Justice P.N.RAVINDRAN\n\n Dated :20\/07\/2009\n\n O R D E R\n                       P.N.RAVINDRAN, J.\n                  ---------------------------------------------\n                   W.P.(C)No.18693 of 2009\n                  ---------------------------------------------\n                       Dated 20th July, 2009\n\n                              JUDGMENT\n<\/pre>\n<p>             Heard Sri.Kaleeswaram Raj, the learned counsel<\/p>\n<p>appearing for the petitioner and Sri.P.Nandakumar, the learned<\/p>\n<p>Government Pleader appearing for the respondents.<\/p>\n<p>           2. The petitioner, a              Forester was placed under<\/p>\n<p>suspension by Ext.P1 order dated 14.2.2008 passed by the Chief<\/p>\n<p>Conservator of Forests (Administration) on the ground that a<\/p>\n<p>criminal case was registered against him and that he was also<\/p>\n<p>arrested in connection with the said case. The petitioner submits<\/p>\n<p>that seeking revocation of the order of suspension he has<\/p>\n<p>submitted Exts.P2 and P3 representations before the Chief<\/p>\n<p>Conservator of Forests (Administration). In this writ petition the<\/p>\n<p>petitioner seeks a writ in the nature of mandamus commanding<\/p>\n<p>the respondents to reinstate him in service. In the alternative,<\/p>\n<p>he seeks a direction to the Government to consider Exts.P2 and<\/p>\n<p>P3 representations and pass orders thereon within a time limit to<\/p>\n<p>be fixed by this Court.\n<\/p>\n<p>           3. The learned Government Pleader appearing for the<\/p>\n<p>official respondents      submits        that      the      Police have after<\/p>\n<p><span class=\"hidden_text\">WP(C).No.18693\/2009               2<\/span><\/p>\n<p>investigation filed final report and that the case registered<\/p>\n<p>against the petitioner is presently pending as C.C.No.854 of 2008<\/p>\n<p>in the Court of the Judicial First Class Magistrate II, Cherthala.<\/p>\n<p>The learned Government Pleader also submits that the second<\/p>\n<p>respondent is considering Exts.P2 and P3 representations and<\/p>\n<p>that a decision thereon will be taken expeditiously.<\/p>\n<p>           4. Having regard to the fact that the respondents<\/p>\n<p>themselves are considering the question whether the petitioner<\/p>\n<p>should be reinstated in service pending disposal of the criminal<\/p>\n<p>case registered against him, I dot not deem it proper to interfere<\/p>\n<p>with the order of suspension at this stage.
