Substitution allowed.\n<\/p>\n<p>     Though the dasti notice had been served on the L.R., he<br \/>\nrefused to accept as per the statement made in the affidavit<br \/>\nfiled in  support of  the dasti service. Accordingly we have<br \/>\nheard the counsel for the appellant.\n<\/p>\n<p>     The case  of the  respondent set  up in  the plaint was<br \/>\nthat originally\t the Properly belonged to the appellant Shri<br \/>\nPushpagiri Math.  Subsequently, the  property was granted in<br \/>\nfavour of one K. Narasingaiah, the great grand-father of the<br \/>\nplaintiff as  Bhatavarthi  Inam\t by  Sankaracharya  who\t was<br \/>\nPeetadhipathi  of   the\t math.\tHe  was\t in  possession\t and<br \/>\nenjoyment as  a grantee.  Subsequently, he acquired title by<br \/>\nprescription.  The  trial  Court  decreed  the\tsuit  in  OS<br \/>\nNo.66\/68 dated September 30, 1974. On appeal, the Additional<br \/>\nSubordinate Judge,  Narasaraopet in  his judgment and decree<br \/>\ndated December\t29, 1979 in A.S. No.218\/78 held that Ex. A-1<br \/>\nto  Ex.A-10   positively  show\tthat  the  suit\t land  is  a<br \/>\nBhatavarthi Inam land and was in possession of the ancestors<br \/>\nof the\trespondent-plaintiff since  1950 under\tEx.A-1.\t The<br \/>\nland, therefore,  is a Bhatavarthi Inam land as evidenced by<br \/>\nEx.A-1 to  A-10 granted\t originally  by\t Bhatavarthi  in  or<br \/>\naround the  year 1900  for rendering  service that was being<br \/>\nrendered by the plaintiff-math to the appellant. Math is the<br \/>\nreal owner  of the land granted as an inam to the respondent<br \/>\nplaintiff. It  was also\t found that  Ex.B-1 to B-14 and B-17<br \/>\nwould prove  conclusive evidence  that the  appellant is the<br \/>\nabsolute owner\tof the land and the respondent plaintiff and<br \/>\nhis ancestors  were permitted  to continue in possession and<br \/>\nenjoyment of  the land\tas inamdars for service rendered and<br \/>\nto the\trendered by  them to  the institution. The appellate<br \/>\nCourt accordingly  held that  the decree  for declaration of<br \/>\ntitle and  injunction cannot  be granted  against  the\treal<br \/>\nowner. In S.A. No. 191\/88, the High Court of A.P by judgment<br \/>\nand decree  dated March\t 8, 1983 reversed he judgment of the<br \/>\nappellate Court\t and confirmed that of the trail Court. Thus<br \/>\nthis appeal by special leave.\n<\/p>\n<p>     When it  is an  admitted case  that the land originally<br \/>\nbelonged to  the Math  and  when  the  appellate  Court\t has<br \/>\nrecorded the finding of fact on the basis of the documentary<br \/>\nevidence that the Math is the owner of the property and that<br \/>\nthe respondent\tadmittedly came\t in possession as an Inamdar<br \/>\nto  render   service  to  the  math,  he  cannot  claim\t any<br \/>\npossessory title  or title  in his own right. Under the A.P.<br \/>\nInam Abolition\tand Conversion into Ryotwari Act, Act 37\/56,<br \/>\nafter the  Act had  come into force, the pre-existing right,<br \/>\ntitle and  interest Stood  extinguished and  the new  rights<br \/>\nwere sought  to be  conferred  under  Section  3  read\twith<br \/>\nSection 7 thereof either in a sun motu enquiry under Section<br \/>\n3 or  on an  application under\tSection 7.  A new  grant  of<br \/>\nryotwari patta\tis to  be made by the Tehsildar by way of an<br \/>\norder after enquiry to the extent of entitlement as per law.<br \/>\nit would  be subject  to an appeal to the Revenue Divisional<br \/>\nofficer which  becomes final.  In  Peddinti  Venkata  Murail<br \/>\nRanganath Deslka  Iyengar &amp;  Ors v.  Govt of  A.P. &amp; Anr [JT<br \/>\n1996 (1)  SC 234  ], a Bench of two Judges of this Court (in<br \/>\nwhich one  of us K Ramaswamy J. was a member) had considered<br \/>\nthe scope  and operation  of the  Act. While considering the<br \/>\nconstitutional validity\t of Section 76 of the A.P Charitable<br \/>\nand Hindu  Religious Institution  and Endowments  Acts 1987,<br \/>\nthe Court held that a person or institution or the tenant in<br \/>\noccupation is  entitled to  ryotwari patta in respect of the<br \/>\nland. The  institution is  entitled to the extent of 2\/3 and<br \/>\nthe tenant  or person  is entitled  to ryotwari\t patta to an<br \/>\nextent of  1\/3 share.  The grant  of  ryotwari\tpatta  udder<br \/>\nSection 7  becomes conclusive overriding the effect given by<br \/>\nSection 15 over any other law. It would therefore be clear &#8211;<br \/>\nthat after  the Inam stood abolished the pre-existing rights<br \/>\nextinguished and  the obligation  to render service burdened<br \/>\nwith the  land was  relieved. The  holder of the land became<br \/>\nentitled to  free hold ryotwari patta. Thus the pre-existing<br \/>\nrights title and interest stood extinguished.\n<\/p>\n<p>     It would  thus be\tclear that by statutory operation of<br \/>\nthe provisions of the Act the pre-existing right or interest<br \/>\nheld by\t the inamdar  or the  institution stood extinguished<br \/>\nand conferment\tof ryotwari  patta under Section 7 read with<br \/>\nSection 3 becomes conclusive between the parties. Therefore.<br \/>\nthe jurisdiction  of the civil Court to declare title to the<br \/>\nInam land  by necessary\t implication, stood  excluded. Under<br \/>\nthose circumstances,  the respondent cannot cannot claim any<br \/>\nexclusive title\t to the\t property as  an owner and lay claim<br \/>\nfor declaration\t of title  on that basis. Unfortunately, the<br \/>\nHigh  Court  blisfully\tbecame\tignorant  to  the  statutory<br \/>\noperation of  law and  the legal evidence and the effect and<br \/>\nproceeded on  the premise  that the  grant has been lost and<br \/>\nthe  respondent\t  has  become\towner  of  the\tproperty  by<br \/>\nprescription. Though  the plea\tof  adverse  possession\t was<br \/>\nraised, no  issue has  been framed  the that  behalf nor any<br \/>\nfinding was  recorded by  the trial  Court or  the appellate<br \/>\nCourt .\t Under these  circumstances,   the  High  Court\t was<br \/>\nwholly wrong  in its  conclusion  that\tthe  respondent\t has<br \/>\nestablished his title to the property.\n<\/p>\n<p>     The appeal\t is accordingly allowed anti the suit of the<br \/>\nrespondent  stands   dismissed.\t But  in  the  circumstances<br \/>\nwithout costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Pushpagiri Math vs Kopparaju Veerabhadra Rao on 7 May, 1996 Equivalent citations: JT 1996 (5), 590 1996 SCALE (5)8 Author: K Ramaswamy Bench: Ramaswamy, K.
