He<br \/>\n\tsubmitted that mainly there are two groups of persons, who have been<br \/>\n\tperforming &#8216;Pooja&#8217; in the temple, which is a trust property,<br \/>\n\ttaking their respective turns as per practice which has prevailed<br \/>\n\tand has been followed since last many years.\n<\/p>\n<p>He<br \/>\n\talso submitted that certain disputes as regards the scheme and in<br \/>\n\tconnection with the matters related to Trust are pending before the<br \/>\n\tCharity Commissioner. He submitted that in connection with the right<br \/>\n\tto perform &#8216;Pooja, the complainant of present complaint, who<br \/>\n\tare accused in the complaint filed by the present applicants,<br \/>\n\tassaulted the present applicants and in defense, this is scuffle<br \/>\n\tbetween the persons of the two groups occurred in view of which, the<br \/>\n\tcross complaints came to be filed. He submitted that the present<br \/>\n\tapplicants are innocent. They have not committed alleged offence and<br \/>\n\tno specific allegations about their alleged role is mentioned in the<br \/>\n\tFIR. He also submitted that all the accused persons in connection<br \/>\n\twith the complaint filed by present complainants have been released<br \/>\n\ton bail.\n<\/p>\n<p>It<br \/>\n\tis also submitted that the complainant in the cross complaint are<br \/>\n\tfamily members. He also submitted that actually present applicants<br \/>\n\treceived injuries on account of assault by the 10 accused persons in<br \/>\n\tthe complaint filed by the present complainant and the said 10<br \/>\n\tpersons have been released on bail. He also submitted that out of<br \/>\n\tthe five accused in present complaint, accused No.1 and 2 have also<br \/>\n\tbeen released. Therefore, it is requested that the application for<br \/>\n\tpresent applicants for bail may be considered and granted.\n<\/p>\n<p>Mr.Dave<br \/>\n\talso submitted that the parties have mutually arrived at an<br \/>\n\tagreement not to enter into any scuffle and on ad-hoc basis i.e.<br \/>\n\tuntil the orders of the Charity Commissioner is passed, to follow<br \/>\n\tthe same practice and schedule of &#8216;Pooja&#8217; as was being done<br \/>\n\tuntil now and thereafter to abide by the order which may be passed<br \/>\n\tby the Charity Commissioner.\n<\/p>\n<p>Mr.Dabhi,<br \/>\n\tlearned APP has opposed the application and submitted that<br \/>\n\tapplicants were given stick blow in the result of which, the<br \/>\n\tcomplainant received injury. He, however, conceded that all persons<br \/>\n\twho are in jail are now discharged. He also could not dispute that<br \/>\n\tall the 10 accused-persons in the cross complaint have been released<br \/>\n\tand also accused No.1 and 2 in the present complaint are also<br \/>\n\treleased.\n<\/p>\n<p>Having<br \/>\n\tregard to the submissions made by learned counsel and considering<br \/>\n\tthe facts and circumstances and having regard to the<br \/>\n\tcompromise arrived at between the parties as well as the<br \/>\n\talleged role attributed to the present applicants, the nature of the<br \/>\n\tallegations, the nature of offence coupled with the fact that all 10<br \/>\n\taccused-persons in cross complaint and accused Nos.1 and 2 in<br \/>\n\tpresent case also have been released on bail and the<br \/>\n\tinjured persons are also discharged from the Hospital and taking<br \/>\n\tinto account the law laid down by Apex Court in case of <a href=\"\/doc\/1108032\/\">Siddharam<br \/>\n\tStalingappa Mhetre vs. State of Maharashtra and Ors.<\/a> reported<br \/>\n\tin [2011] 1 SCC 694, wherein<br \/>\n\tthe Apex Court reiterated the law laid down by the Constitutional<br \/>\n\tBench in the case of Shri<br \/>\n\tGurubaksh Singh Sibbia and Ors. reported<br \/>\n\tin [1980] 2 SCC 565, I<br \/>\n\tam persuaded to exercise my discretion in favour of the<br \/>\n\taccused-applicants and grant them anticipatory bail.\n<\/p>\n<p>\tIn<br \/>\n\tthis view of the matter, accused-applicants are ordered to be<br \/>\n\tenlarged on bail in the event of their arrest in connection with the<br \/>\n\toffence registered with Dungari Police Station vide C.R.No.I-34 of<br \/>\n\t2011. They shall be released on anticipatory bail on each one<br \/>\n\tfurnishing bond of Rs.10,000\/- (Rupees Ten Thousand Only) each with<br \/>\n\tone surety of like amount for each applicant, on following<br \/>\n\tconditions that they:\n<\/p>\n<p>\t[A]<br \/>\n\tshall cooperate with the investigation and make themselves available<br \/>\n\tfor interrogation whenever required;\n<\/p>\n<p>[B]<br \/>\n\tshall remain present at the concerned Police Station on 30th<br \/>\n\tJune, 2011 between 9:00 a.m. to 1:00 p.m.;\n<\/p>\n<p>[C]<br \/>\nshall not hamper the investigation in any manner nor shall directly<br \/>\nor indirectly make any inducement, threat or promise to any witness<br \/>\nso as to dissuade them from disclosing such facts to the Court or to<br \/>\nany Police Officer;\n<\/p>\n<p>[D]<br \/>\nshall at the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[E]<br \/>\nwill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nwithin a week;\n<\/p>\n<p>[F]<br \/>\nIt would be open to the Investigating Officer to file an application<br \/>\nfor remand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>9. It<br \/>\nwould be open for the Investigating Agency to apply to the competent<br \/>\nMagistrate, for police remand of the applicants. The applicants shall<br \/>\nremain present before the learned Magistrate on the first date of<br \/>\nhearing of such application and on all subsequent occasions, as may<br \/>\nbe directed by the learned Magistrate. This would be sufficient to<br \/>\ntreat the accused in the judicial custody for the purpose of<br \/>\nentertaining application of the prosecution for police remand. This<br \/>\nis, however, without prejudice to the right of the accused to seek<br \/>\nstay against an order of remand, if ultimately granted, and the power<br \/>\nof the learned Magistrate to consider such a request in accordance<br \/>\nwith law. It is clarified that the applicant, even if remanded to the<br \/>\npolice custody upon completion of such period of police remand, shall<br \/>\nbe set free immediately, subject to other conditions of this<br \/>\nanticipatory bail order.\n<\/p>\n<p>10.With<br \/>\nthese directions, application is allowed.
