NO. 16224 OF 2010\n                     --------------------------------------------\n\n                    Dated this the 27th day of May, 2010\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The petitioner is the Manager of Sree Sethuparvathy Bhai<\/p>\n<p>High School, Kadakkavoor. The petitioner submitted an application to the<\/p>\n<p>third respondent seeking permission for the re-construction of the<\/p>\n<p>classrooms and sanction was accorded. The petitioner approached the first<\/p>\n<p>respondent for getting the fitness certificate as contemplated under the<\/p>\n<p>Kerala Education Rules. The grievance of the petitioner is that despite the<\/p>\n<p>receipt of the application for the aforesaid purpose, no action has so far<\/p>\n<p>been taken by the first respondent to conduct inspection and to issue the<\/p>\n<p>requisite certificate.\n<\/p>\n<\/p>\n<p>      2.     Ext.P3 would reveal that the constructions have been effected<\/p>\n<p>after obtaining necessary approval from the third respondent as<\/p>\n<p>contemplated under Rule 3(b)(ii) of Chapter V of the Kerala Education<\/p>\n<p>Rules . The learned counsel for the petitioner submits that in respect of 10<\/p>\n<p>classrooms fitness certificates have already been granted by the first<\/p>\n<p><span class=\"hidden_text\">W.P.(C) NO.16224\/2010                 2<\/span><\/p>\n<p>respondent.    The application in question presented before the first<\/p>\n<p>respondent pertains to the issuance of fitness certificate with respect to the<\/p>\n<p>newly constructed 15 classrooms.       The said applications are pending<\/p>\n<p>before the first respondent. Therefore, the first respondent is directed to<\/p>\n<p>expedite the steps for the purpose of issuing necessary fitness certificates<\/p>\n<p>after conducting appropriate inspection as contemplated under Rule 3(b)<\/p>\n<p>(ii) Chapter V of the Kerala Education Rules. At any rate, the whole<\/p>\n<p>exercise in terms of the aforesaid provision shall be done by the first<\/p>\n<p>respondent within a period of six weeks from the date of receipt of a copy<\/p>\n<p>of this judgment.\n<\/p>\n<\/p>\n<p>      This Writ Petition is, accordingly, disposed of.<\/p>\n<p>                                 (C.T.
