Raval for the applicant accused referred to<br \/>\n\tthe First Information Report and submitted that it is a case of an<br \/>\n\taffair and victim had voluntarily accompanied  and had moved from<br \/>\n\tplace to place. He further submitted that as charge sheet has been<br \/>\n\tfiled, present application may be allowed.\n<\/p>\n<p>Ms.Mini<br \/>\n\tNair, learned Additional Public Prosecutor resisted the application<br \/>\n\tand submitted that the date of birth of victim is 01.06.1995 and she<br \/>\n\twas aged about 14 years and 10 months. She, therefore, submitted<br \/>\n\tthat consent would not be relevant. Therefore, she submitted that<br \/>\n\tpresent application may not be entertained.\n<\/p>\n<p>In<br \/>\n\tview of rival submissions, it is required to be considered whether<br \/>\n\tthe present application can be entertained or not.\n<\/p>\n<p>It<br \/>\n\tis well accepted that this Court is not required to appreciate and<br \/>\n\tscrutinize evidence in detail at this stage. However, for<br \/>\n\tconsidering prima facie case,<br \/>\n\trelevant factors like nature of offence, manner in which it is<br \/>\n\talleged to have been committed, role attributed, age of victim,<br \/>\n\tmedical evidence etc. are required to be considered. Therefore,<br \/>\n\twithout any further elaboration, when consent would be decided with<br \/>\n\treference to the age of victim on the basis of evidence at the<br \/>\n\ttrial, in view of rival submissions and considering the papers,<br \/>\n\tpresent application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.13 of 2010 has<br \/>\n\tbeen registered with Mansa Police Station on his executing bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand) with one solvent surety of the<br \/>\n\tlike amount to the satisfaction of the lower Court and subject to<br \/>\n\tthe conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof English calender month between 11:00 AM to 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
