217; omission to take recourse to<br \/>\nthe provisions of Section 12 of the Public Safety Act which<br \/>\nprovides for invoking provisions of Sections 87, 88 and 89 of<br \/>\nthe Code of Criminal Procedure in case of absconding persons,<br \/>\nI am constrained to hold that the apprehension of learned<br \/>\nDistrict Magistrate that petitioner would indulge in activities<br \/>\nprejudicial to the security of State, was unfounded.<br \/>\nThat apart, the detention records do not contain any such<br \/>\nmaterial, on the basis whereof, it may be said that the petitioner,<br \/>\nwho was on bail, was likely to indulge in activities prejudicial<br \/>\nto the security of State.\n<\/p>\n<p><span class=\"hidden_text\">4<\/span><\/p>\n<p>State counsel&#8217;s submission that detention order once<br \/>\nissued could be executed at any time and that too at the<br \/>\ndiscretion of the State Agencies, is utterly misconceived, in<br \/>\nthat, for exercising jurisdiction under Section 8 of the Jammu<br \/>\nand Kashmir Public Safety Act, live and proximate link<br \/>\nbetween the grounds of detention and purpose therefor must<br \/>\nexist. Delay in execution of the detention warrant snaps this<br \/>\nlink thereby disabling the detaining authority to curtail one&#8217;s<br \/>\nliberty at a belated stage. Such a disability would not, however,<br \/>\napply in a case where the detenue had been responsible for<br \/>\navoiding execution of detention warrant. No such case of<br \/>\navoidance of execution of detention warrant, by the detenue,<br \/>\nhas, however, been projected by the State authorities. Mr.<br \/>\nChopra&#8217;s submission thus fails and is, accordingly, rejected.<br \/>\nNon-execution of detention order issued in respect of the<br \/>\npetitioner for over a period of three months without any<br \/>\nexplanation therefor renders petitioner&#8217;s detention unsustainable.<br \/>\nGrounds of detention on which petitioner has been<br \/>\ndetained, too do not indicate any such activity of the petitioner,<br \/>\nafter his release on bail by learned 2nd Additional Sessions<br \/>\nJudge, Jammu in FIR no. 62\/07 on 16.11.2007 on the basis<br \/>\nwhereof impugned detention order may be justified.<br \/>\nIn this view of the matter, petitioner&#8217;s detention in<br \/>\npreventive custody on grounds similar to those which had<br \/>\n<span class=\"hidden_text\">5<\/span><br \/>\nappeared in FIR no. 62\/2007, in which he had been released on<br \/>\nbail, cannot be justified.\n<\/p>\n<p>For all what has been said above, it is, therefore,<br \/>\nestablished that the learned District Magistrate had no material<br \/>\nbefore him, on the basis whereof, satisfaction in terms of<br \/>\nSection 8 of the Jammu and Kashmir Public Safety Act, 1978<br \/>\ncould be recorded that the petitioner was likely to indulge in<br \/>\nactivities prejudicial to the security of State. Order passed by<br \/>\nlearned District Magistrate thus lacks application of mind.<br \/>\nI am, therefore, of the opinion that the detention order<br \/>\nissued by District Magistrate, Jammu for the detention of<br \/>\npetitioner suffers from non-application of mind and is even<br \/>\notherwise unjustified for the reasons mentioned hereinabove.<br \/>\nAllowing this petition, District Magistrate, Jammu&#8217;s<br \/>\ndetention Order no. 16\/PSA of 2007 dated 21.11.2007 is<br \/>\naccordingly quashed. A direction shall accordingly issue to the<br \/>\nrespondents to set the petitioner to liberty, if not required in any<br \/>\nother case.\n<\/p>\n<p>Detention records to be returned to the learned State<br \/>\nCounsel.\n<\/p>\n<p>(J.
