No.22658 of 2011\n                             Chunnu Kumar Singh son of Sidhnath Singh\n                                                Versus\n                                        The State Of Bihar\n                                              -----------\n<\/pre>\n<p>2.   27.7.2011              Heard learned Counsel for the petitioner<\/p>\n<p>                 and the State.\n<\/p>\n<p>                           The petitioner seeks bail in a case instituted<\/p>\n<p>                 for the offence under Section 392 of the Indian Penal<\/p>\n<p>                 Code.\n<\/p>\n<p>                           It has been submitted that the petitioner is<\/p>\n<p>                 not named in the First Information Report and<\/p>\n<p>                 subsequently when he was arrested in another case<\/p>\n<p>                 and brought to the Police Station the informant<\/p>\n<p>                 appeared there and identified the petitioner as one of<\/p>\n<p>                 the miscreants. The further submission is that this kind<\/p>\n<p>                 of identification has no meaning since it is not in<\/p>\n<p>                 accordance with law.\n<\/p>\n<p>                         Considering the same as also that no looted<\/p>\n<p>                 article has been recovered from his possession and<\/p>\n<p>                 now the petitioner&#8217;s mother is ready to stand surety for<\/p>\n<p>                 him, let the petitioner above named, be released on bail<\/p>\n<p>                 on furnishing bail bond of Rs. 5,000\/-(Five thousand)<\/p>\n<p>                 with two sureties of the like amount each or any other<\/p>\n<p>                 surety to be fixed by the court concerned to the<\/p>\n<p>                 satisfaction of learned Chief Judicial Magistrate, Buxar<\/p>\n<p>                 in connection with Dumraon (Naya Bhojpur O.P.) P.S.<br \/>\n<span class=\"hidden_text\">                         -2-<\/span><\/p>\n<p>Case No.209 of 2010, subject to the conditions (i) That<\/p>\n<p>one of the bailor shall be the mother of the petitioner<\/p>\n<p>and the other bailor shall be local since the petitioner<\/p>\n<p>belongs to District Bhojpur. The bailor will undertake to<\/p>\n<p>furnish information to the Court about any change in<\/p>\n<p>address of the petitioner. (ii) That the bailor shall also<\/p>\n<p>state on affidavit that he will inform the court concerned<\/p>\n<p>if the petitioner is implicated in any other case of similar<\/p>\n<p>nature after his release in the present case and<\/p>\n<p>thereafter the court below will be at liberty to initiate the<\/p>\n<p>proceeding for cancellation of bail on ground of misuse,<\/p>\n<p>(iii) That the petitioner will give an undertaking that he<\/p>\n<p>will receive the police papers on the given date and be<\/p>\n<p>present on date fixed for charge and if he fails to do so<\/p>\n<p>on two given dates and delays the trial in any manner,<\/p>\n<p>his bail will be liable to be cancelled for reasons of<\/p>\n<p>misuse, (iv) That the petitioner will be well represented<\/p>\n<p>on each date if he fails to do so on two consecutive<\/p>\n<p>dates, his bail will be liable to be cancelled.<\/p>\n<p>           In view of the nature of allegations against<\/p>\n<p>the petitioner, the petitioner is directed to appear before<\/p>\n<p>the Superintendent of Police, Buxar within fifteen days<\/p>\n<p>of his release with a copy of this order and every two<\/p>\n<p>weeks thereafter for the next nine months. The conduct<\/p>\n<p>of the petitioner will be kept under watch in this period<br \/>\n<span class=\"hidden_text\">                                    -3-<\/span><\/p>\n<p>            by the superintendent of Police concerned and if it is<\/p>\n<p>            found wanting in any respect, a report shall be made to<\/p>\n<p>            the court concerned by him to initiate a proceeding for<\/p>\n<p>            cancellation of bail for reasons of misuse of bail.
