Justice V.GIRI\n\n Dated :11\/08\/2009\n\n O R D E R\n                            V.GIRI,J.\n                      -------------------------\n                 W.P ( C) No. 22745 of 2009\n                     --------------------------\n               Dated this the 11th August,2009\n\n                       J U D G M E N T\n<\/pre>\n<p>     The vehicle bearing Reg.No.KL-05-A 194 belonging<\/p>\n<p>to petitioner was allegedly seized for infraction of the<\/p>\n<p>provisions of the Kerala Protection of River Banks<\/p>\n<p>(Protection and Regulation of removal of sand) Act, 2002.<\/p>\n<p>He has approached the District Collector, the 1st<\/p>\n<p>respondent for release of the vehicle and is aggrieved by<\/p>\n<p>the non-consideration of his request as such.<\/p>\n<p>     2.   The nature of the power exercised by the<\/p>\n<p>District Collector and the para meters within which such<\/p>\n<p>power is to be exercised have been dealt with by a Bench<\/p>\n<p>of this Court in Sanjayan Vs.Tahasildar        [2007 (4) KLT<\/p>\n<p>597). Principles have been reiterated in Subramanian Vs.<\/p>\n<p>State of Kerala [2009 (1) KLT 77).\n<\/p>\n<p>     3.     In Subramanian&#8217;s case, this Court observed<\/p>\n<p>that the power exercised by the District Collector is under<\/p>\n<p>Section 23 of the Kerala Protection of River Banks<\/p>\n<p>(Protection and Regulation of removal of sand) Act, 2002.<\/p>\n<p>W.P ( C) No. 22745 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>It is also, therefore, quasi judicial in character. Reasons<\/p>\n<p>will have to be given by the District Collector       while<\/p>\n<p>passing orders under Section 23 of the Kerala Protection<\/p>\n<p>of River Banks (Protection and Regulation of removal of<\/p>\n<p>sand) Act, 2002 r\/w Rules 27 and 28 of Kerala Protection of<\/p>\n<p>River Banks and Regulation of Removal of Sand Rules<\/p>\n<p>2002. If there is a contention that the transportation of<\/p>\n<p>sand was supported by a pass issued by the competent<\/p>\n<p>local authority, that has to be referred.     The materials<\/p>\n<p>which are placed before      the District Collector  by the<\/p>\n<p>subordinate officials shall also be looked into.    This has<\/p>\n<p>been indicated in Subramanian&#8217;s case. If motion is made<\/p>\n<p>by the owner of the vehicle for release of the vehicle on<\/p>\n<p>interim custody, it will be subject to the conditions<\/p>\n<p>mentioned in paragraph 58 of the said judgment.         The<\/p>\n<p>District Collector may pass orders on such applications on<\/p>\n<p>interim custody. (The scope of the directions contained in<\/p>\n<p>Subramanian&#8217;s case have later been dealt with in Sareesh<\/p>\n<p>Vs. District Collector [2009(2) KLT 906].       Appropriate<\/p>\n<p>clarifications have been issued in the latter case). Further<\/p>\n<p>W.P ( C) No. 22745 of 2009<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>conditions can be imposed in the course of release of the<\/p>\n<p>vehicle      as indicated by this Court in Shoukathali Vs.<\/p>\n<p>Tahasildar [2009 (1) KLT 640].\n<\/p>\n<p>      4.     Keeping in mind the observations made in the<\/p>\n<p>judgments in Shoukathali&#8217;s case and Subramanian&#8217;s case<\/p>\n<p>and Sareesh&#8217;s case which have been referred to, the 1st<\/p>\n<p>respondent shall pass final orders in the matter of<\/p>\n<p>confiscation\/release of the vehicle in question after<\/p>\n<p>conducting an appropriate enquiry as early as possible, at<\/p>\n<p>any rate within three months from the date of receipt of a<\/p>\n<p>copy of this judgment.\n<\/p>\n<p>      5.     In the meanwhile, if motion   is made by the<\/p>\n<p>petitioner for interim custody of the vehicle bearing<\/p>\n<p>Reg.No.KL-05-A 194 then orders shall be passed by the<\/p>\n<p>District Collector on the application for interim custody of<\/p>\n<p>the vehicle, within four weeks from the date of receipt of a<\/p>\n<p>copy of this judgment in the light of the observations<\/p>\n<p>contained in Shoukathali Vs. Tahasildar [2009 (1) KLT 640,<\/p>\n<p>Subramanian Vs. State of Kerala [2009 (1) KLT 77) and<\/p>\n<p>Sareesh Vs. District Collector [2009(2) KLT 906].<\/p>\n<p>W.P ( C) No. 22745 of 2009<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>      6.     I make it clear that I have not considered the<\/p>\n<p>petitioner&#8217;s contentions on merits. It is up to the District<\/p>\n<p>Collector to consider whether the vehicle is to be released<\/p>\n<p>on interim custody or not.     It is also up to the District<\/p>\n<p>Collector to consider, in accordance with law, the question<\/p>\n<p>as to whether the vehicle belong to the petitioner has been<\/p>\n<p>used in a manner as to contravene the provisions of the Act<\/p>\n<p>and the Rules framed thereunder and as to whether the<\/p>\n<p>vehicle is liable for confiscation and pass final orders on<\/p>\n<p>that basis.\n<\/p>\n<p>      The writ petition is disposed of as above.
