Secretary, Morsandi Gram Panchayat, Morsandi, Anchal Motipur, District\n                 Muzaffarpur.\n                                                    -----------\n<\/pre>\n<p>2   28.09.2010                     Having heard counsel for the petitioner and counsel<\/p>\n<p>                       for the State as with regard to the following relief:-<\/p>\n<blockquote><p>                                               &#8220;That this is an application by the<br \/>\n                                   abovenamed petitioner for issuance of an<br \/>\n                                   appropriate writ\/ order\/ direction to consider<br \/>\n                                   selecting and employing the petitioner as Panchayat<br \/>\n                                   Shiksha Mitra in Primary school of Morsandi Gram<br \/>\n                                   Panchayat from the panel in view of vacancies<br \/>\n                                   caused as ordered on 3.1.2007 by the District<br \/>\n                                   Magistrate under clause 14 of amended Panchayat<br \/>\n                                   Shiksha Mitra (Terms and conditions). Rule and<br \/>\n                                   employ him as such in accordance with law.&#8221;<\/p><\/blockquote>\n<p>                                   and that the earlier writ application of the petitioner,<\/p>\n<p>                       C.W.J.C. No.3971 of 2006 as with regard to his appointment had<\/p>\n<p>                       been specifically dismissed, this Court would not find it possible<\/p>\n<p>                       to issue now a direction for his appointment on the post of Siksha<\/p>\n<p>                       Mitra specially when such post stands already abolished w.e.f.<\/p>\n<p>                       1.7.2006.\n<\/p>\n<p>                                   As a matter of fact, the impugned order which has<\/p>\n<p>                       been passed for cancelling appointment of three other persons,<\/p>\n<p>                       namely, choudhary Charan Singh, Devendra Rai and Anita Rai by<\/p>\n<p>                       holding the post of Siksha Mitra is bad, will also not entail the<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>              consequential relief in favour of the petitioner for also his<\/p>\n<p>              appointment on the post of Siksha Mitra, inasmuch as, such prayer<\/p>\n<p>              was straight way rejected by this Court by order dated 7.9.2006 in<\/p>\n<p>              C.W.J.C.
