PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nMR HARSHIT S TOLIA for Complainant\n \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/10\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npresent application has been filed by the applicant for grant of<br \/>\nregular bail under sec. 439 of the Code of Criminal Procedure.\n<\/p>\n<p>2.\tThe<br \/>\napplicants-accused are charged with having committed offences under<br \/>\nsections 143, 147, 148, 149, 323, 324, 326 of IPC and sec. 135 of<br \/>\nBombay Police Act for which FIR, being C.R. No. I-72\/2010 has been<br \/>\nregistered with Veraval Police Station.\n<\/p>\n<p>3.\tLearned Sr. Counsel<br \/>\nMr. Naik appearing for the applicants submitted that the applicants<br \/>\nare the original accused shown in the FIR as accused Nos. 4, 8 &amp;<br \/>\n9 and they are not attributed with any injury or hurt and therefore<br \/>\nthe present application may be allowed. He further submitted that<br \/>\nsec. 326 would not be attracted. He also submitted that the victim<br \/>\nwas taken to the government hospital and thereafter, as admittedly<br \/>\nstated in the impugned order, he has got himself admitted in the<br \/>\nprivate hospital and the injuries are not serious and therefore the<br \/>\npresent application may be allowed.\n<\/p>\n<p>4.\tLearned APP Ms. Nair<br \/>\nresisted the application. She however stated that the applicants are<br \/>\nnot attributed with any injury to anyone.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel Mr.Tolia objected, referring to the papers, and submitted<br \/>\nthat they are headstrong persons. He submitted that the injury<br \/>\ncertificate of the medical officer of the local hospital is required<br \/>\nto be considered that it cannot be said to be non-grievous injury<br \/>\nwhen admittedly there is an injury with a sharp cutting weapon as<br \/>\nrecorded. He submitted that there are antecedents and as many as 16<br \/>\ncases are registered against the entire gang and therefore the<br \/>\npresent application may not be entertained.\n<\/p>\n<p>6.\tIn<br \/>\nview of rival submissions, it is required to be considered whether<br \/>\nthe present application can be entertained or not.\n<\/p>\n<p>7.\tIt<br \/>\nis well accepted that the court is not required to appreciate or<br \/>\nscrutinize the evidence in detail. However, for considering the<br \/>\napplication for bail, factors like the nature\/gravity of offence, the<br \/>\nmanner in which it is alleged to have been committed, the role<br \/>\nattributed, weapon used etc. are relevant.   In the facts of the<br \/>\npresent case, the applicants are not attributed with any injury to<br \/>\nanyone and therefore without any further elaboration, the court is of<br \/>\nthe opinion that the present application deserves to be allowed.<br \/>\n However, considering the strong apprehension voiced by learned<br \/>\ncounsel Mr. Tolia for the complainant, with the antecedents, it would<br \/>\nbe appropriate to apply strict conditions.\n<\/p>\n<p>8.\tThe application is<br \/>\naccordingly allowed.  The applicants are ordered to be released on<br \/>\nbail in connection with C.R. No. I-72\/2010 registered with  Veraval<br \/>\nPolice Station,  on their executing a personal bond of Rs. 5,000\/-<br \/>\n(Rupees Five Thousand only) each with one solvent surety for the like<br \/>\namount to the satisfaction of the lower court and subject to the<br \/>\nfurther conditions that they shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark their presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the charge sheet is<br \/>\nfiled.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof their residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender their<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>(h)\tnot enter the areas<br \/>\nof Veraval Town for six months.\n<\/p>\n<p>9.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>10.\tBail before the<br \/>\nlower court having jurisdiction to try the case.
