SIRI JAGAN, J.\n                   ------------------------------\n                   W.P.(C) No.31410 OF 2010\n                   -------------------------------\n            Dated this the 13th day of October, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>      The petitioners are Public Health Nurse Gr.II in the Health<\/p>\n<p>Department of the Government of Kerala. Prior to joining regular<\/p>\n<p>service they had provisional service. Their grievance in this writ<\/p>\n<p>petition is that their provisional service has not been reckoned for<\/p>\n<p>the purpose of granting them increments. Seeking this relief,<\/p>\n<p>they have submitted Exts.P4 and P5 representations before the<\/p>\n<p>third respondent. They seek a direction to the third respondent<\/p>\n<p>to dispose of Exts.P4 and P5 representations expeditiously.<\/p>\n<p>      2.    I have heard the learned Government Pleader also.<\/p>\n<p>The learned Government Pleader points out that although the<\/p>\n<p>provisional service of the petitioners were prior to 1.10.1994, for<\/p>\n<p>getting their provisional service reckoned, they had to submit<\/p>\n<p>applications within the time limit prescribed by the Government,<\/p>\n<p>which the petitioners have not done. Therefore, they cannot now<\/p>\n<p>claim the benefits on the basis of provisional service, he<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.31410\/10              2<\/span><\/p>\n<p>contends.\n<\/p>\n<p>      2.    I have considered the rival contentions in detail.<\/p>\n<p>Whether, because of non-submission of application within the<\/p>\n<p>prescribed time, the petitioners are ineligible for the benefit<\/p>\n<p>sought by them, is also a matter, which the third respondent<\/p>\n<p>can consider while disposing of Exts.P4 and P5.<\/p>\n<p>      Accordingly, this writ petition is disposed of with a<\/p>\n<p>direction to the third respondent to consider and pass orders<\/p>\n<p>on Exts.P4 and P5, in accordance with law, as expeditiously as<\/p>\n<p>possible, at any rate, within three months from the date of<\/p>\n<p>receipt of a copy of this judgment.\n<\/p>\n<\/p>\n<p>                                   S.
