Though Rule<br \/>\n\tis served to respondent no. 2, no appearance is filed by him.  On<br \/>\n\tbehalf of respondent no. 3, one Mr. Pathik Bharat Patel for JMSL,<br \/>\n\tWeb Solutions Ltd has filed affidavit, which is at page 36.  The<br \/>\n\taverment made by respondent no. 3 in para 2 and 3 are quoted as<br \/>\n\tunder:\n<\/p>\n<p>\t 2.\tI further<br \/>\n\tsay that the letter, dated 12\/10\/2009 was written by me as an agent<br \/>\n\tof the respondent No. 3, to the petitioner.  I say that when I had a<br \/>\n\ttalk with Mr. Prasad, an officer of the respondent no. 1, he had<br \/>\n\ttold me telephonically on 09\/10\/2009 that the claim has been<br \/>\n\tsanctioned.  I further say that the TPA i.e. the respondent no. 2<br \/>\n\twas merely waiting for the float from the respondent no. 1.<br \/>\n\tTherefore, as the petitioner and her spouse were frequently asking<br \/>\n\tme as to the fate of the claim, I wrote the letter at Annexure &#8216;B&#8217;<br \/>\n\tto the petition.  I reiterate that the contents thereof are true and<br \/>\n\tcorrect.\n<\/p>\n<p>\t3.\tI further say<br \/>\n\tthat I was subsequently told that the file relating to the claim is<br \/>\n\tunder process.  As the claim relates to a cataract operation, which<br \/>\n\twas performed on 25\/07\/2009, it is difficult to comprehend as to the<br \/>\n\tmodalities of processing and the inordinate delay therein.  The non<br \/>\n\tpassing of a number of such claims has caused wide spread<br \/>\n\tdissatisfaction amongst my clientele. I, therefore, wrote a letter<br \/>\n\ton 07\/04\/2010 (copy at Ann.  R-1 ), to the respondent no. 3 and<br \/>\n\talso gave a copy to the petitioner.  The said letter has been<br \/>\n\twritten, after I was served with the notice, issued by this Hon&#8217;ble<br \/>\n\tCourt.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid averment made by respondent no. 3, it is clear<br \/>\n\tthat claim file of petitioner is under process, which relates to<br \/>\n\tcataract operation, which was performed on 25\/7\/2009.  The letter<br \/>\n\tannexed to affidavit dated 7\/4\/2010 addressed to Manager, JMSL Web<br \/>\n\tSolution Pvt. Ltd page 39 annexure R1.  Copy of this letter is sent<br \/>\n\tto Mrs. Kusumben J. Trivedi. The averment made in aforesaid letter,<br \/>\n\tpage 39 dated 7\/4\/2010 of respondent no. 3 is quoted as under:\n<\/p>\n<p> Reg:\n<\/p>\n<p>\tClaim under policy no:  \t021600\/48\/09\/41\/00000589<\/p>\n<p>Certificate<br \/>\n\tno: JSW\/U\/M\/0000000672, Claim no: UN 32218<\/p>\n<p>Please<br \/>\n\trefer to the claim as detailed above for Smt. Kusumben J. Trivedi<br \/>\n\tlodged to you on 27\/07\/2009 and subsequent submission of all<br \/>\n\trequired claim papers to your TPA   Alankit Healthcare TPA<br \/>\n\tLimited.\n<\/p>\n<p>I<br \/>\n\tam sorry to say that till date no any kind of fruitful solution has<br \/>\n\tcome out pertaining to the particular claim in spite of my<br \/>\n\tcontinuous follow up with the authorities concerned.\n<\/p>\n<p>Now<br \/>\n\tthe matter has been so serious that my client Smt. Kusumben J.<br \/>\n\tTrivedi has referred the matter to court of law (Honourable Justice,<br \/>\n\tHigh Court of Gujarat at Ahmedabad) for natural justice in the<br \/>\n\tmatter vide special civil application no: 1694 of 2010 &amp; have<br \/>\n\tserved a notice to United India Insurance Co. Ltd., Alankit<br \/>\n\tHealthcare TPA Pvt. Ltd and to me also.\n<\/p>\n<p>I<br \/>\n\tam sending herewith a copy of summon which indicates my presence to<br \/>\n\tthe court being a opponent party no. 3 as per notice of the<br \/>\n\tHonourable Court.\n<\/p>\n<p>Please<br \/>\n\tnote that I am a salesman of your designed product in market and no<br \/>\n\twhere attached, authorized or responsible to dispose off the claim<br \/>\n\tredressal.  The claim formalities\/decisions to be made good either<br \/>\n\tby your TPA\/insurance company or by you in this kind of special<br \/>\n\tcase.\n<\/p>\n<p>Therefore<br \/>\n\tI request you to intervene seriously in the matter as early as<br \/>\n\tpossible to resolve the high attitude grievance of the loyal client<br \/>\n\tas it is now on serious stage.\n<\/p>\n<p>Hence,<br \/>\n\tthis is sufficient to move further in the matter.  Ignorance of this<br \/>\n\trequest may be sufficient for some indecent steps against your<br \/>\n\torganization if I will be considered liable for the same in any<br \/>\n\tmanner either monitory\/morally or emotionally.\n<\/p>\n<p>From<br \/>\n\tperusing aforesaid record, it has been found that till date<br \/>\n\tMedi-claim application made by petitioner is still not decided by<br \/>\n\trespondent no. 1.  Therefore, it is directed to respondent no. 1 and<br \/>\n\t2 to decide Medi-claim application made by petitioner in respect to<br \/>\n\tcataract operation, which was performed on 25\/7\/2009, on or before<br \/>\n\t30\/11\/2010 if so far not decided by respondent no. 1 and 2.\n<\/p>\n<p>It<br \/>\n\tis further directed to respondent no. 1 and 2 to place on record<br \/>\n\tdecision on next date of hearing i.e. on 30\/11\/2010. Therefore,<br \/>\n\tmatter is adjourned to 30\/11\/2010.
