Justice R.BASANT\n\n Dated :14\/10\/2008\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                     Crl.M.C.No.3583 of 2008\n                    ----------------------------------------\n             Dated this the 14th day of October 2008\n\n                               O R D E R\n<\/pre>\n<p>      The petitioners are accused 1 and 2 in a prosecution for<\/p>\n<p>offences punishable inter alia under Sections 468 and 420 read<\/p>\n<p>with 34 I.P.C. The crux of the charge against the petitioners is<\/p>\n<p>that they, in furtherance of their common intention, fraudulently<\/p>\n<p>issued a cheque on a cheque leaf issued to the second accused<\/p>\n<p>by his Bank on an account which was closed long back. The first<\/p>\n<p>accused allegedly signed the same and thus induced the de facto<\/p>\n<p>complainant to part with an amount of Rs.5,00,000\/-. Crime was<\/p>\n<p>registered.    Investigation was conducted.                 Final report was<\/p>\n<p>submitted to the learned Magistrate and cognizance was taken<\/p>\n<p>by the learned Magistrate. The matter is pending before the<\/p>\n<p>learned Magistrate now.\n<\/p>\n<p>      2.   At this stage, the petitioners\/accused and the second<\/p>\n<p>respondent\/complainant have come before this court through<\/p>\n<p>their counsel to report to the court that they have settled all<\/p>\n<p>their outstanding disputes and the second respondent has<\/p>\n<p>compounded      the    offences        allegedly        committed   by   the<\/p>\n<p>petitioners.   The second respondent has appeared                    through<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3583\/08               2<\/span><\/p>\n<p>counsel. An affidavit duly attested by counsel has been filed by<\/p>\n<p>the second respondent. It is submitted at the Bar also that the<\/p>\n<p>parties have willingly and voluntarily settled their disputes and<\/p>\n<p>the second respondent has compounded the offences allegedly<\/p>\n<p>committed by the petitioners.\n<\/p>\n<p>      3.    I am satisfied from the totality of inputs available that<\/p>\n<p>the parties have willingly and voluntarily settled their disputes<\/p>\n<p>and the second respondent has compounded the offences<\/p>\n<p>allegedly committed by the petitioners. If legally possible and<\/p>\n<p>permissible, I am satisfied that the composition can be accepted<\/p>\n<p>and premature termination of the proceedings can be brought<\/p>\n<p>about. But the offence under Section 468 I.P.C is not legally<\/p>\n<p>compoundable under Section 320 Cr.P.C. The learned counsel<\/p>\n<p>for the contestants, in these circumstances, rightly rely on the<\/p>\n<p>decision in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> [2008<\/p>\n<p>AIR SCW 2287].\n<\/p>\n<p>      4.    Notice was given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor submits that the State has no<\/p>\n<p>objection against the quashing of proceedings.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3583\/08               3<\/span><\/p>\n<p>      5.    I am satisfied that the dispute is one which is purely<\/p>\n<p>personal and private between the parties and that no purpose<\/p>\n<p>will be served by unnecessary continuance of the proceedings.<\/p>\n<p>This, I am satisfied, is an eminently fit case where powers under<\/p>\n<p>Section 482 Cr.P.C as enabled by the dictum in Madan Mohan<\/p>\n<p>(Supra) can safely be invoked to bring to premature termination<\/p>\n<p>the prosecution against the petitioners.<\/p>\n<pre>\n\n      6.
