Government Pleader \n\nAppeal against the order dated 15.3.2002 of the learned single Judge  in  W.P.\nNo.13196 of 2002. \n\n:J U D G M E N T \n<\/pre>\n<p>(The Judgment of the Court was delivered by The Honourable The Chief Justice)<\/p>\n<p>        This  Writ  Appeal is directed against the order of the learned single<br \/>\nJudge and arises  out  of  the  Tamil  Nadu  Hindu  Religious  and  Charitable<br \/>\nEndowments Act,  1959,  hereinafter  referred  to as the Act.  The cause arose<br \/>\nbecause of the appointment of a fit person under the Act.  The power has  been<br \/>\nexercised by the Commissioner.\n<\/p>\n<p>        2.      Mr.  W.C.    Thiruvengadam, learned counsel for the appellant,<br \/>\nvery vehemently contended that the order  of  appointment  of  fit  person  is<br \/>\ndevoid of  jurisdiction.  His further contention is that there was a decree in<br \/>\ncivil action way back in the year 1940 and also Section 27 of the Act does not<br \/>\ntake in the mattah and as the Trust is a private trust and not a  public  one,<br \/>\nthe Act itself is inapplicable.\n<\/p>\n<p>        3.      On  the other hand, the learned Special Government Pleader for<br \/>\nEndowment submits that the Endowment in question is governed by the Act,  that<br \/>\nit  is  a  subsidiary  unit  to  the  main Palani Temple at Palani of Dindigul<br \/>\nDistrict, that the order of appointment of fit person was passed on  17.6.1999<br \/>\nand  by  letter  dated  7.7.1999, the appellant herein was called upon to hand<br \/>\nover the charge.  But because of the stay order  in  the  writ  petition,  the<br \/>\ncharge could  not be taken.  The learned Special Government Pleader brought to<br \/>\nour notice that the appellant is selling away the property and  in  fact,  has<br \/>\nexecuted several sale deeds to several persons conveying the properties.\n<\/p>\n<p>4.      The matter came up even before and we had directed the learned counsel<br \/>\nfor  the  appellant  to  produce  the  copy of the sale deeds and they are now<br \/>\nbefore us.  We have perused the recitals of the sale deeds, from which  it  is<br \/>\nobvious  that  the  ownership rights have been conveyed so also the possessory<br \/>\nrights.  We are at a loss to find as to what is the locus of the appellant  to<br \/>\nlaunch  this proceedings when he himself is not the owner and possessor of the<br \/>\ntrust property in question.  The further questions as to whether the trust  is<br \/>\nprivate  or  not or as to whether it is governed by the Act or not, are purely<br \/>\nfactual in nature and to decide them, fact finding is necessary and for  that,<br \/>\nadduction of  evidence, both oral and documentary, is necessary.  That process<br \/>\ncan be undergone only either by Civil Court or the statutory  authority.    In<br \/>\nfact,  a  specific  provision is made under Section 63 of the Act to meet such<br \/>\ncontingencies.  It is up to the proper person, who is claiming the property in<br \/>\nquestion, to approach the Joint Commissioner for getting redressal by way of a<br \/>\ndeclaration that it is not a public trust governed by the Act and that it is a<br \/>\nprivate trust.  Until such declaration is obtained, the fit person has got  to<br \/>\nmanage  the property in question as it is always in the interest of the public<br \/>\nthat the property is kept intact without allowing it to undergo  any  changes.<br \/>\nIn  this  view  of  the matter, we concur with the order passed by the learned<br \/>\nsingle Judge  and  consequently,  dismiss  this  Writ  Appeal.
