Justice J.M.JAMES\n\n Dated :11\/01\/2007\n\n O R D E R\n                           J.M.JAMES, J.\n\n                             -------------------\n\n                         W.P.(C). 8072\/2006\n\n                            --------------------\n\n            Dated this  the 11th day of January, 2007\n\n\n                             JUDGMENT\n<\/pre>\n<p>             The writ petitioners are   defaulters  to the  first<\/p>\n<p>respondent,   Urban   Co-operative   Bank.     They   had   been<\/p>\n<p>proceeded  against,    as  an  amount  of  Rs.8,80,033\/-   is  due<\/p>\n<p>as on  24.5.2006,   the date  of filing  of the  counter  by the<\/p>\n<p>first respondent.\n<\/p>\n<\/p>\n<p>      2.     This writ petition was filed on 16.3.2006.  After<\/p>\n<p>ordering   notice,     an     interim   stay   for   three   months   was<\/p>\n<p>granted,     on   condition   of   the   petitioner   remitting   an<\/p>\n<p>amount   of   Rs.1,50,000\/-   on   or   before   20.3.2006   and   also<\/p>\n<p>directed  to make further remittance of Rs.1,00,000\/- each,<\/p>\n<p>on 30.4.2006 and on 30.5.2006.\n<\/p>\n<\/p>\n<p>      3.     The   learned   counsel   for   the   first   respondent<\/p>\n<p>submits   that   no   amount   had   so   far   been   paid.     Through<\/p>\n<p>counter,     the   counsel   also   brought   to   my   notice   that   the<\/p>\n<p>writ   petitioners   had     preferred   different   writ   petitions   in<\/p>\n<p>the   earlier   occasions   and   after   obtaining   the   interim<\/p>\n<p>W.P.(C).8072\/2006<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>orders,   the same had not been complied with whenever<\/p>\n<p>the first respondent opposed the continuance of the stay<\/p>\n<p>granted.\n<\/p>\n<\/p>\n<p>       4.     When   this   writ   petition   came   up   for<\/p>\n<p>consideration,     the   learned   counsel   for   the   petitioners<\/p>\n<p>submits that the petition is not pressed.   It was   on that<\/p>\n<p>occasion,  the counsel for the first respondent brought to<\/p>\n<p>my   notice   that   the   petitioner   had   preferred   W.P.(C).<\/p>\n<p>No.29587\/2004.     An   interim   stay   was   granted   on<\/p>\n<p>8.10.2004,     with  a direction  to remit Rs.75,000\/-.     But<\/p>\n<p>the   same   had   not   been   remitted   so   far,   submits   the<\/p>\n<p>counsel.        Similarly   another   writ   petition,   W.P.(C).<\/p>\n<p>29931\/2005,  was filed after suppressing the filing of the<\/p>\n<p>earlier   writ   petition.     In   that   petition   also,     an   interim<\/p>\n<p>stay was   granted on 25.10.2005.   But the same had not<\/p>\n<p>been   complied   with.     Therefore,     after   hearing   all<\/p>\n<p>concerned,     the   learned   single   Judge   of   this   Court   had<\/p>\n<p>dismissed the said writ petition on 4.1.2006.  The counsel<\/p>\n<p>submits that though an  interim order had been obtained<\/p>\n<p>in  this  writ  petition  as  well,  no amount had so far  been<\/p>\n<p>W.P.(C).8072\/2006<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>paid.     The   counsel   for   the   first   respondent,     therefore,<\/p>\n<p>submits   that     a   direction   may   be   issued   to   the     writ<\/p>\n<p>petitioners   to   pay   back   the   entire   amount     due   from<\/p>\n<p>them,  as the One Time Settlement allowed  was also not<\/p>\n<p>availed off by them.\n<\/p>\n<\/p>\n<p>        5.    In the above facts situation,  I find  there is no<\/p>\n<p>point   that   arises   for   consideration,   in   this   writ   petition.<\/p>\n<p>The   writ   petitioners   are   directed   to   approach   the   first<\/p>\n<p>respondent, bank,  and either pay the amount due to the<\/p>\n<p>first   respondent   or     settle   the   matter   as   per   the   law,<\/p>\n<p>without   unnecessarily   preferring   the   writ   petitions<\/p>\n<p>repeatedly.
