ORAL JUDGEMENT<\/p>\n
     Petitioner Amarsinh Chatursinh Chauhan , by way
\n     of this petition under Article 226 of the Constitution of
\n     India, has challenged the order of his detention dated
\n     2-3-96 passed by the Commissioner of Police, Ahmedabad
\n city , under section 3 (l) of the Gujarat   Prevention   of
\nAnti Social Activities Act, 1985.\n<\/p>\n
In the grounds of detention supplied to the
\ndetenu, the detaining authority has placed reliance on
\nthree pending investigation cases registered under the
\nprovisions   of   the Bombay Prohibition Act and the
\nstatements of four witnesses of the alleged incidents of
\n1-2-96 and 15-2-96 wherein the witnesses were beaten
\nbecause they refused to store illicit liquor in their
\nresidential premises and also on the ground that they are
\nthe informants of the police and that when the people
\ngathered, the detenu rushed towards the crowd with an
\nopen knife with the result that an atmosphere of fear and
\nterror was   created in the area.       Considering this
\nmaterial, the detaining authority recorded a finding that
\nthe the detenu is a “bootlegger” within the meaning of
\nsection 2 (b) of the said Act and with a view to
\npreventing the detenu from acting       in   any   manner
\nprejudicial to the maintenance of public order, it was
\nnecessary to pass the order of detention against him and,
\ntherefore, the impugned order is passed, which is under
\nchallenge in the present petition.\n<\/p>\n
Ms Kachhavah, learned Advocate appearing for the
\ndetenu, has raised number of contentions. However, it is
\nnot necessary to deal with each of them as the present
\npetition can be disposed off on the first contention
\nitself.   Ms Kachhavah has submitted that the subjective
\nsatisfaction arrived at by the detaining authority that
\nthe detenu is a bootlegger is not genuine as the alleged
\nactivities of the detenu as a bootlegger do not affect
\nadversely or are not likely to affect adversely the
\nmaintenance of public order. In the submission of Ms
\nKachhavah, the offences alleged against the detenu in the
\ngrounds of detention and also the allegations made by the
\nwitnesses could not be said to have created any feeling
\nof insecurity or panic or terror among the members of the
\npublic of the area in question giving rise to the
\nquestion of maintenance of public order. In support of
\nher submission, reliance is placed by Ms Kachhavah on the
\ndecision of the Supreme Court in the case of Piyush
\nKantilal Mehta vs Commissioner of Police, Ahmedabad city
\nAIR 1989 SC 491.\n<\/p>\n
The Supreme Court in Piyush Kantilal Mehta’s case
\n( supra) has held that it may be that the detenu is a
\nbootlegger within the meaning of S.,2 (b) of the Act, but
\nmerely because he is a bootlegger, he         cannot   be
\npreventively detained under the provisions of the Act
\nunless, as laid down in sub-section (4) of S.3 of the
\n Act, his activities as a bootlegger affect adversely or
\nare likely to affect adversely the maintenance of public
\norder.   A person may be very fierce by nature, but so
\nlong as the public generally are not affected by his
\nactivities or conduct, the question of maintenance of
\npublic order will not arise. In the present case the
\nthree prohibition cases registered against the detenu are
\npending at the investigation stage.       Considering the
\nstatements of the witnesses, I am of the view that they
\nare vague and general and no reliance can be placed on
\nthe same. In that view of the matter, I am of the view
\nthat the subjective satisfaction arrived at by the
\ndetaining authority is not genuine and, therefore, the
\ncontinued detention of the detenu is vitiated.\n<\/p>\n
Mr.U.R.Bhatt,    learned   Assistant   Government
\nPleader, appearing    for   the   respondents,    however,
\nsubmitted that the fact that these cases have been
\nregistered coupled with the fact       that    there   are
\nstatements of the witnesses in support thereof that the
\ndetenu is engaged in manufacturing illicit liquor is
\nsufficient to hold that there is likelihood of breach of
\npublic order. In the submission of Mr.Bhatt, with a view
\nto preventing this manufacturing activity of illicit
\nliquor, the detaining authority thought it necessary to
\ndetain the detenu.   In view of the decision of the
\nSupreme Court in Piyush Kantilal’s case ( supra) , it is
\nnot possible for this Court to accept the submission of
\nMr. Bhatt. Assuming that the allegation of the activity
\nof manufacturing illicit liquor by the detenu is true,
\nthe same can , by no stretch of imagination, be construed
\nas causing breach of public order and, therefore, it
\ncannot be said that the subjective satisfaction arrived
\nat by the detaining authority for the purpose of passing
\nthe order of detention was genuine.         Therefore, the
\ncontinuous detention of the detenu is vitiated.\n<\/p>\n
In the result, this petition is allowed. The
\nimpugned order of detention dated 2-3-96 is quashed and
\nset aside.    The detenu Amarsinh Chatursinh Chauhan is
\ndirected to be set at liberty forthwith if his detention
\nis not required for any other purpose. Rule is made
\nabsolute accordingly with no order as to costs.\n<\/p>\n
