\tThis
\nappeal by the original writ petitioner is preferred challenging the
\njudgment and order passed by the learned Single Judge dated 30.9.2010
\nwherein the learned Single Judge dismissed the writ petition.\n<\/p>\n
2.\tBrief
\nfacts relevant for the purpose of deciding this appeal can be
\nsummarized as under.\n<\/p>\n
\tThe
\nappellant – original writ petitioner was granted quarry lease
\nin the year 1990 under the provisions of the Gujarat Minor Mineral
\nRules, 1966.  The said lease was renewed from time to time upto 1999.
\n In 1999, the appellant preferred an application for third renewal of
\nthe lease.  On 21.12.199, the said lease was sanctioned by the
\nCollector, Surat for the period from 8.9.1999 to 7.9.2002.  The
\nrecord reveals that the Collector, Surat failed to execute the lease
\ndeed in favour of the appellant.  On 13.6.2002, the Collector revoked
\nthe order granting renewal of the quarry lease.  The record further
\nreveals that on 28.3.2003, the appellant preferred an appeal against
\nthe said order, which came to be allowed by the appellate authority
\nand the matter was remanded to the Collector, Surat to consider the
\ncase of the appellant afresh for renewal of the quarry lease.\n<\/p>\n
\tThe
\nrecord reveals that on 31.1.2004, the Collector, Surat granted
\nrenewal of the quarry lease to the appellant for the period from
\n8.9.1999 to 7.9.2002 and also for the period from 8.9.1999 to
\n7.9.2005.  However, the period from 8.9.1999 to 7.9.2002 was treated
\nas lapsed by efflux of time.  It appears that by the time the lease
\ndeed could be executed by the Collector, the period of lease expired.
\n  On 3.10.2005, the appellant once again preferred an application for
\nrenewal of the lease and the application was not entertained.  An
\nappeal was preferred by the appellant against the order dated
\n29.10.2005 revoking the earlier order dated 3.1.2004 by which renewal
\nof the lease was sanctioned and by the very same order, the renewal
\napplication of the appellant was also rejected on the ground of
\ndelay.  Vide order dated 26.6.2007, the appellate authority dismissed
\nthe appeal of the appellant.  Vide order dated 13.2.2010, the
\nrevision application of the appellant also came to be rejected by the
\ncompetent authority.\n<\/p>\n
3.\tRule
\n11(4) of the Gujarat Minor Mineral Rules, 1966 reads as under :-\n<\/p>\n
“11.\tGrant
\nof execution of quarry lease.-\n<\/p>\n
(4)\tWhere
\na quarry lease is granted under sub-rule (1), the requisite lease
\ndeed shall be executed in triplicate within three months of the date
\nof the order sanctioning the lease, and if no such deed is executed
\nwithin the said period, the order granting the lease shall be deemed
\nto have been revoked :\n<\/p>\n
\tProvided
\nthat where the competent officer is satisfied that the applicant is
\nnot responsible for the delay in the execution of the lease deed, he
\nmay permit the execution of the lease deed even after the expiry of
\nthe said period of three months.”\n<\/p>\n
4.\tAll
\nthe competent authorities recorded a finding that there was a gross
\ndelay of 206 days at the end of the appellant in preferring the
\nrenewal application for the fifth time and inspite of two notices
\nserved upon the appellant dated 2.6.2004 and 21.9.2004, no steps were
\ntaken by the appellant for renewal of the lease.  The learned Single
\nJudge after taking into consideration the orders passed by the
\nauthorities below has recorded a finding that the appellant remained
\nabsolutely negligent and no sufficient cause could be assigned by the
\nappellant for the said delay.  The learned Single Judge also took
\nnotice of Rule 18(1)(A)(i) and (b)(i) of the Gujarat Minor Mineral
\nRules, 1966, which reads as under :-\n<\/p>\n
“18.\tPeriod
\nof the lease, renewals and availability of the area already granted,\n<\/p>\n
– (1)(a)(i)  Except in the case of ordinary sand, kankar, murram and
\ngravel, the period for which a quarry lease may be granted, shall not
\nexceed ten years in respect of all minor minerals.\n<\/p>\n
\tProvided
\nthat if the State Government is of the opinion that in the interest
\nof mineral development and industrial development of the State, it is
\nnecessary so to do, for the purpose of establishing a mineral based
\nindustry in the State, it may, for the reasons to be recorded in
\nwriting, grant a quarry lease for a period not exceeding twenty
\nyears.\n<\/p>\n
(ii)\t…\t…\t…\t…\t…\t…\t…\n<\/p>\n
(b)(i)\tThe
\nlease for all minerals specified in sub-clause (I) of clause (a) may
\nbe renewed by the competent officer for one or more periods and the
\nperiod of renewal at one time shall, not exceed ten year and the
\ntotal period for which the lease may be renewed shall not exceed
\ntwenty years in the aggregate.\n<\/p>\n
\tProvided
\nthat if the State Government is of the opinion that in the interest
\nof the Mineral Development and industrial development of the State,
\nit is necessary so to do, for the purpose of establishing mineral
\nbased industry in the State, it may, for the reasons to be recorded
\nin writing renew a quarry lease for a period not exceeding twenty
\nyears.”\n<\/p>\n
\tThe
\nlearned Single Judge noticed that in all 12 years’ period has expired
\nand as per Rule 18, there cannot be any further renewal of the quarry
\nlease as prayed for by the appellant.\n<\/p>\n
5.\tWe
\nalso take notice of the fact that the mining activity has also
\nstopped since a long period of time and it would not be appropriate
\nat all to grant any relief to the appellant – writ petitioner
\nat this stage after such a long period of time.\n<\/p>\n
6.\tWe
\nare in complete agreement with the reasons assigned by the learned
\nSingle Judge while dismissing the writ petition and we do not find
\nany error, much less an error of law, in the impugned judgment and
\norder.  For these reasons, the appeal fails and the same is hereby
\ndismissed with no order as to costs.\n<\/p>\n
7.\tIn
\nview of the order passed in the main appeal dismissing the appeal, no
\norders on the Civil Application.\n<\/p>\n
